M., on July 22, 1965, said meeting having been postponed from its regular meeting date, Tuesday, July 20th, in the Municipal office. There were present: Mayor C. V. Jackson, presiding. Councilmen: C. B. Gallimore, H. H. Eggert, T. J. McCarthy,. W. S. Gallimore, F. L. Carrico, Glen K. Aust, W. A. Larson Absent: Rudolph Farmer Also present: Town Manager: T. B. Noland Clerk: Gladys R. Dalton Town Attorney: Garnett S. Moore Visitors: Midge Trloodard, Southwest Times reporter Paul Dellinger, Roanoke Times reporter Mark F. Price Mrs. Rosa Co1l.ins The invocation was given by Councilman Gallimore. Mayor Jackson advised that the Council meeting scheduled for Tuesday, July 20th, had been postponed out of respect for Mr. Charles. M. Hayter, whose funeral was held on July 20th, in Abingdon, Virginia, The following resolution was made a part of the minutes of the meet- ing: We, the undersigned, being all of the duly elected members of the Council of the Town of Pulaski, Virginia, do agree, by these Presents, to postpone the regular meeting of Council from ti:00 P. M. on the 20th day of July, 1965, to l~:00 P. M. on the 22nd day of July, 1965, without the POSTPONEMENT giving of any further notice. Mayor Jackson advised this was the time, date and place, as had been advertised in the Southwest Times for holding a public hearing on the application of Njark F. Price for permission to place MARK PRICE a house trailer on Case Knife Road. Town Manager Noland advised that. GRANTED PERM. TO PLACE the lot on which Mr. Price proposed to place the 1957 model, three- HOUSE TR. ON CASE KNIFE room - 1-1~2 bedroom trailer, costing $1500.00, was located just ROAD ~~2 Council rains. contd. 7/22/65 above the Malcolm Porter property on the left of Case Knife Road; that town water is available and Mr. Price plans to connect to the Town system, but that town sanitary sewer is not available and Mr. Price plans to use an outside privy. He further advised that he had not inspected the trailer as it is still in Blacksburg, Virginia, It was the feeling of Council that until such time as Council amends its present trailer ordinance, the matter having been referred to-a Committee for study, all such trailer applications would be considered by Council as it had in the past. On motion of Councilman Cummings, seconded b~,~ Councilman Gallimore, and carried, it was, RESOLVED, that Mark E. Price be granted permission to place a house trailer on Case Knife Road. Mrs. Rosa Collins, who lives on Case Knife Road, asked Council to place signs o.r guard rails on the sharp curve as you REQ. TO TG~TN MGR. curve. Council man Aust moved that this request be ref erred to Town Manager Noland for investigation and report. This motion was seconded by Councilman rggert, and carried. Town Manager Noland presented the petition of R. S. McPeak for permission to place a house trailer at 626-628 Ridge USUAL PROC. HE FOLLOMIED Avenue. On motion of Councilman Eggert, seconded by Councilman IN MCPEAK McCarthy, and carried, it was, RESOLVED, that the usual procedure APPLICATION TO PLACE HOUSE be followed in these applications, and a public hearing be held TRAILER ON RIDCE AVENUE by Council. On motion of Councilman McCarthy, seconded by Councilman Gallimore, and carried, it was, RESOLVED, that the petition submitted WINDSOR CIRC. by Windsor Circle-Dublin Road petitioners, bearing twenty-three PET. FOR SEWER SERV. REF. TO signatures, for sa nitary sewer services, be referred to the Sewer COMM. & TC~~1N MGR. Committee and Town Manager Noland for investigation and report. Fvick of Staunton, Virginia, advised the Town of. Pulaski that Lottie Henderson Cary, deceased, did in her Last Z~Till and Testament, provide and designate that Three Hundred Dollars (`300.00) go into a Trust Fund with the interest derived therefrom to be used for the care of the graves of her husband's parents, A. R. Cary and Lucy F, Cary, who are buried on T,ot, #61, Section X, in Oakwood Cemetery; said lot is in the name of Miles Davis Cary; T~rTf-IFR~AG, ±.he Totem of Pulaski now operates and controls Oakwood Cemetery which is the cemetery referred to in the will of decedent; trustees were appointed for the cemeter~r but have not assumed control of the cemetery's assets; ~(~~~3 WHER~'AS, the Tom has on other occas~.ens accepted various sums to hold in trust for care of graves, and is willing to accept the bequeath of iottie Henderson Cary for this purpose. RESOLUTION NCI, THEREFORE, BF IT RESOLVED BY THE Ct~JNCIL OF ACCEPTING THE TOTrIN OF PULASKI, VIRGINIA, meeting in regular session $300.00 FOR on this 22nd day of July, 1965, that: UPKEEP OF CARP GRAVES (1) The Treasurer of the Town of Pulaski, & LOT 61 SEC. X, Virginia, accept for, and upon behalf of said town, the afore- OAKWOOD CEM. mentioned sum in the amount of Three Hundred Dollars 0300.00) given by Lottie Henderson Cary, deceased, for the benefit and upkeep of the graves of A, R, Cary and Lucy F. Cary, the mother and father of Miles Davi s Cary. (2) The said sum of money be accepted under the conditions given, and that the income therefrom. be used for the care of the graves of A. R. Carv and Iuc,y F, Cary, located upon I:ot ~61., Section X, of the Oakticod Cemetery, the p~_c,t, of Niles Davis Carv. (3) The said Treasurer Ghall place the money S.n the special cemetery fund and otherwise keep said funds intact, using therefrom the earnings for the purposes above indicated, and such sums of revenue unused at the end of ahy ,year to become part of the carpus, and thereafter use as same becomes necessary. (~a) The said Treasurer is further directed to, at such times as regular trustees of Oakwood Cemetery are properly appointed and organized, and upon further specific direction of said Council., transfer said funds to be held in Trust by the Trustees of Oakwood Cemetery for the purpose herein indicated. At a prior meeting Town Attorney Moore had discussed with Council the feasibility of Council adopting an ordinance or resolution which would cure any over-s9ght of legal proceedings in RESOL.TO CURE OVERSIGHT OF connection with the. PROP.BUDGET motion of Councilman Eggert, seconded by Councilman Larson, and carried, the following resolution was adopted: ~~ ~8~'~ RESOLUTION Council mins. contd. 7/22/65 ~~1HERFAS, by the general laws of the Commonwealth of Virginia, the Charter and the Ordinances of said Town, the Town is required each year to prepare and adopt a budget showing anticipated revenue, the sources thereof, and proposed dis- bursements; and, ?~'HFREAS by the usual procedure the Town Manager prepares and presents a proposed budget to the Council several months before the end of the fiscal ,year, which budget is studied by the members of Council, by the Finance Committee and the Council as a whole, amended and finally adopted together with necessary revenue measures to produce the revenue needed and called for by the budget; and, RE: TOWN MGRS. PROPOSED ~TDGETS WILEY & WILSON FEASIBILITY REPORT ON PEAK CREEK COVERAGE DISTRIBUTED - NO COMMENT ?aHEREAS, many meetings of Council and its Committee are reouired from the time the budget is introduced until it is adopted; and, 1~THE'RFAS, the Council desire that considera- tion of the budget be a continuing matter before the Council and its Committees from the date it is proposed and,deli vered to the members of the Council by the Town Manager until the day of adoption. NOTrT, THEREFORE, be it reso7.ved, THAT: Upon and from the time of delivery of the annual proposed budget, by the Town Manager to the members of the Council, until its final passage, the same shall BF AND IT IS HEREBY DIRECTED that it be a continuing order of business before the Council as a whole, its Committees or members considering same, however, it is not intended that other business shall not be consider- ed, but the Council, or committee and members shall proceed and consider all other matters in the ordinanry manner. Rules of Council applying to the necessity of placing business on the calendar prior to the meeting or by a vote of members at the meeting are hereby suspended and shall not apply to consideration or debate on the budget. Town Manager Noland advised that copies of the report of Wiley & Wilson, Consulting Engineers, on the feasibility of covering Peak Creek for parking purposes, had been given to the Merchants Council, the Press and members of Council, and that he had forwarded a copy of the report to the Corps of Engineers in Huntington, West Virginia, and asked them to comment on same, but as of the meeting time, he had had no reply from the Engineers, nor from the Merchants Council. There was some discussion with regards to the report, and the execution of a deed granting title to the Creek to the Town, but no action was taken by Counci_.1, as none was necessary at this time. 1 1 I Council mins, contd. 7/22/65 t: `; '~~~ Town Manager Noland advised that from information obtained from the Pulaski County Commissioner of Revenue, the recently adopted REPORT ON Pulaski County Trailer ordinance does apply inside the Town limits, PULASKI COUNTY mainly as to personal property tax, but that he had not seen a copy TRAILER ORDINANCE of the ordinance, but would secure a cony and report on it later. Town Attorney Moore was of the opinion that the Town Zoning laws would take precedence over the County's, but that police powers, etc. would not. CHURCH TO Town Manager Noland advised that he had discussed with ADVISE LATER WITH REE. TO the minister of the Church of which the late Fire Chief Ray was a MEMORIAL, FOR CHIEF member, the matter of. a memorial. to the late Chief by the Council, RAY and the minister had promised to find out what the situation is and advise Mr. 1°oland. Mayor Jackson reported a Food meeting was held recently. on the Beautification Program, and stated he felt the Committee as well as Mrs. Elsie Guynn, are doing a fine job, but he felt it was BEAUTIFICA_ TI ON PROG. the responsibility of each individual to take a real interest in REPORT, ALL PERSONS this program. He further stated there is too much litter on the ARE RESP. streets of the Town as well as along the highways. On motion of Councilman Larson, seconded by Council- EXECUTIVE man Eggert, and carried, Council went into F'xecutive Session. SESSION After a period of approximately twenty minutes, Council declared the meeting to be in open session to hear any one present, and to continue with the business of Council. On motion of Councilman ~'ggert, seconded by Councilman Cummings, a.nd carried, H.C.JACKSON it was, RESOLVED, that Howard C. Jackson, Director of Public T~'orks, GRANTED ONE YR. PERIOD who will be seventy .years old in August, meaning that September 1, OF POSTPONEMT. BEFORE RE- 1.965 would be his normal retirement date under the Town's Retirement TI REMENT Plan, be granted a postponement of his retirement for one year, con- ditioned upon his health and ability to perform his duties; and at the end of said one year period Council would again review Mr. Jackson's case. ~~~ ~~3f~ Council mins. contd. 7/22/65 There being no further business, the meeting adjourned at 5:l~S P.
