Town Manager Noland read a letter from Mr. John A. ~tler in which he called Council's attention to the traffic situation at the corner of Madison and Third Street and asked that a traffic light be installed where the "stop" signs now exist. Mr. Butler also stated several bad wrecks had occurred at this corner since the opening of Route 9g and he urgently requested Council STREET COMMITTEE to consider the installation of a traffic light at this intersectimn. TO STUDY TRAFFIC SITUATION AT On motion of Councilman Auat, seconded by Councilman McCarthy, and COR. THIRD & MADISON ST. carried unanimously, it was, RESOLVED, that the traffic situation at the corner of Madison Avenue and i'hird Street be turned over to the Street Committee for investigation and observation, to report back to Council. Ths dommittee of women asked Council what progress had been made in abating the smoke and noise from the industrial plants in Pulaski. They were advised by members of Council as well as the ENGINEERING Mayer, that an Engineering firm had been contacted with regards FIRM CONTACTED RELATIVE TO to making a survey to determine what can be done at these plants SURVEY OF INDUSTRIAL PLANTSto combat the smoke and fallout, which survey is necessary before TO COMBAT SMOKE AND any steps can be taken to correct the situation, or before an ordinance FALLOUT 1 1 1 can be drawn relative to air pollution. M. aaapbell, Attorney for the Col®nial Natural Gas C®mpar~y, passed copies of his co~anyts letter regarding the gas franchise to members of Council to read. Councilman Carrico moved that after the meeting was over that Council go into executive session to discuss the gas franchise. This motion was seconded by Councilman Auat and carried unanimously. Later in the meeting, and after a full discussion in the executive session relative to the granting of a franchise to the Colonial Natural Gas Company, and in the subsequent open session of Council, Councilman Nuckols, as Chairman of the Ordinance Committee, advised that subsequent to October 17, 1961, the POLICIES OF date of the public hearing and opening of bids, that his COLONIAL ~iATURAL GAS CO, S]~T FORTI~ommittee, together with the Town Attorney and Town Manager, had IN LETTER TO TOWN negotiated with the Colonial Natural Gas Company through its Attorney, Mr. Campbell, and by reason of these negotiations, established that the Gas Compatay's policy world be set out in a letter dated NoTember 2, 1961, to Mayor C. Q. Jackson and in keeping with the other standards and requirements imposed bT the Building Code and subsequently imposed by the State Corporation Commission. Dear Mayor Jackson: I have met with the Sub-Committee. of your Council and with Mr. Noland., and I would like. to give you the following information which was brought up in those meetings concerning the roposed operations of Colonial Natural Gas Company i~ Pulaski: (1) Colonial Natural Gas Company will purchase. gas from a transmission company probably taking delivery at or near the. Virginia State. line. At this point, the gas will be metered. and. od.orized.. The. transmission companies d.o not put anything in to give. the gas a distinctive odor, but this will be done when Colonial takes delivery so that all gas d.elive.red. by Colonial will be. odorized.. (2 ) The. pipes proposed. for the distribution system will be either cast iron or steel with a coal tar wrapping, depending on local conditions. In the resid.e.ntial districts, these pipes will carry 20 lbs. of pressure but they will be capable of carrying 150 lbs.; however, the. normal pressure will be 20 lbs. (3) The. Gas Company will install and, main- tain meters and connections to private users from its mains, again depending on local conditions. The Gas Company will pay for these connections on private property within 50 or 100 feet of the street line but will be responsible for maintenance of all connections on private property. (4) No gas will be turned. on in any residence or business until the Gas Company has inspected. all appliances and. installations and, have seen that they conform to an accepted. building code. In any event, the. inspection will conform to accepted. standards. (5) It will be. Colonial's pol:i.cy to have a public user rate., which would. mean that the. Tawas of Pulaski would. get gas for its uses at a discount from the. regular commercial or re.sid.ential rate. ~~~ (6) It will be. Colonia7_ts policy to carry liabil~_ty insurance ir. a substantial amount. For your confident~_al information, East Tennessee Natural Gas Company now carries liability insurance in the. amount of `3,000,000.00. There. is no plan or intention of Colonial to be a self-insurer, and. it is certainly to Colonial's inte.re.st to carry adequate liability insurance.. However, we would. strongly oppose the writing into the franchise. of any sort of compulsory liability insurance because we thinlc this would. set a particular precedent and. would, not necessarily accomplish the desired end. I shall be ready and willing to discuss any other matters which may arise, but I hope the foregoing will clarify the points which you and. the Council had. in mind . Aust - age Claude B.Gallimore -aye FRACHISE GRANTED COLONIAL NATURAL it was, RESOI.9ED, that the franchise be awarded to Colonial Natural GAS. CO. ON FIRST READING, SUBJECT TOGas Company on this the first reading, sub3ect to a second and SECOND & FINAL READING final reading as soon as the Town Attorney prepares the final franchise. Mr. Wysor sttated that it now appeared that the heirs of the late Frank Wysor, together with Mr. G. C. Full and Mr. Tom Kersey, were ready and willing to convey to the Town their interest, without further investigation of the ownership, to the channeled portion of Peak Creek, and he hoped the transfer of title could be worked out at this time. Town Attorney Moore explained that their MATTER OF EXCHANGE proposal involved an exchange of quitclaim deeds. The three OF LOTS RE : PEAK CREEK REFERRED TO parties propose to deed whatever rights they have to the walled COMMITTEE FOR FOR STUDY AND creek channel, except for four parcels fronting 5O ft. each side of CONSIDERATION the Washington Avenue and the Jefferson Avenue Bridges, and tanning back 130 feet from each side of the two bridges. In return, the Town would dedd whatever rights the Town might have to the four parcels as described. On motion of Councilman McCarthy, seconded by Councilman Cummings, and carried unanimously, it was, RESOLVED, that the matter be referred to the Land, Building and Parks Committee with the Town Manager to xazk with them, for a study and recommendation to Council. Mrs. Mona Leftwich appeared before Council in protest NO ACTION TAKEN to the recent petition before Council that a building belonging to BY COUNCIL - MRS. MONA LEFTWICHher be demolished. No action was taken by Council on this matter. PROTEST PETITION THAT BUILDING Council discussed the matter of opening the road leading BELONGING TO FiER BE DEMOLISHED from the National Guard Armory to Valley Road. It was Council's decision that this road should not be opened, and on motion of TG~JN WILL NOT Councilman Nash, secotuled by Councilman Nuckols, and carried OPPOSE STATE ~ HIGHWAY TAKING unanimously, it was, RESOLVED, that the Town has no further need ROAD LEADING FROM ARMORY TO VALLEY ~jpr this road and would not oppose the State taking it out of OUT SEC DA Y OF ON R '!.SYSTEM, ~ the Sea~pd~ry System. ti ., Council mina. cmntd. M. ~~ ~~~ Town Attorpdy Moore advised that condemnation pro- ceedings with reference to Route 99 were being heard in the Circuit Court; that in the first such Court action Herman E. CONDEMNATION PROCEEDINGS RE : ROUTE 99 BEING HEARD IN CIRCUIT COURT ~~ Jones was awarded $160.00 damages, the amount specified by the I appraisers having been $lt0.00; and that other condemnation suits would be heard sometime this month or in Iaecember. Couhcilman Aust reminded Council that when Ned Bane I was appointed Director of Recreation and began his duties with the '~oKn on May 15th, Council agreed to discuss a raise for Mr. Bane at the end of six months. Councilman Gallimore moved that the matter be placed on the agenda for immediate discussion. This motion was seconded by Councilman Aust, and carried unanimously. It was felt that Mr. Banes services were most satisfactory and on motion of Councilman McCarthy, seconded by CounciLnan Gallimore, and carried on the following recorded vote: Billy B. Flint - aye F. Aust - aye Claude B.Gallimore - aye SALARY INCRESSEDD TO $100.00 PER 3t was, RESOLYED~ that Ned Banes salary be increased to $1100.00 MONTH a month, with this increase to be considered with the neat pay period ending November 2l~th, 1961, and that the sum of $175.00 is appropriated to Account 12A 100-3 to take care of this increase in the budget.
