HomeMy WebLinkAbout10-20-64Minutes of the regular meeting of the Pulaski Town Council, held on the 20th day of October, 196b, at 1:00 P. M. in the Municipal Office. There were present: Mayor C. V. Jackson, presiding. Councilmen: W. A. Larson, W. S. Cummings, T. J. McCarthy F. L. Carrico, H. H. Eggert, Rudolph Farmer C. B. Gallimore Absent: Glan K. Aust Also present: Town Manager: T. B. Minutes of the regular meeting of September 15th were approved as recorded. Mayor Jackson advised this was the time and place, as advertised in the Southwest Times, for Council to hear any one either for or against the application of Mr. Kenneth Fagg for permission to place a house trailer at 818 Pepper Street. There appeared to be no APPROVES one present either for or against this proposal, and upon the recommenda- TRAILER APPLICATION tion of the Ton Manager, motion was made by Councilman Cummings, seconded OF KENNETH FAGG-PEPPER by Councilman Larson, and carried unanimously, that the application of STREET Mr. Fagg be granted upon the condition that a separate water and sewer connection be made for the trailer. In answer to an inquiry of Mr. and Mrs. Duncan as to what had been done to relieve the air pollution situation of which they had complained at a previous meeting, Town Manager Noland advised that a report had been received from three of the local industries, but a NO REPORT AS YET ON complete report could not be made at this time as there were two AIR POLLUTION MATTERh other industries to report, but he expected to make a report at the next meeting of Council. Councilman Larson advised that he had made an F Council mins. contd. 10/20/6b investigation of the situation and it was his belief that it was impossible for the screens on the stacks to catch all of the small AIR POLLUTION particles of dust, etc., and there might be some changes the plants CONTINUED could make to help the situation, such as higher smokestacks but this would run into ouite a large sum of money. Mayor Jackson stated that there would always be some air pollution in communities where there is industry, and that there was air pollution from small furnaces such as those used in residences, as well as from automobiles. He advised Mr. and Mrs. Duncan that a report would be made just as soon as all the plants were heard from. Mayor Jackson declared the meeting to be a public hearing as had been advertised in the Southwest Times on a reouest of the First Federal Savings and Loan Association to use and occupy a portion of Vashington Avenue on the east side thereof and a portion PUBLIC HEARING of Third Street on the south side thereof, now being used as a sidewalk for the purpose of brickcasing the building recently RE: ENCROACHMENT purchased by them at the corner of Third Street and Washington FIRST FED.SAVS. Avenue. No one appeared against this encroachment and Town Attorney Moore advised that the viewers had met and received instructions regarding this view, and had submitted their report, as follows: Re: Town of Pulaski, Virginia Vacation, alteration or abandonment of approximately four inches on Washington Avenue and Third Street as it fronts on property owned by the First Federal Savings and Loan Association of Pulaski, Virginia. Convening of the duly appointed viewers of the said Town at Ten o'clock on the 1st day of October, 196b, in the office of the Town Attorney, Pulaski, Virginia. INSTRUCTIONS PRESENT: Garnett S. Moore, Attorney for the Town of TO VIEWERS Pulaski Porter F. Lively Fred J. Swinburne and Ralph Martin The viewers are hereby instructed by the said Town Attorney as follows: 1 1 1 Council mins. contd. 10/20/64 (1) That your appointment was made by the said Town under authority granted in Title 15.1-36)-, of the Code of Virginia of 1950, as amended, and any and all other general powers granted said Town; (2) That as viewers appointed by said Town, you are instructed to view those certain premises set out and described in the resolution adopted by the Town Council, being that portion of the First Federal Savings and Loan Association building on the east side of Washington Avenue and south side of Third Street, North, in the Town of Pulaski. INSTRUCTIONS (3) You shall determine by your view and your evaluation thereof whether or not any inconvenience would be caused by the TO VIEWERS closing, abandonment, or the alteration of any of the aforesaid, and if any, what, inconvenience would result and to whom from discontinuing the same as a part of the streets of the Town of Pulaski, Virginia. (4) To report in writing ,your findings as above instructed in this matter to the Council of the Town of Pulaski, Virginia. This report is to be filed as soon as convenient after you have viewed all of the proposed streets, or easements to be abandoned or altered, and after ,your evaluation thereof from your view, and from such other facts .you determine to be pertinent thereto. PETITIONER: First Federal Savings and Loan Association of Pulaski, Virginia We, the undersigned, viewers duly appointed by reso- lution of the Town of Pulaski, Virginia, adopted on the 15th day of September, 1962, convened in the Town Attorney's office at 10:00 o'clock A. M., on the 1st day of October, 1961.,, at that time we were given written instructions by the Attorney for said Town of Pulaski, Virginia, upon our duties as viewers, the original of these instructions being herewith attached as a VIEWERS" part of these proceedings. REPORT After reading the instructions, the undersigned did personally visit the location described in the aforementioned resolution and in the instructions, and we do unanimously agree that the vacation and abandonment of approximately four inches along the east side of Washington Avenue and south side of Third Street, North, immediately adjacent to the property lines of the property of the First Federal Savings and Loan Association of Pulaski (known as the Steger Building), will create no inconvenience to any one. SWINBURNF A940 Council mins. contd. 10/20/611 On motion of Councilman Eggert, seconded by Councilman Larson, and carried unanimously, on the vote of those present, the following ordinance was adopted: AN ORDINANCE TO GRANT A LICENSE TO OCCUPY AND TO VACATE THAT CERTAIN STRIP OF LAND ON THE EAST SIDE OF WASHINGTON AVENUE AND THE SOUTH SIDE OF THIRD STREET, NORTH, IN THE Ta4N OF PULASKI, VIRGINIA, A DISTAYCF OF 50 FEET ON WASHINGTON AVENUE AND NOT TO EXCEED 130 FEET ON THIRD STREET, IN IENGTH AND APPROXIMATELY 1.1 INCHES FROM THE PR OPE RTY LINE ONTO THE RIGHT OF WAY OF THAT PORTION OF WASHINGTON AVENUE AND THIRD STREET, ADJACENT TO THE PROPERTY LINE, AND TO PROVIDE FOR COSTS WHEREAS, the First Federal Savings and Loan Association of Pulaski, Virginia, owner of Lots no. 2 and 4 in Section 32, at the southeast corner of Washington Avenue and Third Street, North, requested the Council of the Town of Pulaski, Virginia, for permission for landowner to use and occupy a portion of Washington Avenue on the east side thereof and a portion of Third Street on the south side thereof, now being used as a sidewalk or walkway, not to exceed four plus inches along a portion of the property of said landowner and adjacent thereto, to enable said landowner to construct a wall against the present wall of said building, and to otherwise improve said building; and, WHEREAS, upon consideration of the request the Council did upon its own motion appoint Porter F. Lively, Fred J. Swinburne, ORDINANCE TO and Ralph Martin as viewers, and J. H. White as alternate, under VACATE AND provisions of Section 15.1-361, of the Code of Virginia of 1950, as ALLOW ENCROACH- amended; that said viewers did meet on the lst day of October, MENT FI9ST FED. 1961x, and the attorney for said Town did give to them written instructions setting out their duties; whereupon, the said viewers did view said premises and have filed with the Council their report as directed; and, WHEREAS, subsequent thereto all of the landowners who would be affected by the requested action and the motion of the Council were given notice of the proposal and of a public hearing thereon to be held at 1:00 o'clock P. M.1 on October 20, 19611, in the Council Chamber in the Town of Pulaski, and further notice being given by publication in the Southwest Times, a local newspaper, on October 6th and 13th, 1961; and, WHEREAS, at 1:00 o'clock P. M. on the 20th day of October, 196L, said public hearing was held pursuant to the aforesaid notices, and there appearing no person opposed to the granting of said license and of vacating said portion of the street, and upon the filing of the viewers' report stating that in their opinion no damage would result to other property owners and no inconveniences would result from the vacation or alteration of the necessary portions of Washington Avenue and Third Street, North; and, WHEREAS, the said Council of the Town of Pulaski, Virginia, is of the opinion that the proposed construction by the First Federal Savings and Loan Association of Pulaski will improve said premises, make them safer and more, presentable, and it further appearing that no inconvenience would result by allow- ing the landowner to occupy the portion of said street not ex- ceeding four (4) inches plus in width for the purposes of con- t'941 Council mins. contd. 10/20/61, structing a new wall and other improvements, and providing that said landowner shall hold the Town harmless for any damage to any person or property by reason of the existence of said encroachment upon the right of way of Washington Avenue and Third Street, North, and providing further that said landowner shall submit to the Manager of the said Town the specifications of its proposed improvement prior to the beginning of the construction thereof, f -or his approval; NOW, THEREFORE, BE IT ORDAINED by the Council of the Town of Pulaski, Virginia, as follows: That permission be, and it is hereby, granted unto the First Federal Savings and Loan Association of Pulaski, Virginia, for a license to occupy that certain strip of land not to exceed four (4) inches plus in width and adjacent to its western property line on Washington Avenue and its northern property line on Third Street, North, and the aforementioned strip of land is vacated and abandonded for the purpose for which the said permission is granted, the said portions abandoned being shown on a plat prepared by R. Lloyd Mathews, Town Engineer, dated July 211, 1961,, entitled "Plat Showing Property Surveyed for First Federal Savings and Loan Association" for the purpose of placing ORDINANCE thereupon another wall to support and improve the existing building at this location; subject, however, to the said First CONTINUF'D Federal Savings and Loan Association of Pulaski, Virginia, holding the said Town harmless for any damage or injury to any person, or property, by reason of the said construction occupying a portion of the right of way of Washington Avenue and Third Street, North, and to reimburse said Town for any expenses made by reason of any claims therefor; and the construction of said wall shall constitute acceptance bf this, (;ovehaftt of indemnity. BE IT FURTHER ORDAINED that the Town Manager of the said Town shall cause to be recorded in the Deed Books of the County of Pulaski, Virginia, located in the Clerk's Office of the said County, a copy of this ordinance, and to take any and all other steps necessary to properly place on the record the said ordinance. BE IT FURTHER ORDAINED that porter F. Lively, Fred J. Swinburne, and Ralph Martin, the viewers, be paid the sum of Ten Dollars (910.00) each, for their services rendered, and that all of the costs and expenses involved in the granting of the license be assessed against the First Federal Savings and Loan Association of Pulaski, Virgida. WHEREUPON, this ordinance is hereby adopted by the recorded vote of said members of Council as follows: Woodson Cummings - aye Fred Carrico - aye Claude Gallimore - aye T. J. Mr. Frank Kesling appeared before Council regarding bids which were recently submitted to the Town for hauling and FRANK KESLING RE: HAULING furnishing the Town's needs of stone, but as this was an FOR TOWN administrative matter,no action was taken by Council. Mr. D. T. Vaughn, Vice President of Twin OAKS Water Company, Inc., appeared before Council with the request to purchase wa e purchase water from the Town, and suggested that a master meter be placed at the corporate limits nearest Twin Oaks Sub- division on Newbern Road, with the Twin Oaks Company being responsible for distribution lines to the twenty-one property TWIN OAKS REQ. TO PURCHASE WATER owners in the subdivision. After a short discussion of the FROM TOWN TURNED OVER TO WATER request, on motion of Councilman Carrico, seconded by Councilman COMMITTEE FOR STUDY & REPORT Farmer, and carried, it was, RFSOLVFD, that the reouest be turned over to the Later Committee for study and report to Council. Town Manager Noland gave a report on information obtained from the Virginia Municipal League for getting rid of pigeons. REPORT FROM VA. MUNC. LEAGUE No action was taken by Council. RE: PIGEONS Councilman Fggert, as Chairman of the Land Buildings and Parks Committee, advised that further study is ARCHITECT FOR TOWN HALL being made in the selection of an architect for the proposed new Town Hall. Councilman Carrico, as Chairman of the Sewer Committee, HANEY ST. REQ, advised that because there are no sanitary sewer line extension FOR SEWER ADDED TO LIST; BYRD funds available, the Haney Street petition for sewer services had been DRIVE & ALUM SPG. RD. PROJECT added to the list of sewer services which now includes eight re - SHOULD BE JOINT CONSTRUCTION quests. He further stated that the Alum Spring -Byrd Drive projects should be a joint construction; that the construction of all eight lines would cost the town approximately $100,000.00. Mr. Carrico advised that his Committee would make a further study of the situation in the spring to see what can be done at tha t time. On motion of Councilman McCarthy, seconded by Bouncilman MAPLE & VALLEY Cummings, and carried unanimously, it was, RESOLVED, that the Town Manager be directed to see that the Street is placed in passable condition. On motion of Councilman Gallimore, seconded by Councilman McCarthy, and carried unanimously, Mayor Jackson was authorized to sign the agreement, on behalf of the Town. Town Attorney Moore, at the request of Council, advised that it would be possible for the Town to require the payment of LEGAL TO REQUIRE Personal property taxes on vehicles before issuing new license tags, but PAYMENT OF PER PROP. that he would have to check further as to requirements regarding the TAXES BEFORE ISSUING AUTO payment of all taxes. LICENSES The Town Attorney advised that no definite action had been cem.trustees taken with regards to the appointment of Trustees to the Oakwood Cemetery Trust Fund. Mr. Moore advised that the Virginia Advisory Legislative Council will hold a public hearing on possible changes in the urban highway program, on November 5th, in an attempt to develop answers to what financed and developed through cities and towns, and what should be urban places should participate in the urban system program; what PUB.HEARING VA.ADV.LEGIS.proportion of total highway funds should be allocated to the urban COUNCIL ON ON URBAN L system; whether the present 85-15 percentum construction cost ratio WAYS TOWM MGR. &!MAYORis eouitable; whether the present system of maintenance payments on TO ATT�*D a mileage basis is equitable; how the arterial system should be financed and developed through cities and towns, and what should be AV 4 Council mins. contd. 10/20/61c with respect to streets and highways within the limits of municipalities which are completely rural in nature. Mr. Moore further advised that he planned to be in Richmond on that day and would attend the meeting, but felt the Town Manager and Mayor MAYOR AUTHORIZ. TO SIGN NEW LIGHTING CONTRACT WITH APCo. On motion of Councilman Larson, seconded by Councilman Cummings, and carried unanimously, it was, RESOLVED, that the resolution authorizing the acceptance by the Town of Pulaski of a contract with the Appalachian Dower Company for the new lighting system, authorizing the Mayor to sign the contract for the Town, be adopted conditioned upon a review of said contract by the Town Attorney. On motion of Councilman Gallimore, seconded by Councilman Larson, and carried unanimously, it was, RESOLVED, to participate on a 50-50 basis with the Merchants Council for the installation of electrical receptacles on poles in the downtown area for the purpose of better and quicker installation of Christmas lights. On motion of Councilman Gallimore, seconded by Councilman Eggert, and carried unanimously, it was, RESOLVED, that the Town Manager be directed to proceed in accordance with the Town Code, in removing certain properties whichare unsightly and unsafe. It was reported that 6,000 feet of pipe had been laid on the Dublin Water line project. Mayor Jackson reported that the Committee for providing for the caretakers house at Warden Springs is now considering the purchase of a modern second-hand house trailer, rather than building a house, it being the committee's thought that some money could be saved by purchasing a trailer and asked Council to make a formal recommendation to the Committee. It was felt that a trailer could be purchased for approximately $2500.00, and the construction of a house would be approximately $8,000.00. On motion of Councilman McCarthy, seconded by Councilman Larson, and carried unanimously, it was, RESOLVED., that the Dublin Water Line Committee - comprised of W. S. Cummings, T. J. T,cCarthy, H. C. Jackson, T. B. Noland and R. Lloyd Mathews - be given authority to purchase a good second-hand house trailer for the caretaker to live in at ?garden Springs, if such a trailer can be purchased for $2200.00 or $2300.00.
