Minutes of a special meeting September 1, 1966, were approved, and the minutes of the regular meeting of September 6, 1966, were approved as 'corrected. Mayor Jackson advised that all legal steps necessary had been taken in the three applications for permission to place house trailers in the residential zones of the Town of Pulaski, and that Council would hear anyone either for or against the application of Jerry F. Smith to place a house trailer at 1607 Randolph Avenue. Councilman Gallimore asked that he be removed from the Council during JERRY SMITH this public heari ng of the Smith application, and nresQntQd to Council TRAILER APPL. DENIED. a petition from approximately fourteen property owners in this area opposing this application. Mayor Jackson advised that it was the policy of the Council where there is opposition on any house. trailer application, not to approve same. Mr. Smith advised Council that the trailer would be approximately two hundred and fifty feet from Randolph Avenue and would be hard to see from Randolph Avenue. On motion of Co~~ncilman Farmer, seconded by Councilman Frye, and carried, it was, RESOLVED, that the application of Jerry F. Hi hland Terrace. g TRAILER APPL. APPROVED. There appeared to be no objection to this application, and upon the report of Town Manager Norton, Mr. Eggert moved that the application be approved. This motion was seconded by Councilman Aust, and carried. There appeared to be no objection on the application of Mrs. Blanche Hill, to place a house trailer on Dora Highway, and upon the BLANCHE HILL TRAILER APPL. report of Town Manager Norton, Councilman Aust moved that the application APPROVED. be approved. This motion was seconded by Councilman Frye, and carried. Lt. David R. Coltrane filed an application for permission to place a house trailer at 605 Greenview Court, Orchard Road, on a lot NO ACTION TAKEN ON COL'~RANE owned by Fred A. Jackson for one year. At the last meeting of Council TRAILER APPL. it was agreed that all future applications for house trailers would be held in abeyance until the Ordinance Committee can make a report on the Trailer Ordinance. Therefore no action was taken on the Coltrane application. Town Attorney Moore presented a petition of Cecil Breedlove having to do with a drainage problem on Newbern Road, and across the property of Mr. Breedlove. Mr. Norton advised that he felt this STREET COMM. TO STUDY DRAINAGE problem could be worked out, but he was of the opinion that the property PROBLEM. RE: CECIL BREEDLOVE owner should share in the cost of correcting the drainage. On motion of PETITION. Councilman Cuunnings, seconded by Councilman Gallimore, it was, RESOLVED, that the matter be referred to the Street Committee for study and report. Councilman Frye asked that he be excused from serving on the Street Committee in this instance as he is the owner of property nearby. Mrs. Anne English appeared before Council and requested them to extend sewer and water services to the lots which she owns on English ANNE ENGLISH REQUESTS WATER Forest Drive, and in the discussion that followed it appeared that two & SEWER SERV . TURNED OVER TO separate lines would have to be installed to these lots, one of which WATER & SEWER COMM. would cross the Roop property, and the other from Newbern Road. Councilman Farmer moved that the request be referred to the Water and Sewer Committees for study and report to Council. This motion was seconded by Councilman Aust, and carried. Council mins. contd. 9/22/66 *•+ A delegation appreared before Council and requested that curb and gutter be installed on the West side of High Street - curb CURB & GUTTER REQ. FOR WEST, and gutter having been recently installed on the East side of High SIDE OF HIGH ST. REF. TO ST. COMM. Street. On motion of Councilman Aust, seconded by Councilman Cummings, and carried, the matter was referred to the Street Committee for report to Council. Town Council received an additional request for water service on Robinson Tract Road, from Reuben Hash. Councilman Gallimore moved that this request be included along with the other request received by REUBEN HASH REQ. WATER Council and considered in the same study for water service. This motion SERV . was seconded by Councilman Ratcliff, and carried. On a request from property owners on both sides of Allen Street CURB & GUTTER REQ. for curb and gutter on that street, on motion of Councilman Aust, seconded ON ALLEN ST. REF. TO ST. COMM. by Councilman Gallimore, and carried, the matter was referred to the Street Committee for report to Council. Mayor Jackson stated that he felt a definite policy should b® CURB & GLITTER APPL. PLACED made by Council in connection with applications for curb and gutter, and ON AGENDA. it was agreed by Council that this be placed on the agenda for the next meeting. Councilman Aust reported that three bids had been received oa the chassis for the new fire equipment just purchased, the low bid on s Ford truck being X6,638.30 and reported that it was the recommendation of PURCHASE OF FIRE TRUCK the committee that an order to purchase this Ford truck be approved; that APPROVID . the purchase of a pickup truck, funds for which are set up in the current budget, be deferred. On motion of Councilman Frye seconded by Councilman Eggert, and carried, it was, RESOLVED, that the report and recommendation of the Fire Committee be accepted and the Ford truck be purchased. Mr. Ratcliff reported that the special committee had contacted Dr. Foye Gibson of Asbury Acres Home, a Methodist Home for the Aged in MR GIBBON TO TOUR Maryville, Tennessee; that Dr. Gibson would be in Pulaski the next day SITES FOR METH. HOME. (Friday) for a tour of the available sites for the Methodist Home for the Aged which will be built west of Roanoke. Mr. Ratcliff advised there would be a luncheon meeting at the First Methodist Church Friday and the luncheon was open to all members of Council. `~~~.7~7 MAYOR REP. ON VA. MUNICIPAL LEAGUE MEETING. Council rains, contd. 9/22/66 Mayor Jackson gave a brief report on the recent meeting in Richmond of the Virginia Municipal League. Town Attorney Moore stated that earlier in the week Mr. Hurt TOWN ATTY. REP. ON RIGHT- OF-WAY ACQ. BY STATE HGHY. DEPT. had advised he had not heard anything with regard to right-of way acquisition by the State Highway Department, and that this subject had been discussed briefly in the Attorney's section at the League Meeting. Mr. Moore advised that Mr. Hurt would contact him as soon as he has heard something definite on this subject. An ordinance to amend and re-enact Sections 20-6, 20-7, 20-21, and 20-23 of the Town Code of the Town, of 1954, providing for application for water service; payment of deposits; discontinuance of service; penalties, etc., was read by Town Attorney Moore, and discussed by Council. On motion of Councilman Eggert, seconded by Councilman McCarthy, and carried, the following ordinance wss adopted, effective November 1, 1966. AN ORDINANCE TO AMEND AND RE-ENACT SECTIONS 20-6, 20-7, 20-21, AND 20-23 OF THE CODE OF THE TOWN OF ORDINANCE ADOPTED PULASKI, VIRGINIA, OF 1954, PROVIDING TO AMEr1D & RE-ENACT FOR APPLICATION FOR WATER SERVICE; SECT. 20-6,20-7, PAYMENT OF DEPOSITS; DISCONTINUANCE 20-21, 20-23, OF OF SERVICE; PENALTIES, ETC. CODE. BE IT ORDAINED BY THE COUNCIL OF THE TOWN OF PULASKI, RE: WATER 5F~EV. ETC. VIRGINIA, as follows: See. 20-6. Application for water service; deposits. Any person desiring to connect with the town water lines and to introduce town water into his premises shall make application for such service to the superintendent or other properly designated agent of said Town upon a form to be provided by the Treasurer. A Ten Dollar deposit shall be paid to the Treasurer at the time all applications for new water service are made, and in all cases where accounts for water service have been discontinued due to delinquency or failure to make payment of water bills. Any person making application for restoration of water services shall, in addition to making the above required deposit, pay all past due accounts, together with penalties, or any other sums due for service received at any location before restoration of water service is made. Only one Ten Dollar deposit shall be required for each water account, which sum shall be applied to all sums due at the time final bill is rendered either when services have been discon- tinued due to the person moving or non-payment for services, or for anyy othe r ason for which payment has not been made. Deposit shall be app~ie~ to all sums due whether for water service or penalty or for whatever other reason due to the water service. 1 1 1 Council mina. contd. 9/22/66 Deposits (or the residue if a part of said deposit is applied as herein provided) shall be returned without interest to any depositor upon discontinuance of service on payment of all sums due the Town. Sec. 20-7. Connections generally; connection fees. The provisions of this section shall apply to water connections and water connection fees: `~~39 (a) For service laterals where meters of the following sizes are installed connection fees, payable in advance, shall be as follows: Size: Inside Town Outside Town 5/8 or 5/8 x 3/4 X100.00 X200.00 3/4 135.00 200.00 1 165.00 200.00 1~ 200.00 24fl.00 l~ 250.00 300.00 2 325.00 390.00 (b) For service connections wherein three-quarters inch or larger meters would be necessary due to anticipated consumption, the town shall have the right to prescribe the proper size meter and to assess a connection fee accordingly. (c) In the event it should be necessary to make a connection to a standard domestic service for connection to the town water system without the installation of a water meter, the connection fee for such installations as would ordinarily require a five- eighths inch by three-quarters inch meter shall be X100.00. (d) For connections larger than two inches, the entire cost of installation shall be borne by the person requesting the service, with an additional ten percent added thereto if connection is made inside the corporate limits; and with an additional sixty per cent added if the connection is made outside the corporate limits. (e) A connection fee shall not be charged in cases where laterals of the property line have been installed or a connection fee paid prior to adoption of this section. (f) The collection of connection fees and the provisions of this section shall apply to all connections to the town public water system, both in and out of the corporate limits. Sec. 20-21. Discontinuance of service for delinquency in payment of water bill; assessment of penalties; restoration of service. The superintendent or other properly designated agent of said Town is authorized to discontinue water service furnished by the Town to its customers upon the failure to pay for water supplied at the rate established, and shall be restored only upon the customer meeting the conditions hereinafter provided. The following is hereby established as procedure for mailing water bills, notices, and method of restoration; (1) Statements of water accounts herein referred to as water bills are to be mailed on or before the first day of each month and shall thereon designate the date upon which the meter was read and the last date charges are included for services stated on said bill. ~9~ Council mina. contd. 9/22/66 (2) All water accounts .shall be due and payable on or before the fifteenth day of the same month upon which said bill is dated, and if not paid by the fifteenth, a ten per cent penalty shall be added to the total amount of the bill as of the fifteenth, unless, however, the fifteenth falls on a Saturday, Sunday or legal holiday, in which instance the ten percent penalty will be added as of the day following the next succeeding day of work. (3) If the bill for water service is not paid by the twentieth day of the same month upon which the bill is dated, service will be cut off on the twentieth, and will thereafter be restored only after payment of all arrears, including any penalties assessed, the deposit as provided in Section 20-6, and the re-connection fee as provided in Section 20-23. If a deposit is of record in the Treasurer's Office and has not been applied to any account, penalty, etc., no additional deposit will be required for restoration of service. If the twentieth should fall upon a Saturday, Sunday or a legal holiday, the cut-off or discontinuance of service will not be made until the day following the next succeeding day of work. (4) Statements of accounts mailed shall include water service, sewer charges, garbage charges, a statement of the provisions of penalties, and give notice of this and the date of disconnection of services as provided in this ordinance, and no further notice except that contained on said water bill shall be required of the Town, except the person who disconnects the w~tar service shall notify the customer that the water service is being discontinued and services disconnected at the time the service is disconnected. Sec. 20-23. Re-establishment of service after discat~tt~u~r3ib~ for.. faaliire to Qay bills . The superintendent or other proper agent of the Town shall not restore water service to any person whose service has been discontinued under the provisions of this ordinance until the customer has, in addition to paying the delinquent bill and other charges herein provided, paid a re-connecting charge of Two Dollars and Fifty Cents. Dalton Clerk of Council Town Manager Norton reported that he had discussed with Mr. Richard Bourbon, planning coordinator of the Federal Housing and Urban Development, whil in Richmond, the Town's application for federal funds for future plans for extending water and sewer services, and the possibility MR. BOURBON of Mr. Bourbon's attending a meeting at the Ruritan headquarters at Dublin TO ATTEND MEET. SEPT. 29, 1966. for September 29, 1966. He stated further that the New River Valley Council mins. conted. 9/22/66 Industrial Commission had planned to have all municipal and political subdivisions meet on October 17th for the establishment of a regional planning commission to serve the New River Valley area and had asked Mr. Bourbon to be with them for this meeting. Mr. Norton advised it now appears that a joint meeting will be held at the Ruritan National Headquarters in Dublin at 7:30 P.M. on September 29, 1966, and Town Manager Norton urged all members of Council to be present. Ia another matter Town Manager Norton advised Council that -~~~.)1 Mr. Harlan Westerman, Chairman of the Urban Planning Division at V. P. I. had read a newspaper article on the critical housing situation in Pulaski, and had contacted him for permission to set the situation up as a project SURVEY TO BE in his department. Mr. Norton advised that a meeting had been set for MADE BY V . P . I . STUDENTS. Friday afternoon at V. P. I. with Mr. Westerman and if an agreement is reached, the project will be carried out by Mr. Westerman's department at V.P.I., with the students making surveys pertaining to housing, income and employment, with such information to be formulated into a plan for use by the Town. Mr. Norton stated the overall housing program could be used in the town's attempt to obtain federal aid for a comprehensive town planning program. He further stated that there would be no cost to the Town for this work to be done by V.P.I. Town Manager Norton advised Council of a communication from CITY STATUS MY'• I. G. Vass of Galax, in which Mr. Vass acknowledged Council's approval STUDY TO BEGIN FIRST OF YR. of him to make the city status study, and advised that he would begin this study as soon after the first of the year as possible. The matter of house trailers carried on the agenda was carried HOUSE TRAILERS over to the next council meeting. Mr. Holyfield asked Council to include TO BE CARRIED ON AGENDA. in their study the use of trailers for business offices, etc., and located in the business area. Town Manager Norton advised that the Colonial Natural Gas Company is busy making connections, and he felt the council should consider the adoption o#~ the Southern Gas Code. The contents of the Southern Gas Code were discussed briefly, and on motion of Councilman Gallimore, seconded by ORD. COMM TO Councilman Ratcliff, and carried, it was agreed that the Code be turned STUDY SOUTHERN GAS CODE. over to the Ordinance Committee for study and report to Council at the next meeting. ~~~~~~ Council rains contd. 9/22/66 At this point Councilman Eggert moved that Council go into executive session.
