Councilmen: W. A. Larson, W. S. Cummings, T. J. McCarthy Eugene L• Nuckols, C. B. Gallimore, Glen K.Aust, F. L. Carrico, Billy B. Flint Also present: Town Manager: T. B. Noland Clerk: Gladys R. Obel Ratcliff The invocation was given by Councilman Aust. Mayor Jackson declared the meeting to be a public hearing PUBLIC HEARING and advised that Council will be glad to hear anyone who opposed FOR CLOSING the closing of a portion of Lee Street. There appeared to be no LEE STREET one present opposing the closing of said street, and Mayor Jackson advised Council would then hear those who favored the closing of said street. Mr. Harman, Attorney for the petitioners, without reviewing the petition and proceedings to date, asked Council that same be considered by them, and further advised that Virginia Maid had acquired an option to purchase from the only protesting property owner, Mrs.Hettie S. Dooley, and this problem would VA. MAID HAS shortly be disposed of, but there remained one problem and that OPTION TO was the culmination of the purchase of the Smith lot, a matter PUR. DOOLEY PROPERTY, PUR. which is now pending in the Circuit Court, and that if it became OF SMITH LOT HANDLED THRU necessary for the Town to foreclose in this matter the Virginia COURT; NO FURTHER OBJS. Mr. Harman stated he hoped Council would act favorably on this request, stating that it would mean more employment for this area as well as more taxes for the Town. Mr. Harman further advised that upon the acquisition of the Smith property there would be no adjacent property owners, as Virginia Maid would own the land on both sides of that portion of Lee Street proposed for closing; that the 12 foot alley running east and west and parallel to Commerce Street, would be widened by eighteen (18) feet by the Virginia Maid according to Town specifications, thus providing a thirty (30) foot street, the expense of which would be borne by Virginia Maid with the Town to do the actual work. May 28, 1964 Obel Ratcliff, appearing only as an interested citizen, stated he hoped Council would see fit to close that portion of Lee Street as requested by Virginia Maid, as he felt the Town was happy to have this industry; retaining rights of ingress and egress to service utilities. It was brought out that there would be no water line under the new expansion, and that the terra cotta APPROVAL sewer line would be replaced by cast iron pipe. OF Raymong Ratcliff and Geo. A. Hillsman, representing the CLOSING Chamber of Commerce, advised that a survey conducted by the PORTION Chamber indicated very little use of Lee Street, except by the OF LF E ;;T. Virginia Maid mill and its employees, and hoped that Council would act favorably on this request of Virginia Maid. Town Attorney Moore advised that the viewers appointed by Council had met and been instructed, and had submitted their report as follows: Re: Town of Pulaski, Virginia Vacation and abandonment of a portion of Lee Street within the Town of Pulaski, hereinafter more fully described in detail. Reconvening of the duly appointed viewers of said Town at 10:00 A. M. on the 26th day of May, 19611, in the office of the Town Attorney, Pulaski, Virginia. PRESENT: Garnett S. Moore, Attorney for the Town of Pulaski, G. C. Hall Odell Mayberry INSTRS. I. R. Carper TO Viewers are hereby instructed by the said Town Attorney as follows: VIEWERS (1) That approximately twelve months has elapsed since the view previously made in connection with these proceedings for the closing of Lee Street, and that it is now necessary to go upon the premises and to review them for any change of condition and to report to the Council of the Town of Pulaski, Virginia, as hereinafter set out. (2) That you are to view that certain street, and particularly that portion of it hereinafter described as follows: BEGINNING at the southern terminus of Lee Street at the northern boundary line of First Street, South; thence between parallel lines 50 feet apart, North 2 deg. East a distance of 1129.73 feet to a point in the boundary line of said Street at the intersection with the Southern boundary line of an alley running east and west. (3) You shall determine by your view and your evaluation thereof whether or not any inconvenience would be cause d by the closing of the aforesaid, and if you determine that anjr incon- 03 VIEWERS' 10 .4: t7 Council mins. contd. M. venience would be caused to any person, firm or corporation, the exact inconvenience which would result and to whom from the discontinuance or the abandonment of that portion of Lee Street as a part of the street system of the Town of Pulaski, Virginia. (h) To report in writing your findings as above indstucted in this matter to the Council of the Town of Pulaski, Virginia. This report is to be filed as soon as convenient after you have viewed the proposed street to be abandoned or vacated, and after your evaluation thereof from your view, and from such other facts you determine to be pertinent thereto. RE: Town of Pulaski, Virginia Vacation and abandonment of a portion of Lee Street within the Town of Pulaski, Virginia. Second view. PETITIONER: Virginia Maid Hosiery Mills, Inc. We, the undersigned viewers, duly appointed by resolution of the Town of Pulaski, Virginia, adopted on the 21st day of May, 19632 did thereafter convene and make our report on the 12th day of June, 1963; and we have been requested to go upon the premises and take another view of said premises since the matter has been pending approximately twelve months since our last view, and after having been instructed by the Attorney for the said Town of Pulaski, Virginia, upon our duties as viewers, and a copy of the instructions having been made a part of the record of these proceedings. RE:CLOSING Upon receiving said instructions, the undersigned Com- missioners did go upon the parcel of land set out and described LEE STREET in the petition filed by the aforementioned petitioner, for the second time, and did view the same and have reached our decision and evaluation thereof as follows: It is our opinion that if the 30 -foot street is opened running between the west line of Jefferson Avenue and the east line of Lee Street, that there would be no inconvenience to any one due to the proposed closing of a portion of Lee Street. Maid it was, RESOLVED, that the Town Attorney be directed to draw an ordinance which would close Lee Street from First Street South to a point eighteen feet south to the 12 foot right-of-way of the alley running between Lee Street and Jefferson Avenue, subject to the petitioners providing eighteen (18) ddditional feet to add to the twelve (12) foot existing alley and petitioners completing this TOWN ATTY. thirty (30) foot area into a street according to town specifications INSTR. May 28, 19611 line advisable, he recommended that the Town pay the difference in the cost between an eight inch and ten inch line, with the under- standing that this cost difference would approximate $630.00. It was further explained that so far as is now known the Lee Street sanitary sewer line serves only the Virginia Maid Company, the LEE ST.TC company will be required to replace the terra cotta sewer with SANITARY SEWER TO cast iron at all places where the construction in Lee Street BE REPLACED BY VA.
