Minutes of the regular meeting of June lath and special meeting of June 11th were approved. Town Manager Noland read a .letter addressed to OPP05ITION PRESENTED TO PROPOSAL TO OPEN FIRST ST. PARK FOR PARKING Mayor C. V. Jackson from the Pulaski Garden Club, together with copyi of a resolution which the Club had adopted on June 11, 1963, ' in which they strongly protested the proposal to open First Street Park for off-street parking. Mr. Noland also read a letter from the Pulaski Town Planning Commission Secretary addressed to the Town Council in which it was stated that based on information avail- able at the time of their meeting the Planning Commission was opposed to the conversion of First Street Park into an off-street parking area. Mrs. J. C. Harman, representing the Pulaski Garden Club, spoke at length setting forth the reasons for the club's opposition to the proposal to open a portion of First Street Park for off-street parking and also stating that a search of the records in the County Clerk's Office indicated that it was the purpose of the original owners, Ernest Calfee, Frank Wysor, Tom Kersey and G. Mrs. Groseclose, Mrs. Cruise and ,- Mrs. Nuckols stated that from their observation there seemed to be ample parking space if persons would take advantage of several .lots near the business district, and they felt the park was a definite asset to the town. Mr. Hall stated that it was the desire of the owners of this property when it was deeded to the Norfolk and Western Railway Company (owners being Ernest Calfee, Frank Wysor, Tom Hersey ; and himself) that it be used as a pariC, and it was so stated in the deed. DISCUSSION OF Frank Johnson, president of the Pulaski Merchants OPENING FIRST Association, read a petition to Council. in which fifty-six (5b) STREET PARK merchants had signed opposing the conversion of First Street nark into an off-street parking area. FOR PUBhIC At this time Curtis C. Jordan advised that as a result) .PARKING of a request by the Pulaski Merchants Association that First Street Park be considered for off-street parking, that he, in the company of Mayor Jackson, T. J. McCarthy and T. B. Noland, contacted the officials of the Norfolk and Western Railway Company in Roanoke and at that time it was presented to the officials of that company for a parking lot. Mayor Jackson advised that there were "no strings attached" to the area in question in the deed from the Norfolk and ?~-estern Railway Company to the Town, and had it not been given to the town, the area would have some day been used as an industrial area. Sgt. Black, as a private, citizen, said he was against !; the park being converted into a parking lot; that he felt we needed tb progress but also felt that the community should be educated and if this area ~s the place for the municipal building, as some think, then let the people know about it and have their say about its use. He was in favor of long-range planning. NO ACTION No action was taken by Council on the matter. M. and bounded on either side by property belonging to the Virginia Maid Hosiery Mi11s with the exception of ninety-eight (98) feet thereof on the west side of Lee Street belonging to Jefferson Mills Division, Kahn & Feldman, Inc. At this time T. S. Dalton, Attorney for Mrs. D. T. Dopey of Norfolk, Virginia, advised that Mr. Alton I. Crowell, who represented James L. Sturgill and Morris Burton, was unable to attend the hearing because of being involved in a case before the Judge of the Circuit Court. Mr. John H. Rice stated the matter must be solved quickly because "it will ruin our fall business if it isn't". Town Attorney Moore stated that the petition of the Virginia Maid Hosiery l~'ills, Incoz~3orated, filed by Mr. R. R. Rice, as president and attested and signed by J. V. Virginia, and that on the 21st day of May, 1963, their petition which was dated the 6th day of May, 1963 , w~,s presented to the Town Council and that on the 21st day of May, 1963, a formal resolution was adopted by the Town Council in which resolution Council appointed G. C. Hall, I. R. Carper and Curtis C. Jordan as viewers, and 0"Dell Mayberry, alternate viewer, and set the 18th day of June, 1963, at l~:30 P. M., as the date and time to hold a public hearing on the matter. That on the 12th day of June, 1963, G. C. Hall, O'Dell Mayberry and I. R. Carper, viewers, met and were given written instructions; they proceeded to go on the premises, and did view the same, and on the 12th day of June, 1963, made their formal report to the Town Council. Ni, INSTRUCTIONS TO VIEWERS Re: Town of Pulaski, Virginia Vacation and abandonment of a portion of Lee Street within the Town of Pulaski, hereinafter more fully described in detail. Convening of the duly appointed viewers of said Town at on the 12th day of June, 1963, in the offices of the Town of Pulaski, Virginia. PRESENT: Garnett S. Moore, Attorney for the Town of Pulaski; G. C. Hall, O'Dell Mayberry; I. R. Carper Viewers are hereby instructed by the said Town Attorney as follows: (1) That your appointment was made by the said Town TNSTRUCTIONS under authority granted in Title 15, Section 766 of the Code of Virginia of 1950, as amended, and any and all other general TO VIEi~IERS powers granted said town; RE: PETITION (2) That as viewers appointed by said Town, you are instructed to view that certain street set out as described TO CLOSE fully in the petition filed and described as follows: LEE ST. BEGINNING at the southern terminus of Lee Street at the northern boundary Line of First Street, South; thence between parallel lines. 50 feet apart; North 2 deg. East a distance of It04.73 feet to a point in the boundary line of said Street 25 feet South of the Southern boundary line of an alley running east and west. (3) You shall determine by your view and your evaluation thereof whether or not any inconvenience wt~uld be caused by the closing of the aforesaid, and if you determine that any inconveniencd would be caused to any person, firm or corporation, the exact inconvenience which would result and to whom from the discontinuance or the abandonment of that ,portion of Lee Street a as a part of the street system of the Town of Pulaski, Virginia. We, the undersigned, viewers, duly appointed by resolution of the Town of Pulaski, Virginia, adopted on the REPORT OF 21st day of May, 1963, did convene in the Town Offices of the Town of Pulaski, Virginia, at 9 A. M. on the 12th day of June, ~~~ 1963; and at that time were instructed bar the attorney for the said Town of Pulaski, Virginia, upon our duties as viewers, RE: CLOSING and a copy of the instructinn having been made a part of 'the record of these proceedings. OF LEE ST. Upon receiving said instructions, the undersigned Commissioners did to upon the parcel of land set out and described in the petition filed by the aforementioned petitioners, and did view the same, and have reached our decision and evaluation thereof as follows: After viewing the land, the only inconvenience would be to the property lying on the southwest side of said Street, and we have information that the owner of said property would not offer any objection to the closing of the street. Mayor Jackson asked those in favor of the closing of Lee Street to so state their names: J. R. Rice; J. C. Crumbley, Jr.; .'. J. V. Goodson; Clark Owen; Warren Bogardus; Earl Hi1l;and Geo. A. Crowell, Attorney for Mr. Sturgill and Mr. Burton, being unable to appear, as well as the Law Firm of Gilmer, Herman and Sadl er, representing the Virginia Maid Hosiery Mills, Incorporatled. Mr. Rice, at this time, stated that the hosiery business is a very keenly competitive business and that the new building is very necessary to their fall business. He further stated that plant expansion could have gone to Wytheville, but that they elected to spend a million dollars on plant expansion in Pulaski which would ' make it necessary that their plant employ an additional fifty personls. fir. Earl Hill wished to go on record as favoring the closing ', of Lee Street for the plant expansion of Virginia Maid Hosiery Mills and further stated that his company was ready to sell them the ninet~- eight feet 1 ocated on the west side of Lee Street. Mr. Warren Bogardus, representing Sweet-Orr Company advised they would like to go on record as favoring the closing of Lee Street for Virginia Maid Hosiery Mills' expansion. PUBLIC HEARING At this point the hearing was recessed to reconvene again RECESSED, TO RECONVEI9E at x:00 P. M. Thursday, June 20, 1963, in the municipal offices. JUNE 20TH Mr. Carrico, Chairman of the Sewer Committee, advised that his committee recommended the installation of the Northwood Sewer line, which was reauested by property owners on lrlillow Avenue and Greenbrier Avenue, at an estimated cost of $11,000.00, with ten COUNCIL ACCEPT- out of a potential of sixteen to take a connection at this time. Councilman Aust moved that the recommendation of the Sewer Committee be accepted and,; the work on the installation of this line to proceed after the paymeht of the minimum of ten fees. This motion was seconded by Councilman Cummings, and carried unanimously. Town Manager Noland stated that according to a verbal statement from the two local banks, the Town could borrow part TOWN ATTY. & TOWN of the sum of $135,000.00 needed for making up the final payment MGR. After a discussion of the legality of said loah, Councilman McCarthy moved that the Town Manager and Town Attorney be empowered to work out the details of the loan with the two local banks. This motion was seconded by Councilman Gallimore, and carried. The matter was discussed briefly, and on motion of Councilman Gallimore, seconded by Councilman Aust, and carried, the matter was turned over to the special Gatewood Reservoir Committee. It was then realized that no one had been named to GALLIMORE NAMED TO take the place of John W. Nash, a former councilman, and Mayor GATEWt~D RES. COMM. IN PLACE Jackson, with Council's consent, named Mr. Gallimore to serve OF JOHN HASH on the Gatewood Reservoir Committee along with T. J. McCarthy, F. L. Carrico and Eugene L. Nuckols.
