V. Jackson, presiding. Councilmen: W. S. Cummings, H. H. Eggert, C. B. Gallimore W. A. Larson, Glen K. Aust, F. L. Carrico, Rudolph Farmer, T. J. Nuckols, Attorney The invocation was given by Councilman Aust. The minutes of the regular meeting of June 1st were approved, as corrected. Mr. Philip Sadler appeared before Council to learn if Council had arrived at a decision upon the request of City Cable Company to transfer the franchise granted to them on July 21, 196l~, by the Pulaski Town Council, to the Booth Broadcasting Company. Mr. Sadler stated that his investigation of the Booth Broadcasting Company confirmed the COUNCIL TO WAIT ON report in Dunn & Bradstreet, and that it appeared that the Company REPORT OF TOWN MGR. had assets of between $750,000.00 and a Million Dollars. Oouncilman Gallimore, Councilman Eggert abstaining, it was, RESOLVED, that Council wait and hear the report from the Town Manager on his investigation of the Booth Broadcasting Company and of the general CATV situation, which had been requested by Council. ~,- A petition was presented to Council on behalf of Thomas J. McCarthy and Virginia Commonwealth Properties, Incorporated, by Attorney Eugene Nuckols, in which the Council was reauested to adopt an ordinance as authorized by Section 15..1-377 of the Code of Virginia, COUNCIL ADOPTS ORDINANCE RE: authorizing petitioners, legal and equitable owners of what is known as EXISTING ENCROACHMENT Hotel Pulaski Building, to maintain the existing encroachment of said OF HOTEL PULASKI BLDG. building along.Washington Avenue and Second Street, North (Main Street), as shown on the plat prepared by R. Mr. Nuckols explained that this 3-1/2" encroachment was discovered only recently when title work was being done and after survey by Mr. Mathews, for the Virginia Commonwealth Propertiesi Inc., who plan to purchase the property from Mr. T. J. McCarthy. At this point Councilman McCarthy asked to be excused and left the meeting during discussion and action on this petition. Mr. Nuckols presented to Council an ordi Hance carrying out the request contained in the petition. The ordinance was examined by Town Attorney Moore, who stated that the ordinance seemed to be in proper form and that it would seem to be a matter of certifying title more than anything else, and the adoption of the ordinance would take care of this situation. Councilman Carrico reported that the committee of Councilmen Cummings, ?{'ggert, Carrico and Gallimore, Mr. Gallimore having been appointed by Njayor Jackson to take the place of Councilman McCarthy, had met and made an investigation of the encroachment, and it was the recommendation of the committee, upon the approval of the ordinance by the Town Attorney, that the ordinance be adopted. Mr. Carrico made this recommendation in the form of a motion, which was seconded by Councilman Larson, and carried on the following recorded vote: W. A. Larson - aye H. H. Eggert - aye W. S. McCarthy - absent from meeting the following ordinance was adopted: AN ORDINANCE ALLOWING AN ENCROACHMENT UPON TOWN PROPERTY OF A CERTAIN PORTION OF THE EASTERN AND NORTHERN WALLS OF A BUILDING LYING AND BEING ON BLOCK NUMBER TWENTY-ONE (21) IN THE TOWN OF PULASKI OWNED BY THOMAS J. McCARTHY ORDINANCE BE IT ORDAINED BY THE COUNCIL OF THE TC~IN OF PULASKI, VIRGINIA, FOR HOTEL meeting in regular session on the 15th day of June, 1965, that: BUILDING ENCROACHMENT WHEREAS, the facing on the wall of a certain building constructed upon the northeast portion of Block Number Twenty-One (21) as shown on a plat known as "Corrected Plan A" cf the Pulaski Land and Improvement Company, fronting 125 feet on Washington Avenue and 130 feet on Second Street, North, encroaches on and upon Washington Avenue and Second Street North a distance of three and one-half (3-1/2) inches, as shown on a survey of the property of Thomas J. McCarthy, known as the, Hotel Pulaski Property, by R. Lloyd Mathews, Registered Surveyor, dated the 12th day of June, 1965, attached hereto and made a part hlereof. '~.)~~ Council rains. contd. 6/15/65 WHEREAS, said encroachment has been in existence for a considerable period of time, is not susceptible to moving without destruction of the building, and whereas, said encroachment, as it now exists, permits free and unobstructed passage and use of both Washington Avenue and Second Street North. NOW, THEREFORE, BE IT ORDAINED that pursuant to Section 15.1-377 of the Code of Virginia of 1950, as amended, Thomas J. McCarthy, the present owner, and his assigns, of said property is hereby authorized to maintain such encroachment as it now exists, until such time as said building is destroyed or removed. BE IT FURTHER ORDAINED that when and if any portion of the building be removed or destroyed this said authorization shall immediately cease as to the encroachment along such portion of the building removed or destroyed; and further that nothing herein contained shall be construed neither to impose upon the municipality any obligation whatsoever for the existence of said encroachment nor to impose upon said municipality any liability to any persons whomsoever by reason of this authority nor to relieve said owners, nor their successors in title, of any liability for negligence or otherwise on their part on account of such encroachment. This ordinance shall be in full force and effect upon its adoption. Adopted this 15th day of June, 1965. Mr. Nuckols advised Council that he was contemplating purchasing a lot from Mrs. Anne English on English Forest Road, being the same lot about which Mr. Milder A. Bushong had contacted Council several months before and requested sewer service to this lot. On motion of Councilman Aust, seconded by Councilman Farmer, and carried, it was, RESOLVED, that the petition be turned over to the Sewer Committee for study and recommendation to Council. Chief of Police Comer advised Council of the many complaints coming to his department with reference to growth on vacant lots, and asked Council to set a date for these lots to be cleaned up, so his department could proceed with the enforcement of the ordinance. There followed a discussion of this situation, and Town Attorney Moore advised that he would make a study of the ordinance now in effect and advise Council. Town Attorney Moore presented to Council an ordinance to name 1 1 ORDINANCE ADOPTED NAMING 61I (Newb®rn Rd) "BOB WHITE BLVD." a street beginning at the intersection of '#611 with State Route #99 and terminating at the east corporate limits of Pulaski, the "BOB WHITE BOtTLEVARD" in memory of Mr. Tn?. F. ~~?hite, which Council had asked its Attorney at a prior meeting to prepare, On motion of Councilman McCarthy, seconded by Councilman Larson, and carried, the following ordinance was adopted: AN ORDINANCE TO NAME A STREET WITHIN THE TOWN OF PULASKI, VIRGINIA, THE "BOB WHITE BOULEVARD" WHEREAS, W. F. ?°ldhte, affectionately known as Bob White, served the Town of Pulaski well and faithfully for a period of sixteen years as a member of the Town Council and as Vice-Mayor for a great part of that time; and, WHEREAS, the services rendered by ~r?. F. White through the years have been of great value and the people of Pulaski continue to profit and benefit by his efforts and his wisdom, and will be the benefactors of his most efficient service for many years to come; and, WHEREAS, the Council of the Town of Pulaski desires to name a street in commemoration of his services to the Town of Pulaski; NCW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE TOWN OF PULASKI, VIRGIMA, that: The portion of State Route #611 now under construction located within the corporate, limits of the Town of Pulaski, Virginia, beginning at the intersection of #611 with State Route #99 and terminating at the east corporate limits of the said Town be, and the same is hereby, designated and named the "Bob White Boulevard" in memory of t~?. F. White, a member of Town Council for sixteen years. ,i ~~~ Council rains. contd. 6,!15/65 BE IT FURTHER ORDAINED that the officials of said Town shall cause to be erected proper signs bearing the aforesaid name of "Bob White Boulevard" along said boulevard at such places as they may determine to be necessary and proper. Town Attorney Moore presented a copy of the legal notice which had been placed in the Southwest Times as of that day (June 15th), for a public hearing on June 30, 1965, at lt:00 P. M. in the Council room, of Council's proposal to increase the tax rate for the fiscal year beginning July 1, 1965, upon real and personal property, and all other property subject to a local tax levy, within said Town, from X1.60 for each $100.00 of assessed value of taxable property, to $1.80 for each $100.00, an increase of Twenty Cents (20¢) per X100.00. On motion of Councilman Larson, seconded by Councilman Eggert, and carried unanimously, it was, RESOLVED, that the Mayor be authorized to give notice of the public hearing on June 30, 1965, and that a copy of the notice be accepted and filed in the minutes of Council, as follows: LEGAL NOTICE PROPOSED '13~AS~ l~TAX RATE AND OF PUBLIC HEARING THEREON FOR THE TCFnTN OF PULASKI, VIRGINIA NOTICE OF PUBLIC HEARING ON INCREASE OF TAX RATE FROM $1.60 TO $1.80 EA. $100.00 VALUE TAKE NOTICE, that the Council of the Town of Pulaski, Virginia, proposes to increase the tax rate for the fiscal year beginning on July 1, 1965, upon real and personal property, and all other property subject to a local tax levy, within said Town, from $1.60 for each $100.00 of assessed value of taxable property to $1.80 for each $100.00, an increase of .0.20 (twenty cents) per $100.00; that the said Council gives further NOTICE of a public Hearing at 1:00 P. Dalton Clerk of Council ~~"'~~ Council mins. contd. 6/15/65 Town Attorney Moore advised Council that it m+ast hold a public hearing on its budget for the fiscal year 1965-66 at least seven days prior to July 1, 7965, which would be June 2~tth, and that notice of sari hearing on the 2~~th must appear in the newspaper at the latest on June 17th, together with a summary of the budget, and that final adoption of the budget could come after July 1. On motion of Councilman Carrico, seconded by Councilman Farmer, and AUTHORIZE PROPER NOTICE carried unanimously, it was, RESOLVED, that the proper notice be BE GIVEN FOR PUBLIC HEAR- given for the holding of a public hearing on the proposed budget for ING ON BUDGET FOR 1965-66 1965-66 at lt:0o P. Jackson, Director of Pablic Z~TOrks, informed Council that it was not feasible to continue using the mountain area for a land- fill, and asked Council to be considering other possible sites. On motion of Councilman McCarthy, seconded by Councilman Carrico, and carried unanimously, it was, RESOLVED, that the matter be turned COMMITTEE TO INVESTIG- over to the Sanitation and Cleanliness Committee, for investigation ATE LOCATION OF NEW LAND- and report to Council. Mayor Jackson asked Councilman Cummings to FILL & REPORT TO COUNCIL serve on this Committee in the place of Councilman Aust, since Mr. Harry Aust owns a possible landfill site, and negotiations may be made with him for same. Councilman Larson, as Chairman of the Finance Committee, advised that an increase in garbage rates would net the Town additional revenue in the sum of X10,000.00; a two cent increase on cigarettes and one ceMt on other tobaccos, would net approximately $35,000.00; and an increase TG~+1N ATTY. of twenty-cents, from $1.60 per hundred assessed value to $1.80 per AUTHORIZED TO PREPARE hundred assessed value on real and personal property taxes would net ORDINANCE FOR GARBAGE approximately $18,Z~00.00. Town Attorney and Town Manager be authorized to proceed with the prepa~a- tion of ordinances to take care of the garbage rate increase, and tobacco tax increase. ~~~0 Council mins. contd. 6/15/65 On motion of Councilman Carrico, seconded by Council- RESOLUTION- LONG SERVICE OF FIRE CHIEF RAY man Cummings, and carried unanimously, it was, RESOLVED, that an appropriate resolution be adopted by the Council recognizing the long and faithful services rendered to the Town of Pulaski by Fire Chief D. G. Ray, who passed away Friday, June 11th, with a copy of same being posted at the Fire House and copy mailed to his family. Director of Public Works Jackson advised Council that the `" ; DIR. RD., RESULT OF CONSTRUCTION OF RT . 738 Town will lay l~20 feet of eight inch pipe on the Robinson Tract Road directly in front of the Needmore Tank made necessary by the re- construction of Route #738, which would cost approximately $2800.00, but which cost would be reimbursed by the State Highway Department. On motion of Councilman McCarthy, seconded by Councilman Carrico, and carried unanimously, the Director of Public Works was given authority to carry out this work as outlined. H. C. WKS. tion of a half-million gallon water tank for Hall's Hill: half- million gallon water tank to cost $21,3li5.00; -feeder line costs $2,150.00 - making the entire project cost approximately $32,Zt95.00, not counting main extensions to serve the Sutherland ?^Toods area. Mr. Jackson explained to Council that action on this matter should be taken as soon as rossible inasmuch as these dealers have to send in to the steel companies their anticipated needs to obtain their steel allotment, and if this is not done soon, it may not be possible to get the tank at an even greater figure. It was the feeling of Council that the Water Committee should work on this project, and that it could be discussed at the meeting of June 21~th or the 30th. Jackson stated he had discussed the matter with the Gas Company's represnetative, NIr. Foster, and he had indicated that the Company would return and fix these places, Council authorized Howard Jackson to see that this was done. Councilman Carrico asked Mayor Jackson to write a letter KLASSROOM KWIZ LETTER to the Pulaski High School Key Club and commend them on their seven week win on TV's Show, KLASSROOM KWIZ.
