Minutes ofthe regular meeting of the Pulaski Town
Council, held May 3, 1966, at l~:00 P. M., in the Pulaski County
Courtroom, in the Old Courthouse.

The invocation was given by Town Attorney Moore.
Mayor Jackson welcomed the Pulaski High School Youth group
and their sponsors, the officials of the Madeline Harman's Woman's Club,
and other visitors present.
Minutes of the regular meeting of Council held April 19th
and called meeting of April 28th were approved, as recorded.
The meeting was opened by Council holding a public hearing,
as had been daly advertised i n the local newspaper, on the application of
THOMAS MATTOX Thomas Junior Mattox for permission to place a house trailer on Garner
TRAILER APPL.
APPROVID. Avenue. No one appeared to oppose said application and upon the
recommendation of Town Manager Norton, Councilman Gallimore moved that
the application be granted, subject to applicant connecting to the
Town's water and sewer system. This motion was seconded by Councilman
Eggert, and carried.

Attorney Phil Sadler advised Council that formal applica-
tion would be presented to Council on the 17th day of May, 1966, for
the official closing of that certain alley set forth and dedicated i n a deed

LaGrange Street and the first 1!t-foot alley lying to the East of LaGrange
Street, in the Town of Pulaski, said alley being further designated in the
aforesaid deed as being the southern thirteen (13) feet of Lot No. 25,
Section 118, according to the Official Map of the Town of Pulaski,
Virginia, and that the necessary legal steps would be taken for the
proper closing of this alley.
Mr. Sadler further advised Council that he had been
appointed Chairman of the Chamber of Commerce Motel Committee, the
purpose of said committee is to try and locate a motel in Pulaski near
the business area. Mr. Sadler stated a motel and restaurant had been
talked about for several years and hoped that private i mrestors would
be interested, but since no one had shown any interest, it was now a
community pro3ect to try and locate an in-town motel in Pulaski. Mr.

another site more suitable for recreation purposes could be made availatble
to the Town in exchange of this lot on Route 99. Mr. Sadler was advised
that Council would be glad to cooperate in this endeavor in any way
possible, and the Council had realized the need of such accommodations
in Pulaski.
Mr. Clarence FAgg, who lives on 12th Street extended, east

Chamber Secretary Hillsman thanked the Town for their
assistance in the clean-up program held the past week, and advised that
40 trees had been planted in the N & W Park on Dora Highway. Mr. Dudley

pressed the interest of his office in the beautification program
now being undertaken in Pulaski.
On motion of Councilman Cummings, seconded by Councilman

gation and report, which motion was seconded by Councilman Gallimore
and carried.

Attorney could make a study and review of the terms of the present
lease and report to Council later.
Councilman Eggert, as chairman of the Land, Buildings and
Parks Committee, reported that Foy Aust had indicated a desire to
purchase approximately 100 acres of land belonging to the Town for
the sum of $7,500.00, said land lying north and east of Route 11,
across from the Natioaal Guard Armory, for beautification purposes
and an access road to property now owned by Mr. Aust, and that the
deed to the Aust land carries a restriction which would give him two
25-foot right of ways over the town land. Mr. Eggert advised that his
committee was not entirely in agreement about this sale, but as chairman

The vote was three for and three against, and Mr. Aust broke the tie by voting
"aye" and the motion was carried.
SALE OF LAND Mr. Eggert asked that the land be sold to Mr. Foy Aust under

FOR NEXT MEETING. the terms of his report just given, with no vote to be taken at this
time, but that it be carried on the agenda for the next meeting of Cou~il.
Reporting for the Ordi Hance Committee, Mr. Farmer stated
that the members of the Ordinance Committee met with the Chief of Police,
in the Town Attorney's office with Mr. Moore, on April 28th. The purpose
of the meeting was to review an ordi Hance and to amend and re-enact Section
9-It of Chapter 9 of the Code of the Town of Pulaski. Mr. Moore was
asked b, the committee to write an ordinance that would provide for the
removal of weeds, trash, garbage, litter, etc., from abandoned property
and other areas not covered by regular collections; and to provide for
collecting the cost of such removal from the property if such debris is
removed by the Town. The ordinance was read by Town Attorney Moore, aqd
discussed by Council with Mr. Moore. On motion cf Councilman Farmer,

On motion of Councilman Gallimore, seconded by Councilman Farmer, and
carried, the date of June 15, 1966, was incorporated in the ordinance
as being the date on which all properties must be cleaned up. Ttie
ordinance is as follows:
AN ORDINANCE TO AMEND AND RE-ENACT SECTION 9-~ OF
CHAPTER 9 OF THE CODE OF PULASKI, VIRGINIA, TO PROVIDE
FOR THE REMOVAL OF WEEHS, TRASH, GARBAGE, RESUSE, LITTER,
ETC. FROM PREMISES IN SAID TOWN, AUTHORIZING REMOVAL BY
TOWN IN CERTAIN INSTANCES, AND FOR COST THEREOF, AND FOR
A LIEN
BE IT ORDAINED BY THE COUNCIL OF THE TOWN OF' PULASKI,
VIRGINIA, that:

(1) The owner, lessee, or the person in possession
of premises in the Town of Pulaski, Virginia, as leasees,
renters, or agent for an owner who is not a resident of the
said Tawn, shall at such time or times as the Council of
the Town may prescribe, remove from said premises any and all
trash, garbage, refuse, litter, and other substance which
might endanger the health of other residents of such Town. I n
the event any of the persons in possession of said property
shall fail to remove such trash, garbage, etc., then after
a fifteen (15) days notice in writing, the Council. or it's
designated agent shall have such trash, garbage, refuse,
littler or other substance which might endanger the health'
of other residents of said,Town, removed by its own agents
or employees, i n which event the actual cost or expense
thereof shall be chargeable to and payable ffiy the owner or
such other person who may have been in possession of said
premises, and may be collected by the Town by any method
available for the collection of taxes and levies in the Town.
(2) The owner, lessee, or such other person in
possession of premises in the Town of Pulaski, Virginia, as
lessees, renters, or agent for an owner who is not a resident
of the said Town, shall at such time or times as the Council
of the Town may prescribe, cut the grass, weeds and other

event the actual cost or expense thereof shall be chargeable
to and payable by the owner or such other person who may have
been in possession of said premises, and may be collected by the
Town by any method available for the collection of taxes and
levies in the Town.
(3) Costs o f the Town made under this ordinance
which remain unpaid for a period of sixty days after rendered,
shall constitute a charge against said person obligated to pay
said charge and to whom notice was given and in the event it is
against the owner of said property, said charge shall constitute
a lien against the real property involved; if the charge is not
against the owner, then said charge shall be assessed against
said person or against his personal property and may be collected
as any other obligation due the Town.
(!~) Reasonable notice under this section to put into
effect the provisions of Paragraph 2 above of this ordinance
shall be by Resolution of Council, which Resolution shall be
published in a local newspaper at least once in two consecutive
weeks, the first publication thereof to be at least thirty (30)
days prior to the effective date set in said Resolution;
reasonable notice to an individual to comply with said ordinance
or be subject to the provision that the Town would remove trash
or cut weeds, as the case may be, shall be deemed to be notice
in writing to the owner or to the lessee or the person who rents
said property or to an agent if said owner is a non-resident
of the said Town, delivered either in person or by certified or
registered mail, giving at least fifteen (15) days notice prior
to the time said Tawn performs the acts of which he is therein
notified.
(5) Charges made under this section shall be reasonable
charges for the services performed and shall be in keeping with
the general costs for like services by private persons.
(6) In the event a lien is to be claimed against any
property, then the Treasurer shall take the same action to
establish the lien as that used to establish a lien against the
property for delinquent taxes.

The Town Treasurer advised that he had no report to
make on the request of Council with regards to the possibility of
setting aside certain funds for specific projects, but suggested

There was no report on the beautification program other
than that given by Mr. Hillsman. Mayor Jackson advised that interest
continues to be good among civic clubs, churches and many individuals..
Mayor Jackson reported that each governing body participat-
ing in the New River Valley Airport Commission must pass a resolution
approving the dedication of at least a 50 ft. right-of-way to the Hightfay
Department for a secondary road to the Dublin Animal Laboratory, and

Town Manager Norton reported that efforts are being made

Town Manager Norton advised that he had made an inspection
of the streets with regards to conditions left by the Colonial Natural:
Gas Company contractors in installing the gas line, and felt that all

Town Manager Norton advised that equipment for the
installation of the Jefferson Avenue drain to Peak Creek from
Fourth Street had been secured by competitive bids, and that as
soon as some of the equipment is received, work will begin on
the upper end of the drain; that with a 10" lateral to the
Methodist Church anal an 18" lateral back of the YMCA, should help to
relieve the storm flooding condition now at Fourth Street and
Presbyterian Church.
Mayor Jackson urged the Youth Group to ask of Council
