V. Jackson, presiding. Councilmen: W. A. Larson, C. B. Gallimore, ?rl. S. Cummings, F. L. Carrico, Billy B. Flint, Eugene L. Nuckols, T. J. McCarthy Absent: Glen K. Aust Also present: Town Manager: T. B. Noland Clerk: Gladys R. Dalton Town Attorney: Garnett S. Moore Visitors: Jim Terrell, reporter for Southwest Times Lloyd Petrey John M. Columbus, WPUV Radio Station The invocation was given by Town Manager Noland. Minutes of the regular meeting of June 18 and special meeting of June 20, were approved. Mayor Jackson advised that as had been advertised APPROVAL OF 1963-61t BUDGET BY COUNCIL AT PUBLIC HEARING in the local newspaper, this was the date, time and place set for a public hearing on the proposed budget for 1963-6Lt fiscal year, and that Council would be glad to hear any one who had anything to say either for or against said budget. There appeared to be no one present opposing or favoring the budget. Councilman Carrico moved that the 1963-6l, budget as prepared and in its final form be approved, which motion was seconded by Councilman Larson. Th ere followed a discussion, after which this motion and second was withdrawn, and Councilman Nuckols moved that the 1963-6l~ budget include an item under "notes payable" in the sum of X135,000.00 to re-pay the loan which the town would secure from the Pulaski National Bank in the sum of :fi70,000.00, 1 1 and the Peoples National Bank in the sum of $65,000.00; and that this be placed in the budget by the au~3itor under the proper heading. This motion was seconded by Councilman Flint, and carried unanimously. Councilman Carrico then moved that the 1963-6It budget as presented and as amended be adopted, which motion was seconded by Councilman Larson, and carried on the following recorded vote: W. A. FOR WA7FR to the Water Committee for investigation and report to Council. SERVICES TO CASE KNIFE A petition from Elbert Fink, Smith Lane, for water ROAD service was presented to Council. Town Manager Noland advised that this line extension would cost approximately `707.00, and that ': Mr. Fink had offered to pay X150.00 for connection fee rather than WATER COMM. TO STUDY the usual fee of ¢80.00. On motion of Councilman Carrico, seconded SMITH LANE REQ. FOR by Councilman Gallimore, and carried, the matter was referred to the WATER SERVICE T^later Committee for a study and report to Council. r] A peti tion from residents of Alum Springs Road, beyond '' Fred ~wineburne's residence, for water and sewer services was presented WATER & to Council. On motion of Councilman McCarthy, seconded by Councilman SEWER COMMS. TO STUDY Gallimore, and carried, this petiton was turned over to the Water ALUM SPGS. ~• ~'• Committee and the Gower Committee for a report to Council. Lark, Jr. , ;, i.n which letter Mr. Lark reouested the removal. of two trees at 60~i Pr~pspect Avenue, on town property, for the reason that because of birds roostitfg in these trees prohibited the parking of automobiles under them. July 2, 1963 ADOPTION OF AUTHORIZING OF NOTES FOR AN ORDINANCE AUTHORIZING THE ISSUANCE OF NEGOTIABLE NOTES OF THE TOWN OF PULASKI, VIRGINIA, IN THE AMOUNT OF ONE HUNDRED AND THIRTY-FIVE THOUSAND INANCE DOLLARS ($135,000) FOR PAYMENT OF THE UANCE SUM DUE THE COMMONWEALTH OF VIRGIi~IA 35,000. ON ROUTE #99 AND FOR CONSTRUCTION OF AN ADDITION TO THE FIRE HOUSE WHEREAS, the Town of Pulaski, Virginia, has heretofore obligated itself for the payment of its share of the cost of theconstruction of Route #99 and for the erection of a needed addition to the Pulaski Fire Department; and, WHEREAS, it is necessary that the Town of Pulaski, Virginia, borrow the total sum of One Hundred Thirty-five Thous Dollars (5135,000) to finance the aforesaid project; One Hundred Twenty-~tzao- : Thousand Dollars (5122,000) thereof to be paid to the Commonwealth of Virginia as the balance due on the constructio cost of Route #99, and Thirteen Thousand Dollars ($13,000) thereof for construction of the fire house; and, WHEREAS, the Pulaski National Bank and the Peoples National Bank of Pulaski, Virginia, offered. to loan the Town of Pulaski, Virginia, the amount of One Hundred Thirty-five Thousand Dollars, ($135,000) at an interest rate of three (30) per cent per annum, the Pulaski National Bank to loan Seventy Thousand Dollars ($70,000) thereof, and the .Peoples National Bank of Pulaski Sixty-five Thousand Dollars ($65,000) thereof, with interest on said loans payable semi-annually; and, WHEREAS, the Treasurer of the Town of Pulaski has filed Council mins. July 2, 1963 o with Council a certificate showing that the assessed valuati of the real estate in the Town of Pulaski, Virginia, subject taxation is $4,998,000.00; that the assessed valuation of personal property is $1,7171530.00; that the assessment on f ~~~~ personal property classified as machinery is $930,090.00; tha the assessment on public utility properties within the Town o Pulaski is $1,279,992.00; and that the outstanding bonds or o interest-bearing obligations for any purpose of the Town of Pulaski, Virginia, on July 1, 1963, were as follows: Sewer Bonds (Revenue) (7/1/58) $921,628.00 Water Bonds (Revenue) (4/1/46) 316,000.00 Water Bonds (Revenue) (7/1/58) 571 737.00 $~$~ , 3~ 6 5.0 0 1 all of which are self-liquidating; a copy of said certifica of the Treasurer being incorporated herein and made a part of this ordinance; and, WHEREAS, the issuance of the negotiable notes totalin g One Hundred Thirty-five Thousand Dollars ($135,000), plus all!' other existing indebtedness far any purpose, will not exceed eighteen per cent (180) of the assessed valuation of the real'. y ;. estate in the Town of Pulaski subject to taxation as shown bye the last preceding assessment far taxes, and the indebtedness; of the Town of Pulaski will therefore not exceed the limitation provided in Section 127 of the Constitution of Virginia, or t~e statutes of the Commonwealth of Virginia; and, ' a WHEREAS, this loan and this ordinance are made under t~e r u authority of and in compliance with the provisions of Section; _2_ R~~~~ Council mins. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE TOWN OF PULASKI, VIRGINIA, that: (1) The Town of Pulaski, Virginia, duly issue its negotiable promissory notes, one in the amount of Seventy Thousand Dollars (570,000), dated July 1, 1963, payable to the order of Pulaski National Bank of Pulaski, Virginia, at said Bank, bearing interest at the rate of three (3%) per cent per annum, said interest to be paid semi-annually, and the principal of said note to be payable on or before June 30, 1964; and one in the amount of Sixty-five Thousand Dollars (565,000), dated July 1, 1963, payable to the order of the Peoples National Bank of Pulaski, Virginia, at said Bank, bearing interest at the rate of three (3%) per cent per annum, said interest to be paid semi- annually, and the principal of said note to be payable on or before June 30, 1964; with right of anticipation reserved on both notes; said notes ar..e issued under authority and in full compliance with the Consti ution and the statutes of the Common- wealth of Virginia and the Charter of the Town of Pulaski, Virginia. (2) On the Town's behalf, the notes shall be signed by the Mayor of said Town and attested by the Clerk, with the corporate seal of the Town of Pulaski, Virginia, affixed thereto. -3- Council mins. The assessment on Public Utility Property in the Town is $1,279,992,00. The assessment on Personal Property is $1,717,530.00. RE TEMP, LOAN 1 1 TO THE TOWN OF PULASKI, VIRGINIA; July 2, 1963 Q~''f~~s~ This is to certify that in the opinion of the undersig~ked, the ordinance adopted by the Council of the Town of Pulaski, Virginia, on the 2nd day of July, 1963, authorizing and approving the borrowing of One Hundred Thirty-five Thousand Dollars ($135,000), Seventy Thousand Dollars ($70,000) thereof from tl~e Pulaski National Bank, and Sixty-five Thousand Dollars ($65,Oa0) from the Peoples National Bank, to be paid within the next twelve (12) months, said loan being for the purpose of meeting approttiria- Lions made for the current fiscal year beginning July 1, 1963,; and in anticipation of the collection of taxes and revenues of such fiscal year, or other funds available or to become available to the Town by or before the maturity date of such notes, is valid ordinance and a valid. exercise of the Town's authority f',or making to mporary loans under the provisions of its charter and under the general laws. o_f the State of Virginia, and particulajrly under Section 15-666.63 and subsequent sections of the Code of Virginia of 1950, as amended; that the borrowing of said money will not exceed eighteen (18) per cent of the assessed valuatijon of the real estate in the Town of Pulaski, Virginia, subject do taxation as shown by a certificate of the Treasurer of said Town, setting out the assessments for taxes as provided him by the Commissioner of Revenue of the County of Pulaski, Virginia, and the existing indebtedness of the Town of Pulaski, together with the $135,000 borrowed under the aforementioned ordinance, will therefore not exceed the limitations of Section 127 of the Constitution of Virginia or any statutes of the Commonwealth j of Virginia. The Town Attorney was instructed CHANGES IN PROPOSED to make certain changes and present the ordinance to Council AMENDMENT TO C~iRBAGE ORD. at its next regular meeting for approval. AND RE-SU~'!IT An ordinance to amend and re-enact Section 20-L~2A, 2.0-l~?_B and 20-lt2C providing for sewer service charges, billing, users, and water line breaks, was presented to Council by Mr. Moore, and on motion of Councilman Nuckols, seconded by Councilman Larson, and carried unanimously, the following ordinance was adopted: AN ORDINANCE TO AI~ND AND RE_EPdACT SECTION 20-~2A, 20-1~2B, and 29-1~2C, IN PROVIDING FOR SE~~dER SERVICE CHARGES, BILLING, USERS, ZaATER LINE. BREAKS. Section 20-1,2, Annual Sewer Assessment, is hereby ORDINANCE - repealed. Section 20-l..2A, 20-l~2B, and 20-1~2C are hereby SE4JER SERVICE enacted as fol7.ows: CHARGES & BILLINGS Ser_.ti.on 2O-li2A, Sewer Service Charge. After the calculation of each water charge, whether the charge be on an metered or on a flat rate basis, there shall be calculated and charged an additional amount eoual to fifty per cent (50~) of said metered or flat rate water charge. Section 20-l~2B, Billing - TJser. After determination of the sewer service charge has been made under the formula set out in 20-l~2A, the user of said water shall be assessed with the said sewer service charge. The Town Manager shall set up a method of billing said users at regular intervals and it shall. be the duty of the Town I~ianager to see that all users are billed in the manner pre- scribed. It was moved, seconded and carried that Council go into EXECUTIVE SESS. executive session. There being no further business which necessitated action by Council, the meeting adjourned at 6 P. M.
