Dalton Waiver of notice of special meeting of the Town Council of the Town of Pulaski was presented, as follows: We, the undersigned, duly members of the Council of the Town of Pulaski, Virginia, hereby waive notice of a special meeting of said Council at 3:30 P. M., on the 18th day of November, 1965, called by Garnett S. Moore, Town Attorney, for the purpose of considering a resolution and petition for annexation of territory to the corporate limits, and transacting any other business that may properly come before said meeting. CARSON Town Attorney Moore advised that the special meeting had been called in order that Council might act formally on a matter which had been considered informally on September 30, 1965, when Mr. Howard C. ANNEXATION Gilmer, Jr., Mr. Harry Hall and Mr. B. K. Hall had met with the members OF REAL ESTATE LYING N0. OF of Council to discuss the annexation of certain real estate owned by PLEASANT HILL DR. BEING DEP E. 0. King, Jr., and Howard C. Gilmer, Jr., and being developed into a BY E. 0. KING, JR. & H. C. modern residential subdivision by E. 0. King, Jr., and Howard C. Gilmer, Jr., GILMER, JR. as well as lands owned by B. K. Hall and Harry H. Hall to be developed by them at some later time; all of said real estate lying immediately north of Pleasant Hill Drive and adjoining the present corporate limits of the Town of Pulaski, and at which meeting all were in agreement as to the procedures of said annexation. Mr. Moore pointed out, on maps which had been passed around, that the area to be annexed contains 23.27 acres, or 0.036!, square miles; that the property now being developed conforms with the Subdivision Ordinances of the governing bodies involved, and that the portion of the area which ~~ 1 Council rains. contd. 11/18/65 t is the property of B. McCarthy ,Absent RESOLUTION CONCERNING THE NECESSITY FOR AND EXPEDIENCY OF THE ANNEXATION OF TERRITORY LYING AT THE NORTHEAST CORPORATE LIMITS OF THE TOWN OF PULASKI, PULASKI COUNTY, VIRGINIA AND ADJOINING THE NORTHERN RIGHT OF WAY LINE OF PLEASANT HILL DRIVE IN SAID TOWN: WHEREAS, Mary B. Gilmer, B. K. Hall and Harry H. Hall own certain tracts or parcels of land, and E. O. King, Jr. , Trustee for Himself and Howard C, Gilmer, Jr. , has developed certain real estate, all lying immediately North of Pleasant Hi11 Drive and adjoining the present corporate limits of the Town of Pulaski, Pulaski County, Virginia, the metes and bounds and area of which is as I follows BEGINIIIIG at a point in the Northwest line of Pleasant Hill Drive, on a present corporation line, said poi:$ being the most easterly corner of the J. WHEREAS, the said E, O. King, Jr, and Howard C. Gilmer, Jr. ha'Ve PLEASANT BILL ANNEXATION RESOLUTION developed and are developing said real estate into a modern residential subcvi- sion, and B. K. Ha11 and Harry H. Hall may develop their property at some ]ter time; and WHEREAS, the governing body of the County of Pulaski, being thee' County in which said territory is located, to-wit: the Board of Supervisors o Pulaski County, Virginia, has, by resolution, declared that the necessity fob and expediency of the annexation of the territory exists and that such annexation. should be decreed, and that it is desirable that such territory be annexed to the Town of Pulaski, Virginia, and at a meeting held on the 18 day of Noveml.r 1965, authorized the filing of a Petition for Annexation of such territory in thle Circuit Gourt of Pulaski County, Virginia, pursuant to Section 15, 1-1034 of the Code of Virginia, 1950, as amended, and has mutually agreed with the Council of the Town of Pulaski, Pulaski County, Virginia, to permit the annexation o~ su< territory of such county within less than five (5) years next succeeding the try of a Final Order of Annexation heretofore instituted by said Town of Pulaski,?and by which certain other territory has heretofore been annexed. BE IT, THEREFORE, RESOLVED, that there exists a necessity for aid expediency of annexation of such territory, that it is desirable that such terf~.tox be annexed to the Town of Pulaski, and that it be decreed that the necessity for and expediency of the annexation of the territory aforesaid exists and that such annexation should be decreed, and with the consent of all intervenors in such. I ~x _ tK.7 -3 - PLEASANT BILL ANNEXATION RESOLUTION proceedings, the Court constituted to hear the matter may be composed of the Judge of the Circuit Court of Pulaski County, Virginia, only; and that it be mutu- ', ally agreed with the governing body of the County of Pulaski, to-wit: the Board of Supervisors of Pulaski County, Virginia, and with the governing body of the Town of Pulaski, to-wit: the Council of the Town of Pulaski, Pulaski County, Vir ginia, the governing bodies affected, to let the proceeding to annex said terri be instituted within less than five {5) years next succeeding the entry of the Final Order of the other annexation proceeding by the Town of Pulaski; and be it further RESOLVED that by mutual agreement and by this joint resolution, the g ing body of the County in which said territory is located, to-wit: the Board of 'i Supervisors of Pulaski County, Virginia, be, and it is hereby, requested to pro- ceed by Petition for the annexation of said territory, and be it further RESOLVED that, in said Petition, the following be set forth: (a) The area of the territory sought to be annexed is 23.27 acres, or 0.0364 square mile, and a metes and bounds thereof are herein set forth. (b) The portion of the area which is the property of Mary B. Gilmer, and that of E. O. King, Jr. , Trustee for Himself and Howard C. Gilmer, Jr. , is being developed by the owners as a residential subdivision and in all respects conforms with the Subdivision Ordinances of the governing bodies involved, as shown on said map, and as shown on a map thereof entitled, "Map of Lots own by E. O. King, Jr. , Trustee, Lying at the Northeast Corporate Limits of the Town of Pulaski, Virginia" , revised September 15, 1960, by R. Lloyd Mathews, Registered Professional Surveyor, and said map being recorded in the Clerk's Office of the Circuit Court of Pulaski County, Virginia, in Plat Book 4, at Page 47; the portion of the area which is the property of B. K. Ha11 and Harry H. Hall` is shown on the: annexation, -map hereto attached, and is open land but suitable for development, -~ ~39 -4 - PLEASANT HILL ANNEXATION RESOLtTTI©N (c) Annexation of said territory is to be sought upon the following ,general terms and conditions: I E. Gilmer, Jr. , ley the recording of the map of said territory as aforesaid, and by the Certificate of i, Subdivision, has dedicated a ten (10) foot strip along said Pleasant Hill Drive as 'additional street width for said Drive in said Town of Pulaski, and has also (reserved and dedicated by the aforementioned maps a fifty (50) foot strip ford future street between Lots Nos . Eight (8) and Nine (9) as shown on said maps II B. K. Ha11 and Harry H. Hall have, by an easement agreement, dedicated a ten ICI (10) foot strip along Pleasant Hill Drive for additional width for said Drive, end I did further agree that any land belonging to them included in the annexed arela would be developed in accordance with the Subdivision and other ordinances'~in effect in the Town of Pulaski. II The Town of Pulaski has heretofore made available water and sewer service for said properties adjacent to the northern boundary line of Pleasant, 1 Drive and with the extension thereof under the same conditions as other wat!!r and sewer lines within the Town are extended. Other services will be provi~ed by the Town to the annexed territory as are provided in other sections of said ~ Town under the same practices and procedure in effect in said Town at the tf,~ne of the proposed annexation.
