~~~53 Minutes of the regular meeting of the Pulaski Town Council, held on the 5th day of December, 1961, at ~t P. M., in the Municipal Office. There were presents Mayor C. V. Minutes of the regular meeting of November 21st and the called meeting of November 27th, were approved. Copies of the point County and Town annaal financial statement booklet were presented to Council, and Mayor Jackson commented favorably upon the excellent point publication of a booklet c©vering the financial status of the two governing bodies. i Town Manager Noland stated that the copies he had taken with him to , BOOKLETS r COVERING the International City Managers' conference in Miami Beach, Florida, FINANCIAL STATUS OF COIINTY & . last week were much in demand, and there was quite a bit of comment TOWN GIVEN TO MEMBERS made regarding the cooperative spirit of these governing bodies as OF COUNCIL .AND COMMENT- was reflected in the publication of this booklet. ED UPON Mr. Farmer and Mrs. Spencer appeared relative to the air pollution situation and asked what progress was being made. They were advised that a qualified combustion engineer from another city will shortly come to Pulaski and make a survey of the situation and QUALIFIED COMBUSTION advise Council as well as recommend to Council an Engineering firm ENGINEER WILL SOON VISIT to whom this matter can be referred for a complete survey, before P[TLgSKI & MAKE SURVEY OF Council considers the adoption of an ordinance relative to air INDUSTRIAL PLANTS pollution. Mr. McMillan appeared before Council relative to the subdivision of two lots mn Newbern Road, and was advised by Town Manager Noland, who is Secretary of the Planning Commission, that 34.4 McMILLAN ADVISED T 0 MEET WITH TOWN PLANNING COMM. & GIVE INFORMATION RELATIVE TO LOTS ON NEWBERN ROAD Council mina. contd. M. the matter is pending before the Town Planning Commission, and suggested that Mr. McMillan attend the Commission's next meeting and submit the additional information which had been requested by the Commission. Mr. Ga7.l.imore, Chairman of the Police Committee, advised that his committee had followed through on the directions of Council and that a complete investigation had been made of the taxicab situation and while the Committee felt that perhaps there vets periods during which each taxicab company could use an additional cab, it was the recommendation of the Committee that Council re- issue Certificates of Public Convenience and Necessity to the thirty-two cabs now in operation; that all defects which were found had been corrected, and recommended that all taxicabs be checked upon frequently to see that they are being operated properly. On COUNCIL ACCEPTS RECOMMENDATION OF motion of Councilman Flint, seconded by Councilman Aust, and POLICE COMMITTE E & CERTIFICATES carried unanimously, it was, RESOLVED, that the Police Committee's FOR OPERATION OF TAXICABS GRANTED recommendation be accepted, and that Certificates of Public BY COUNCIL FOR OPERATION OF 32 Convenience and Necessity be issued for the coming year, 1962, TAXICABS covering the thirty-two cabs now in operation. M. i radios in the homes of the volunteer firemen for the purpose of notifying them of the location of fires, ete. and whether Council should then appropriate a sum to take care of the radio set up. After a full discussion of a report by the Land, Buildings& Parks Committee on the Peak Creek lot exchange, Councilman Carrico LAND,BLDG. & PARKS COMNBTTEE TO moved that the Committee contirn~e their negotiations with the heirs CONTINUE NEGOTIATIONS ON PEAK CREEK of the Pulaski Land and Improvement Company, and bring back a LOT EXCHANGE recommendation to the Council. This motion was seconded by Councilman Cummings, and carried unanimously. A resolution was presented to Council regarding the closing of certain alleys, and on motion of Councilman Nuckols, seconded by Councilman Flint, and carried unanimously, the following resolution was adopted: RESOLUTION WHEREAS, three separate petitions and applica- tions for alteration, vacation, abandonment or the re-subdividing of certain subdivisions, have been filed with the Town of Pulaski, Virginia, as follows: (1) Herman E. Jones and Ethel P. Jones for re-subdividing and vacating a ten-foot alley, as more fully shown in said petition. (2) Hazel Greer Robertson, Lucille Huff, Sr., RESOLUTION H. W. Huff, Jr., and Sarah Huff Tuck, and Walton L. APPOINTING Huff, for vacation and discontinuance of a certain GLENN, BOARD, alley beginning at the southern line of Seventh HALL & GRIGSBY . Street, North, and running Sonth to the M. A. Shoff AS VIEWERS FOR property, as.more fully set out and described in the CLOSING ALLEYS petition. (3) James Robert pobyns, Cornelia Gates Dobyns, John J. Swint, Archbishop of Wheeling, etc., John W. Nash, Mary Virginia J. Nash, for vacation and closing that certain strip or parcel of land 20 feet in width and l4lGO feet in .length,. beginning on the west side of Washington Avenue and running to a point on or near Prospect Avenue, and more fully set out in said petition. and, WHEREAS,. it appears that proper notice ~s required by statute has been posted in at least three places in the Town, including the front door of ;the Courthouse; at least five (5) days has expired since the said posting; and, WHEREAS, said petitioners have asked that the Council appoint the necessary viewers and take other steps to properly determine this matter. NOW, THEREFORE, BE IT RESOLVED, that: 'i-'~~~ Council mina. contd. Dec. 5, 1961 (1) .The applications be received and filed. (2) Viewers be appointed to view the streets, alleys or easements as wet out and described in said petitions, as follows: R. J. Glenn, W. Marvin Board, G. C. Hall, and E. C. Grigsby to act as an alternate. (3) Such viewers meet and report in writing whether in RESOLUTION their opinion any, and if any, what, inconvenience would result from the discontinuance, sacation or abandonment of any of the alleys, streets or easements CONTINUED as requested in any of the said petitions. (!t) Upon receiving the said report from the viewers, that the Town Manager give written notice to all land owners affected by any of the said changes along the alleys, streets or easements to be altered or vacated, that the Town may discontinue much streets, alleys or easements, and, further, that said Town Manager give public notice by publication of same in the Southwest Times, a local newspaper, once a week for two con- secutive weeks, and that said notice describe the said parcels of land uncer consideration and set outtherein that the Town may discontinue or alter said streets or alleys, and that the 16th day of January, 1962, be fixed as a date upon which the said Council will hold a public hearing upon said matters pending before it, and that all persons interested may be heard either for or against atiy or all of said petitions under consideration. (5) That the said Town Manager and Attorney for said Town do any and all. other things .necessary for a proper determination of this matter. It was moved, seconded and carried that the annual Christmas party for Town employes be held on December 21st. Councilman Aust moved that a letter be written to' THIN MGR. & the Town Manager and the Town Attorney work together on the proposed new TOWN ATTY. TO DRAFT ORD. ordinances having to do with regulations relative to water accounts, PERTAINING TO WATER ACCOUNTS and the parking of gasoline tank trucks within the corporate limits. AND THE PARKING OF GASOLINE This motion was seconded by Councilman Aust, and carried unanimously. TRUCKS WITHIN CORPORATE LIMITS Councilman Nuckols stated that regarding YMCAs recent request of Council to adopt an ordinance restricting all drives within the corporate limits to be incorporated in the Community Chest drive, he MID-WESTERN had recently read in the advanced sheets of Printice-Hall, where some STATE RULED SGAINST TYPE mid-western state court had ruled against the type of ordinance OF ORD. REQUESTED BY YMCA FOR contemplated by the YMCA, and it was his opinion that Council could ONE_PACKAGE DRIVE UNDER not regulate these drives. No action was taken by Council. Town Manager Noland advised that on the day of the meeti Mr. Hill of Jefferson Mills had telephoned him complaining of the fallout from the Paul Knitting Mills which Mr. Hill alleges is 1 MR. HILL OF allowing fly ash to spread over the area, thus increasing operating JEFFERSON COMPLAINS costs of nearby Jefferson Mi11s. No action was taken.
