Waiver of notice of special meeting of the Town WAIVER OF NOTICE OF SPECIAL MEETING (&' COUNCIL Council of the Town of Pulaski was presented as follows: WAIVER OF NOTICE OF SPECIAL MEETING OF COUNCIL TOWN OF PULASKI We, the undersigned, duly elected members of the Council of the Town of Pulaski, Virginia, hereby waive notice of a Special Meeting of said Council at 10:00 o'clock A. M., on the 1st day of July, 1.965, called by C. V. Jackson, Mayor, in the Municipal offices of the Town of Pulaski, Virgi nia, for the purpose of considering the borrowing of the sum of Twenty-Two Thousand Dollars ($22,000.00); Eleven Thousand Dollars ($11,000.) thereof from the Pulaski National Bank of Pulaski, and Eleven Thousand Dollars 011,000.00) thereof from the Peoples National Bank of Pulaski, and transact any other business that may properly come before said meeting. PROPERTY REAL AND TANGIBLE PERSONAL LOCATED iiJITHIN THE TOWN, NOT EXEMPT FROM TAXATION, BEGINNING JULY 1, 1965, FOR GENERAL FUND USE OF SAID TOGTN, AND AUTHORIZING THE COLLECTION THEREOF. BE IT ORDAINED BY THE COUNCIL OF THE TOWN OF PULASKI, VIRGINIA, that: INCREASE xN TAX LEVY FROM $1..60 PER HUNDRED TO $1.80 PER HUNDI~D VALUE 1 There is hereby established, imposed, levied and fixed a tax of $1.80 on each $100.00 assessed value, or a fractional part thereof, on all property, real and tangible personal located within the Town and segregated for local taxation and not exempt from said levy, for the fiscal year beginning July 1, 1965, and for each subsequent year thereafter until. otherwise changed and upon being reaffirmed from year to year by said Council in connection with the adoption of the budget of said Town; said revenues derived from the tax levy to be used for the general fund obligations and purposes of the Town payable from said general fund, including but not limited to the payment of salaries of officers and Pmployees, construction, maintenance and repair of streets, alleys, and bridges, interest or principal sums due upon any public debt, to provide any necessary and required sinking fund, to pay for any capital expenditure as well as current obligation, and any payment whatsoever which may be directed by the properly constituted authority of said Town and lawfully payable from public funds. Carrico - absent ~~~~ AN ORDINANCE to levy and to impose a tax on the sale at retail within the Town of Pulaski of any cigarettes, cigars, smoking tobacco, chewing tobacco, and snuff, as herein provided; defining certain words and phrases used; fixing the rate and amount of tax, providing for the payment thereof by every seller into the general fund of the Town; defining violations of the ordinance and prescribing penalties therefor; and providing for the separability of the provisions hereof . BE IT ORDAINED by the Council of the Town of TOBACCO TAX ORDINANCE Pulaski as follows: I. DEFINITIONS. The following words and phrases, when used in this ardinance, shall for the purpose of this ordinance have the following respective meanings, except where the context clearly indicates a different meaning: (1) The word "Town" shall mean the Town of Pulaski, Virginia. (2) The masculine pronoun shall include the feminine and neuter, and the singular shall include the plural. (3) The word "and" shall also mean "or'" , and the word "or" shall also mean "and" , whenever the context or purpose so requires. (4) The word "person" shall mean and include any individual, partnership, society, association, joint stock company, corporation, estate, receiver, trustee, assignee, referee or any other person acting in a fiduciary or representa- tive capacity, whether appointed by a court or otherwise, and any combination of individuals. (5) The word "Treasurer" shall mean and include the Treasurer of the Town and every person duly authorized by him to serve as his representative. ]C_ ~a7 _ ~:~, (6) The word "sale" shall mean and include every act or transaction, irrespective of the method or means employed, including the use of vending machines and other mechanical devices whereby title to any cigarettes shall be transferred from the seller, as herein defined, to any other person within the corpdrat limits of the Town. (7) The word "seller" shall mean and include every TOBACCO TA,X ORDINANGB person engaged in the business of selling cigarettes, cigars, smoking tobacco, chewing tobacco, and snuff who transfers title or in whose place of business title to any such cigarettes, cigars, smoking tobacco, chewing tobacco, and snuff are transferred within the corporate limits of the Town for any purpose other than resale (8) The word "dealer" shall mean and include every manufacturer, jobber, wholesale dealer or other person who sup~li a seller with cigarettes, cigars, smoking tobacco, chewing tobacco and snuff. (9) The word "agent" shall mean and include every local dealer and other person who shall be authorized by the Treasurer to purchase and affix stamps to packages of cigarettes, cigars, smoking tobacco, chewing tobacco, and snuff, under the. provisions of this ordinance. (10) The word "purchaser" shall mean and include every person to whom the title to any cigarettes, cigars, smoking tobacco, chewing tobacco, and snuff is transferred by a seller within the corporate limits of the Town. (11) The word "package" shall mean and include every package, box, can or other container of any cigarettes, cigars, smoking tobacco, chewing tobacco, and snuff, irrespective of the material from which such container is made, to which the Interhal - 2- - '~~tJtJ Revenue stamp of the United States Government is required to be affixed by and under Federal statutes and regulations and in which retail sales of such cigarettes, cigars, smoking tobacco, chewing tobacco, and snuff are normally made or intended to be made. (12) The word ""stamp" shall mean the small gummed TOBACCO TAB ORDINANCE piece of paper or decalcomania to be sold by the Treasurer and to be affixed by an agent to every package of cigarettes, cigars, smoking tobacco, chewing tobacco, and snuff sold at retail in the Town; it shall also denote any insignia or symbol printed by a meter machine upon any such package under the authorization of the Treasurer. (13) The term ``chewing tobacco" shall include any tobacco irrespective of the kind, shape, size, or form, and irrespective of the tobacco being flavored, adulterated, or mixed with any other ingredient prepared in such a manner as to be suitable for chewing. (14) The word "cigar" shall include any roll of tobacco for smoking, irrespective of the kind, shape, size or form, and irrespective of the tobacco being flavored, adulterated, or mixed with any other ingredients where such roll has a wrapper made chiefly of tobacco. (15) The term '"smoking tobacco" shall include granulated, plug cut, crimp cut, ready rubbed, or any other kind or form of tobacco prepared in such a manner as to be suitable foY smoking in pipes or cigarettes. (16) The term "snuff" shall include any form of tobacco ground, pulverized, or form which would allow same to be used or made suitable for dipping, brushing, or sniffing. II. TAX: (Imposition of) -3- i ~~ On the 1st day of July, 1965, or at such other time 1 TOBACCO TAX ORDINANCE as may be hereafter established as the effective date on certaign items, and thereafter, there is hereby levied and imposed by the Town, in addition to any and all other taxes which may be, or have been imposed, a tax to be paid and collected as hereinafter provided on each and every sale made in the Town of cigarettes, cigars, smoking tobacco, chewing tobacco, and snuff; the tax is to be paid by the seller, local dealer, or other agent by affixing a stamp or stamps, or causing a stamp or stamps to be affixed to each and every package of cigarettes, box or container of cigars, package of smoking tobacco, chewing tobacco, and box or package of snuff, in the kind and manner herein required and at the appli~abl rates as follows: (a) The rate or amount of tax levied or imposed on cigarettes, shall be at the rate of Two Cents (2~) for each;ten (10) cigarettes, or fractional part thereof. (b) The rate or amount of tax levied or imposed on cigars shall be as follows: CLASS TAX (On eac-F'i cigar) 1. Selling at retail for less than Seven Cents (7~) none 2. Selling at retail for not less than Seven Cents (7~) each, and not more than Fifteen Cents (15~) each .O1 3. Selling at retail for not less than Fifteen Cents (15~) each, and not more than Thirty Cents (30~) each .02 4. Selling at retail for more than Thirty Cents (30~) each .03 (c) The rate or amount of tax levied or impASed --on each package of smoking tobacco, chewing tobacco, or snuff -4- ~~`~ shall be at the rate of One Cents (1~) on each Twenty Cents (20~) of the retail selling price, or fractional part thereof. III. PREPARATION, SALE OF STAMPS, DUTIES OF THE TREASURER• ~~~ ~~ (1) The Treasurer of the Town shall acquire, keep, !~'`~_~ r~ r t ~ ;~ ~- ~ r `~ : ~ y, . ,< TOBACCO TAB ORDIRiAATCE and sell necessary stamps to local dealers and other agents, the stamps to be of such denominations and quantities as may be necessary for the payment of the tax herein imposed. (2) In the sale of such stamps to a local dealer o~rj • fi't'?°Y ~~'N7~5 /" other agent, the Treasurer shall allow a discount of t-e~-der eel--~~8°~ of the face value thereof to cover the cost which !,will be incurred by such dealer or agent in affixing the stamps to .packages of cigarettes, cigars, smoking tobacco, chewing tobacco, and snuff. (3) In the event that printing by a meter machine is used in lieu of gummed stamps, there shall be allowed an additional discount to that provided in (2) above, equal in amount 1-~- to the costs to the Town of stamps that would otherwise be required. 'The costs shall be determined by the Treasurer based. on average costs of stamps during the preceding twelve months. (4) The Treasurer may from time to time and as often as he deems advisable provide for the issuance and exclusive use of stamps of a new design and forbid the use of stamps of any other design. The Treasurer is empowered to make and carry into effect such reasonable rules and regulations relating to the ~, preparation, furnishing, sale and redemption of stamps as he may deem necessary. In redeeming stamps or making refund for destroyed stamps, he shall not in any case refund more than ninety ~~per centum (90%) of the face value of such redeemed or destroyed -5- ~ ~~ stamps; he is further authorized and empowered to prescribe the method to be employed, the conditions to be observed and any other necessary requirements not contrary to this ordinance in the use of meter machines for printing upon packages of cigarettes, cigars smoking tobacco, chewing tobacco, and snuff insignia to represent the payment of said tax and in lieu of stamps. (5) In addition to powers hereinabove granted, the Treasurer is further authorized and empowered to: (a) Prescribe, adopt, promulgate, and enforce TOB~GCO TAX ORDINANCE' rules and regulations relating to the method and means to be used in the cancellation of stamps. (b) Delegate his powers to agents or others, including the police officers of said Town. (c) Any other matters pertaining to the 1 administration and enforcement of the provisions of this ordin~nc (d) Determine the manner of taking inventory, affixing stamps, etc., on cigarettes, cigars, smoking tobacco,, chewing tobacco, and snuff on hand and in stock on the effective day of this ordinance. IV. INSPECTION AND EXAMINATION OF BOOKS, RECORDS, PREMISES, AND ENFORCEMENT OF ORDINANCE: (1) The Treasurer or his duly authorized agents 1 are empowered to examine books, records, invoices, and papers related to purchases, sales, etc., of cigarettes, cigars, smoking tobacco, chewing tobacco, and snuff, and to examine all cigarettes cigars, smoking tobacco, chewing tobacco, and snuff in and upon any premises where the same are placed, stored, sold, offered for sale, or displayed for sale by a seller. (2) In the event the Treasurer or his agent -6- Of~4 TOBACCO TAX ORDINANCE discover any cigarettes, cigars, smoking tobacco, chewing tobacco, and snuff subject to the tax imposed under this ordinance, but upon which such tax has not been paid and upon which stamps have not been affixed or evidence or payment shown thereon by printed markings of a meter machine in compliance with the provisions of this ordinance, the Treasurer or duly authorized agents or officers, or any of them, are hereby authorized and empowered to seize and take possession forthwith of such cigarettes, cigars, smoking tobacco, chewing tobacco, and snuff, which shall thereupo be deemed to be forfeited to the Town. Such cigarettes, cigars, I, smoking tobacco, chewing tobacco, and snuff forfeited may, within' a reasonable time thereafter, and after written notice is posted at the front door of the Municipal Building at least five days before the date given therein for sale, shall sell such cigarettes cigars, smoking tobacco, chewing tobacco, and snuff in the place ' designated in such notice; the Treasurer, from proceeds of such sale, shall collect tax due thereon, together with a penalty in the amount of fifty per centum (50%) thereof, the cost incurred in such proceedings, and shall pay the balance, if any, of such proceeds to the seller in whose possession such forfeited cigarettes, cigars, smoking tobacco, chewing tobacco, and snuff were found. The seizure and sale of any cigarettes, cigars, smoking tobacco, chewing tobacco, and snuff shall not be deemed to relieve any of the persons of any other penalties provided in this ordinance. (3) The Treasurer is further authorized and empowered to administer oaths and to take affidavits in relation to any matter or proceedings in the exercise of the powers and "duties herein granted or inferred; he shall have power to subpoena -7- TOBACCO TAX ~INAN CE G ~e t and require attendance of witnesses, production of books, papers, records or documents, to examine witnesses, books, records, payers and documents for the purpose of securing information pertinent to the performance of his duties under this ordinance. V. DUTIES OF DEALERS, AGENTS AND SELLERS: (1) Every local dealer in cigarettes, cigars, smoking tobacco, chewing tobacco, and snuff and every agent appointed hereunder shall purchase necessary stamps from the Treasurer of the Town to pay the tax imposed under this ordinance and shall affix or cause to be affixed a stamp or stamps of the monetary value provided by said ordinance to each package of cigarettes, cigars, smoking tobacco, chewing tobacco, and snuff prior to delivering or furnishing such cigarettes, cigars, smoking tobacco, chewing tobacco, and snuff to any seller who is not also an agent. (2) Nothing herein contained shall be deemed to preclude any dealer from authorizing and employing any agent to purchase and affix such stamps in his behalf or to have a stamp meter machine used in lieu of stamps to effectuate the provisions of this ordinance. (3) Stamps or printed markings of a meter machine jshall be placed upon each package of cigarettes, cigars, smokiamg tobacco, chewing tobacco, and snuff in such manner as to be readily visible to the purchaser. (4) It shall be the responsibility of every seller to determine that each package of cigarettes, cigars, smoking tobacco, chewing tobacco, and snuff offered for sale shall haves a proper stamp affixed thereto in compliance with the provisions of this ordinance. -8- ~~~~V (5) If inspection by the agents of the Town To$ACC© TAB ORDINANCE discloses unstamped or improperly stamped packages of cigarettes, cigars, smoking tobacco, chewing tobacco, and snuff, the seller, when such cigarettes, cigars, smoking tobacco, chewing tobacco, and snuff were obtained from a local dealer, shall immediately notify such dealer, and upon such notification such dealer shall forthwith either affix to such unstamped or improperly stamped package or container or item the proper amount of stamps or shall replace such package, etc, with others to which stamps have been properly affixed. If a seller, who is not also an agent, acquires) or has in his possession unstamped or improperly stamped cigarette cigars, smoking tobacco, chewing tobacco, and snuff from any person other than a local dealer, the seller shall forthwith noti the Treasurer of such fact. The Treasurer shall thereupon affix or cause to be affixed the proper stamps to such cigarettes, cigars, smoking tobacco, chewing tobacco; cost of such stamps at face value to be advanced by such seller; the Treasurer or his agent shall thereupon affix the appropriate stamp at such agent's place of business. (6) If any packages of cigarettes, cigars, smoking tobacco, chewing tobacco, and snuff are found in the possession of a seller without proper stamps or authorized printed markings thereon, and the seller is unable to submit evidence establishing that he received such packages, container, etc. within the immediately preceding forty-eight (48) hours, and that he has not.. offered the same for sale, then it shall be presumed that such packages, container, etc, are being kept in violation of the provisions of this ordinance, and the seller shall be subject to "the penalties herein provided, even though such seller be also an -9- f- ~l! 0 1 TC~ACCO TAX ORDINANCE 1 agent. (7) The Treasurer, by proper rules and regulati®ns, may require every local dealer, agent or seller to cancel stamps upon all packages of cigarettes, cigars, smoking tobacco, chewing tobacco, and snuff in his possession. (8) Every local dealer and seller shall maintain and keep for a period of at least two years such records of cigarettes, cigars, smoking tobacco, chewing tobacco, and snuff received and sold by him as may be required by the Treasurer; such records shall be made available for examination in the Town by the Treasurer upon demand, and to make available the means, facilities and opportunities for making any such examinations at all reasonable times. VI. REVENUE.DERIVED FROM TAX TO GO INTO GENERAL FUNS: -- --... Revenues derived from tax shall be deposited by the Treasurer to the credit of the General Fund of the Town for utilization for such legal purposes as the Council of the Town may from time to time determine. VII. VIOLATIONS DEFINED: It shall be unlawful and a violation of this ordinance for any person to erform an act or to fail t e P y o p rf orm any act for the purpose of evading the payment of such tax, or of any part ;thereof; or for any dealer or seller, with intent to violate any provision of this ordinance, to fail or refuse to perform any of the duties imposed upon him under the provisions of this ordinance, or to fail or refuse to-obey any lawful order which the Treasurer may issue under the provisions of Sections ':III and IV of this ordinance. It shall also be unlawful for any ,person falsely or fraudulently to make, forge, alter or counte~- _,o_ .i~(lfi~3 feit any stamp or the printed markings of a meter machine, or to procure or cause to be made, forged, altered or counterfeited any such stamp or .:printed markings of a meter machine, or knowingly and wilfully to alter, publish, pass or tender as true any false, altered, forged or counterfeited stamp or stamps or printed markin; of a meter machine. It shall further be unlawful for any person to sell and dispense through a vending machine or other mechanical device any cigarettes, cigars, smoking tobacco, chewing tobacco, and snuff upon which such tax has not been paid and upon which TOBACCU evidence of the payment thereof is not shown on each package of TAB such cigarettes, cigars, smoking tobacco, chewing tobacco, and ORDIAiANCE snuff . VIII. EACH VIOLATION A SEPARATE OFFENSE: Each violation of, or non-compliance with, any of the provisions of this ordinance shall be and constitute a separa~ offense and shall subject every person guilty thereof to the penalties prescribed in Section IX of this ordinance. IX. PENALTIES FOR VIOLATIONS: Any person violating any of the provisions of this ordinance shall, upon conviction thereof, be punished by a fine of not less than $10.00 nor more than $500.00. X. SEPARABILITY OF PROVISIONS: If any section, part of section, sentence or clause of this ordinance shall be adjudged to be invalid by a court of competent jurisdiction, such decision shall not affect the validity of any other portion of this ordinance, but shall be restricted and limited in its operation and effect to that specific portion of this ordinance involved in the litigation in „which such decision shall have been rendered. ~ -11- XI. EFFECTIVE DATE: The provisions of this ordinance shall be in full u TOBACCO TAX ORDINANCE 1 1 (force and effect as it applies to the tax on cigarettes on and after the 1st day of July, 1965, and upon all other items on and after the 1st day of August, 1965. TAX INCR, & OTHER TOBACCO TAXES that the cigarette t,ax increase would become effective immediately, and the tax on chewing tobacco, smoking tobacco and snuff to become effective August 1, 1965. D~_iring the discussion by Council of the adoption of said ordinance, i.t was the consensus of Council that the minutes show that because of the urgent need for additional revenue by the Town, this ordinance was adopted, but if circumstances change in the future by reason of the Town receiving revenue from a State sales tax, ar some other source, that the Council then in office will give some consideration to the reduction of this tax. ORDINANCE INCREASING GARBA(~ & RUBBISH RATES, FEES & CHARGES BF IT ENACTED BY THE COUNCIL OF THE TC~.~T OF PUI~ASKI, VIRGINIA, that: Section 9-23= Charges and fees for garbage service. Carrico - absent AN ORDINANCE AUTHORIZING THE ISSUANCE OF NEGOTIABI,F NOTES OF THE TOj~rN OF PUI.ASKI, VIRGINIA, IN THE AMOUNT OF TWENTY-TWO THOUSAND DOLLARS ($22,000) FOR PAYMENT OF CERTAIN SUMS DUE THE PF OPLES NATIONAL BANK OF PULASKI AND THE PULASKI NATIONAL BANK OF PULASKI, VIRGINIA. REFINAWCING WHEREAS, The Town of Pulaski, Virginia, has heretofore obligated itself for payment of certain sums for capital OF NEGOT. improvements; and, ~ NOTES WITH WHEREAS it is necessary that the Town of Pulaski, Virgi nia, borrow the total sum of Twenty-Two Thousand '1~+t0 LOCAL Dollars 022,000) to refinance certain notes due and in order to provide this sum for General Fund obligations; and, BANKS WHEREAS, the Pulaski National Bank and the Peoples National Bank of Pulaski, Virginia, offered to loan the Town ~` ~~~_ ~~ ~~~ Council mins. contd. 7/1/65 of Pulaski, Virginia, the amount of Twenty-two Thousand Dollars ($22,000) at an interest rate of three per cent (3%) per annum, the Pulaski National Bank to loan F1leven Thousand Dollars ($11,000), thereof, and the Peoples National Bank of Pulaski to loan Eleven Thousand Dollars ($11,000) thereof, with interest on said loans pa~,rable semi-annually; and, WHEREAS, the Treasurer of the Town of Pulaski has filed with Council a certificate showing that the assessed valuation of the real estate in the Town of Pulaski, Virginia, subject to taxation is $.5,236,0l~0.00; that the assessed valuation of personal property is X1,887,570.00; that the assessment on personal property elas~ifQyl''a~~.machitrer~r t~ -$IG28~5Gz00; TREASURER'S that the assessment on public utility properties within the Town of Pulaski is $1,288,217.00; and that the outstanding bonds or other interest-bearing obligations for any purpose of the FINANCIAL Town of Pulaski, Virginia, on June 30, 1965, were as follows: Sewer Bonds (Revenue ) (7/1/58) $ 886,000.00 REPORT Water Bonds (Revenue ) (!~/1/lab) $ 272,000.00 Water Bonds (Revenue) (7/1/58) $ 55It,000.00 all of which are self-liouidating; a copy of said certificate of the Treasurer being incorporated herein and made a part of this ordinance; and, AND WHEREAS, the issuance of the negotiable notes totaling Twenty-two Thousand Dollars ($22,000), together with all other existing indebtedness for any purpose, will not exceed eighteen per cent (18~) of the assessed valuation of the real REFTNANCING estate in the Town of Pulaski subject to taxation as shown by the last preceding assessment for taxes, and the indebted- NOTES AT TWO ness of the Town of Pulaski will therefore not exceed the Y- limitation provided in Section 127 of the Constitution of LOCAL BANKS Virgirri.a, or the statutes of the Commonwealth of Virginia; and, WHEREASm this loan and this ordinance are made under the authority of and in compliance with the provisions of Section 127 of the Constitution of Virginia, and Section 15-666.63 of the Code of Virginia of 1950, as amended, and the Charter of the Town of Pulaski, Virginia. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE TOWN OF PULASKI, VIRGINIA, that: (1) The Town of Pulaski, Virginia, duly issue its negotiable promissory notes, one in the amount of Eleven Thousand Dollars ($11,000), dated July 1, 1965, payable to the order of Pulaski National Bank of Pulaski, Virginia, at said Bank, bearing interest at the rate of three (3) per cent per ~ssnum, said interest to be paid semi-annually, and the princi- pal,of said note to be payable on or before June 30, 1966; and one in the amount of Eleven Thousand Dollars 011,000), dated July 1, 1965, payable to the order of. the Peoples National Bank of Pulaski, Virginia, at said Bank, bearing interest at the ra~c~f three (3%) per cent per annum, said interest to be paid semi-annually, and the principal of said note to be payable on or before June 30, 1966; with right of antici- pation reserved on both notes; said notes are issued under authority and in full compliance with the @onstitution and statutes of the Commonwealth of Virginia and the Charter of the Town of Pulaski, Virginia.
