Smith The invocation was given by Councilman Aust. Minutes of the regular meeting of August 16, 1966, were approved as recorded. The meeting was opened by Council holding a public hearing, as had been advertised, in the local newspaper, on the petition of Kahn & PUBLIC HEARING Feldman, Incorporated, requesting the town to vacate and abandon all of HELD ON PETITION OF KAHN & FELDMANthat certain fourteen (14) foot porton of an alley, and further, to take TO VACATE ALLEY. the necessary action to adopt an ordinance vacating and closing the said fourteen (14) foot portion of an alley described in said petition. Town Attorney Moore advised that it appeared that all legal steps had been taken; that the viewers had met and been instructed, and had made their report, as follows: Re: Town of Pulaski, Virginia Vacation and abandonment of a certain alley lying within the Town of Pulaski, Virginia, as more fully set out in a petition filed with said Town by Kahn and Feldman, Inc., said alley being therein described and hereinafter more fully detailed. Convening of the duly appointed viewers of said Town at 3:00 P.M., on the 6th day of September, 1966, in the office of the Town Attorney, Pulaski, Virginia. PRESENT: Garnett S. Moore, Attorney for the Town of Pulaski; Archa Vaughan, Jr. G. L. Plunkett and Dan C. Bell Viewers are hereby instructed by the said Town Attorney as follows: (1) That your appointment was made by the said Town under authority granted in Title 15.1-364 of the Code of Virginia of 1950, as amended, and any and all other general powers granted said Town. ~~`~"~~~ Council mina. contd. 9/6/66 (2) That as viewers appointed by said Town, you are instructed to view that certain alley set out and described fully in the petition filed, and described herein as follows: That portion of a certain 14-foot alley lying in Block 118, as shown on the Official Map of the Town of Pulaski, Virginia, and more particularly the portion thereof lying south of and beginning at the southern boundary line of Commerce Street and running between parallel lines South 2° 00~ West 376.17 feet to a point. (3) You shall determine by your view and your evaluation thereof whether or not any inconvenience would be caused by the closing of the aforesaid alley, and if any, what inconvenience would result and to whom, from discontinuing the portion requested as a part of the alleys of the Town of Pulaski, Virginia. (4) To report in writing your findings as above instructed in this matter to th® Council of the Town of Pulaski, Virginia. This report is to be filed as soon as convenient after you have viewed the proposed alley to be abandoned or vacated, and after your evaluation thereof from your view, and from such other facts you determine to be pert- inent thereto. We, the undersigned, viewers duly appointed by resolution of the Town of Pulaski, Virginia, adopted on the 16th day of VIEWERS REPORT August, 1966, convened in the Town Attorney's Office at 3;00 ON PETITION OF o~clock, P.M., on the 6th day of September, 1966, and at that KAHN & FELDMAN time were given written instructions by the Attorney for said TO VACATE ALLEY. Town of Pulaski, Virginia, upon our duties as viewers, the original of the instructions being herewith attached as a part of these proceedings. After reading the instructions, the undersigned did personally visit the location described in the aforementioned petition and in the instructions, and unanimously agree that the closing of the alley in question will create no inconven- ience to any one. AN ORDINANCE TO VACATE THAT CERTAIN 14 FOOT PORTION OF A DEDICATED ALLEY AS SHOWN UPON WHAT IS KNOWN AS THE OFFICIAL MAP OF THE TOWN OF PULASKI, VIRGINIA, LYING AND BEING IN THE TOWN, AND TO PROVIDE FOR PAYMENT OR COSTS, ETC. ORDINANCE ADOPTED WHEREAS, Kahn and Feldman, Inc., appeared by petition on TO VACATE AELE~t~IN the 16th day of August, 1966, before the Council of the Town of BLK, 118. ON PETITION Pulaski, Virginia, after posting due notice of the filing of OF KAHN & FELDMAN,INC. said petition as required by law in at least three plae®s in said Town on the 5th day of August, 1966, being at least ten days prior to the time of the filing of said petition which requested the Town to vacate and abandon all of that certain Fourteen (14) foot portion of an alley, and further, to take the necessary action to adopt an ordinance vacating and closing the said Fourteen (14) foot portion of an alley described here- after; and, WHEREAS, upon the filing of the aforesaid petition, the said Council did by resolution adopt on the 16th day of August, 1966, appoint C. L. Plunkett, Archa Vaughan, Jr. and Dan Be11 as viewers and C. C. Jordan alternate, as required under Section 15.1-364 of the Code of Virginia of 1950, as amended; and, WHEREAS, on the 6th day of September, 1966, said public hearing was convened pursuant to the aforesaid notice, and there appearing no persons opposed to the vacating and abandoning of said alley as set out in the petition and hereinbefore described, and upon the filing of the report of the viewers stating that in the opinion of the viewers no inconvenience would result from discontinuing the use of or:by closing the said portion of the a11ey; and, WHEREAS, the Council of the Town of Pulaski is of the opinion that no inconvenience would result to any one by reason of the closing of said Fourteen (14) -foot portion of the alley described, and that all requirements of Law have been complied.. with. BE IT FURTHER ORDAINED that Archa Vaughan, Jr., C. L. Plunkett, and Dan C. Bell, the aforesaid viewers, be paid the sum of Tet~_Dollars 010.00) each, and that the costs involved in the vacating of the aforesaid alley be paid by the petitioners. Dalton Clerk of Council Town Manager Norton presented the following applications to Council for permission to place hous® trailers within the corporate limits, and after due consideration of Council on each application, the fallowing action was taken: On motion of Councilman Aust, seconded by Councilman Eggert, and USUAL PROCEDURE carried, Mr. Gallimore abstaining, it was, RESOLVED, that the usual procedure TO BE FOLLOWED be followed - that of holding a public hearing by Council - on the application ON THE FOLLOWING TRAILER APPL. of David Leon Webb, to place a trailer at 517 Highland Terrace. DAVID WEBB BLANCHE HILL - On motion of Councilman Aust, seconded by Councilman Eggert, and JERRY SMITH. carried, Mr. Gallimore abstaining, it was, RESOLVED, that the usual procedure be followed in the application of Blanche Hill for the placing of a hous® trailer near Abe11's Junk Yard on Dora Highway. On motion of Councilman Aust, seconded by Councilman Eggert, and carried, Mr. Gallimore abstaining, it was, RESOLVED, that the application of Jerry F. Smith to place a house trailer on Randolph Avenue follow the usual procedure of such applications. Mr. Sutherland stated-that he had been asked to appear before Council on behalf of the local Economic Development Corporation of Pulaski County, which was crated about two years ago for the purpose of assisting .: ~] -, ~_ Council mins. contd. 9/6/66 '~ ~+~~~~ the Electro Plastic Fabrics plant in securing a loan with the Small Business Administration for the construction of a plant. Mr. Sutherland stated that with donations from local citizens and a loan from SBA, the Plastic Plant building will be completed within sixty days. He further stated that it now develops that under the municipal regulations of the Town a larger size water meter must be installed for the sprinkler system in the new building, the cost of which meter has been estimated at X4200.00, ATTY. SUTHER- and there are no funds available for this additional cost, and that SBA LAMA DISCUSSES WATER METER will not grant an additional loan for this purpose. Mr. Sutherland stated FOR ELECTRO PLASTIC. there is no way of raising the money unless local citizens would b® willing TURNED OVER TO WATF~?. COMM. to put it up, and he was in a position to advise the Town that the Economic Development Corporation of Pulaski County is willing to give the Town a bond to protect the Town against any loss of water which is not metered. On motion of Councilman Eggert, seconded and carried, the matter was turned over to the Water Committee for study and recommendation to Council. Mr. Farmer reported that the Ordinance Committee had met with the Town Manager and Town Attorney and had studied the amendment to the Taxi Ordinance, and recommended to Council the adoption of an ordinance having to do with rates and charges, and designated as Section 18-5A. Town Attorney Moore read to Council the proposed ordinance amending Section 18-5A and 18-6A, and on motion of Councilman Farmer, seconded by Councilman Eggert and carried, it was, RESOLVED, that the ordinance to amend and re-enact Sections 18-5A and 18-6A, having to do with rates and charges, be adopted, as follows: AN ORDINANCE TO AMEND AND RE-ENACT TAXI ORD. SECTIONS 18-SA, 18-6A, OF THE CODE ADOPTED. OF THE TOWN OF PULASKI BE IT ORDAINED BY THE COUNCIL OF THE TOWN OF PULASKI, VIRGINIA, THAT: Sec. 18-SA. Rates and Charges - Inside the Corporate limits. For the purpose of fixing and establishing rates for services rendered by public vehicles, taxicabs and for-hire cars within the corporate limits of the town, the town shall be divided into four zones, as follows: Zone One: Zone One shall be the area encompassed within the following .boundary: Beginning at the intersection of Randolph Avenue and Sixth Street, North; thence east with Sixth Street, North, to Prospect Avenue; thence south to Fifth Street, North; thence east with Fifth Street, North, to the intersection with Pico Terrace; thence east with Pico Terrace to Franklin Avenue; thence south with Franklin Avenue to Main Street (Route 99); thence west with Main Street, to Bell Avenue; thence south with Bell Avenue to the Peak Creek Channel change; thence in a southwesterly direction to the intersection of Dora Highway and Pearce Avenue; thence south with Pearce Avenue to First Street, South; thence west ,~~)Q~ Council wins contd. 9/"x/66 to Floyd Avenue; thence south to Second Street, South; thence west with Second Street, South, to its intersection with Washington Avenue; thence in a westerly direction to the intersection of Jefferson Avenue and Second Street, South; thence west to Valley Street; thence north with Valley Street and Randolph A venue to the Beginning. Zone Two: Zone Two shall be described as all that area lying outside of Zone One and bounded as follows: Beginning at a point where Thirteenth Street, North, would if extended, intersect with the west corporat® limit line of the Town of Pulaski; thence with Thirteenth Street, North, and Northwood Drive in an easterly direction to Lee Highway; thence in an easterly direction passing to the south of Barbara Lane and north of Elizabeth Street to the intersection of Peppers Ferry Road and Mashburn Avenue; thence east with Mashburn Avenue to old Newborn Road; thence in a southeasterly direction to the intersection of Ridge Avenue with Ward Lane; thence with Ridge Avenue south to its end; thence in a southwesterly direction to the intersection of Pesch Street and Main Street (Route 99); thence in a southwesterly direction to the intersection of Birch Street and Dora Highway; thence west with Dora Highway to its intersection with Holly Street; thence south with Holly Street to its intersection with Jackson Avenue; thence in a south westerly direction to the intersection of Stuart Avenue and Baskerville Street; thence wouth with Baskerville to its intersection with Fifth Street, South; thence in a southerly direction to the east end of Bunts Street; thence west with Bunts Street to Pearce Avenue; thence south on Pearce Avenue to its intersection with Lee Highway; thence in a westerly direction passing south of Haney Street to a point on Crestline Drive two hundred feet from Lee Highway; thence in a westerly direction passing north of Crestline Drive to the south end of Maple Street; thence in a Westerly direction to the bridge on Valley Street located approx- imately four hundred feet from the corporate limit; thence in a northwesterly direction to the intersection of Chest- nut Street and Garner Avenue; thence in a northwesterly direction to the intersection of Case Knife Road and Fayette Street; thence north with Fayette Street to a point where Fayette Street, if extended, would intersect with the N. & W. Railway; thence east with the railway to where it crosses Pesk Creek; thence north with Peak creek to the end of Vine Street; thence in a northeasterly direction to the intersection of Bluff Street and Summit Street; thence north with Summit Street to Mount Olivet Road; thence in a northeasterly direction to the bridge where Altoona Street crosses Peak Creek; thence with the west corporate limit of the Town in a northerly direction to the Beginning. Zone Three: Zone Three shall b® described as all that area lying outside Zone Two and within the corporate limits of the Town of Pulaski, except for the area here- inafter described as Zone Four. Zone Four: Zone Four shall be described as (1) all that area lying within the corporate limits of said Town and south of the following line: Beginning at the inter- section of Lee Highway with the south corporate limit of said Town; thence in a northeasterly direction passing north of Campbell Avenue and Hermosa Drive to a point where Bunts Street, if extended, would intersect with the east corporate limit line of said Town; and (2) 1 J Council mina contd. 9/&/66 all that area lying within the corporate limits of said Town and north of the following line: Beginning at a point on the north corporate limit of the Town lying north of Smith Lane; thence in an easterly direction to the intersection of Snyder Il.ane and Alum Springs Road; thence in an easterly direction to the intersection of Lee Highway and Pleasant Hill Drive; thence in an easterly direction to the intersection of Peppers Ferry Road and Allison Lane; thence east with Allison Lane to its inter- section with Newbern Road; thence in a southeasterly direction passing south of Monte Vista Drive to a point on Bob White Boulevard (Route 611) two hundred feet south of its intersection with Monte Vista Drive; thence continuing said southeasterly direction to a point on the east corporate limit of said town. (s) All buildings facing a Zone line shall be considered as being located within the lower Zon®. Sec. 18-6A. Same--Schedule. Provided that the proper state license fees have been paid, the following rates are hereby fixed for services rendered by public vehicles, taxicabs and for-hire cars within the corporate limits of the town. (a) For the transportation of one passenger in such s vehicle, the following rates within Zones, between Zones and into Zones shall apply: Embarkation Point Within: Destination Point Within: Rate: Zone 1 Zone 1 ~ .50 Zone 1 or 2 Zone 2 .55 Zone 1, 2 or 3 Zone 3 .65 Zone 1, 2, 3 or 4 Zone 4 .?5 Zone 2 Zone 1 .55 Zone 3 Zone 2 or 1 .65 Zone 4 Zone 3, 2 or 1 .75 (b) When both the embarkation point and destination point are in zones other than Zone 1~ and in traveling from the embarkation point to the destination point it is reasonably expedient from the standpoint of time, distance and street layout or condition to travel from the embarkation point back through Zone 1, an additional charge of ten cents (10¢) shall be made for each zone traveled into between Zone 1 and the destination point. (c) For the purpose of this section travel along a street which is a zone line, shall be travel through a zone. ADOPTED this 6th day of September, 1966. Approved: C. V. Jackson C. V. Dalton Clerk of the Council Mr. Sadler, representing the Taxicab organization, advised Council that he would see that the card which is now displayed in each TAXI'S TO CHANGE RATE taxicab be changed with regards to the charge shown thereon for trips CARD. outside the corporate 13.mits. Mr. Sadler further advised Council that t ~~-` ;''~`~~~ Council rains contd. 9~S/66 with regards to a complaint made against the cabs during bad weather last winter, his only suggestion was that during a state of emergency the Town take over the operation of the cabs when the cab companies refuse to travel. A petition to Council regarding improvements on Russell PETITION FOR IMP. ON RUSSELL Street, off Dora Highway, was turned over to the Street Committee ST., TURNED OVER TO ST. COMM. on motion of Councilman Gallimore, which motion was seconded by Councilman Aust, and carried. On motion of Councilman Gallimore, seconded by Councilman Frye, and carried the following resolution was adopted: BE IT RESOLVED, that Draft No. 1149 from Overnite Transportation Company in the sum of X200.00 be received and DRAFT FROM OVER-~ accepted in settlement of all claims arising out of the accident NITE TRANS. involving the town traffic light at the intersection of Main and ACCEPTID RE: ACCIDENT Jefferson Streets, on the 12th day of July, 1966; and that the INV. TRAF. LIGHT. Town Mansger be authorized to execute a release to the (hrernite Transportation Company, or its attorney. Town Manager Norton advised that it was the recommendation WATER COMM. MAKES of the Water Committee that water bills be sent out on the first day RECOMMENDATIONS of the month, and if bills are not paid by the 15th of the month, a ON WATER BILLS. ten percent (10~) penalty will apply, and if not paid by the 20th of the month, service will be discontinued, and a charge of X2.50 will be made to have the service cut back on. He further stated it was the recommendation of the committee that this information be printed on the utility bills for all to see. Town Manager Norton reported that the Water Committee had .made a study of water connection charges and recommended the following charges for water connections: WATER COMM. Size: Inside Outside REC. Council mina. contd. 9/x/66 '~~,~~: ) Town Manager Norton reported that the Sewer Committee had recommended the construction of the sewer line from Peppers SEWER COMM. MAKES REC. ON SEWER Ferry Road to serve the new subdivision on Route ll to be known LINE FROM PEPPERS FERRY TO SUNSET as Sunset Hills Subdivision, upon the condition that the subdividers HILLS SUB. advance deposit to the Town for thirty-six (36) sewer connections in the subdivision, at X50.00 each, or a total of X1800.00, and the Town would build the line. On motion of Councilman Aust, seconded by Councilman Gallimore, and carried, it was, RESOLVED, that the recommendation of the Sewer Committee be accepted. Councilman Gallimore moved that the subject of house trailers be placed on the agenda for immediate discussion. This motion was seconded by Councilman Farmer, and carried. Mr. Gallimore then moved that all applications for TRAILER APPL. permission to place house trailers in residential areas of the TO BE TABLED FOR FUR. STUDY. Town be tabled until a further study could be made of the present ordinance having to do with trailers. This motion was seconded by Councilman Cummings, and carried. Town Attorney Moore had no report to make on acquisition of right-of-way by the Highway Department. He reported that a BOOKLET GIVEN bQOklet was recently given to Chairman Farmer for s study of a CHRM. FARMER REG. ABANDONED proposed ordinance regarding abandoned cars. CARS. Councilman Gallimore moved that Mr. I. G. Vass of Galax, I.G. VASS be employed to make a study of the Town of Pulaski for city status. EMPLOYID TO STUDY CITY STATUS. This motion was seconded by Councilman Cummings, and carried. It was agreed by Council that the term of Mayor be considered at the next meeting of Council. As some members of the Council would be attending the Virginia COUNCIL TO MEET Municipal League meeting in Richmond on the next regular meeting date, SEPT. 22ND. September 20th, on motion of Councilman Gallimore, seconded by Council- man Ratcliff, it was, RESOLVED, that the next meeting of Council be set for Thursday, September 22nd, at 4:00 P. M.
