There were present: Vice-Mayor S. G. Frye, presiding.. Councilmen: Andrew L, Graham,.J. L. Congrove, William.A. House Arthur L. Meadows, Mason A. Vaughan, Raymond F. Ratcliff, Clen K. Aust Also present: Town Manager: J. E. Marshall Clerk: Gladys R. Dalton Town Attorney: Garnett S. Moore Visitors: Reporters from WPUV & WBLB Radio Stations, and the Southwest Times C. V, Jackson Delegation from Dora Highway Community The invocation was given by Councilman Graham. The minutes of the regular meeting of September 25th were approved as recorded. Vice-Mayor Frye welcomed the visitors, and stated Council would be glad to hear the public at that time. As President of the New River Valley Airport Commission, (JACKSON) REQ. FOR FUNDS FOR PURCHASE OF INSTRUMENT LANDING SYSTEM AT NRVAIRPORT Mr. C. V, Jackson appeared before Council on behalf of the Comm- ission to solicit funds for the purchase of an Instrument Landing System for the New River Valley Airport. Mr. Jackson stated the total cost of the equipment was $84,000.00 of which amount the Federal Aviation Agency would pay 75%, and it would then be up to the area governing bodies to pledge the remaining $21,000. The Town Council was asked to pledge 22.9% ($4,809.00) as its share. Mr. Jackson advised the Council it could appropriate the money in its 1974 budget, but that the Airport Commission had to indicate the money was pledged, or in sight to be able to close the deal. He stated the City of Radford had already made their commitment. Councilman Vaughan moved that the Council pledge itself for an amount not to exceed $5,000.00, and that the Finance Committee bring back a recommendation as to how it will be paid . The motion was seconded by Councilman Ratcliff, and carried. ti ':t N 1 f.~ ~~~Q. o y October 2, 1973 Several Dora Highway citizens appeared before Council relative to the dredging of Peak Creek in an effort to control the flooding situatiox-. These persons also asked about the flood insurance program and were advised that Council had requested Mr. Louis Lombardi of the State Water PEAK CREEK Control Board to furnish to the Town in writing inf ormation on the flood FLOODING insurance program. After further discussion of the feasibility of AND FLOOD INSURANCEdredging the creek and why it could not be accomplished by the Army Corps, Councilman Meadows moved that the matter be referred to the recently appointed Citizens Committee on Feak Creek Flooding. The motion was seconded by Councilman Aust, and carried. Councilman Graham reported the Utilities Committee had met and LARGER discussed several subjects: that a larger pump had been installed on PUMP INSTALLED ON PEAK peak Creek as well as another 12" line at the Filter Piant to be installed CREEK & WATER RATE by the Public Works Department; STUDY that a later discussion would take place on WITHHELD the report requested of Wiley and Wilson relative to the water require- FOR TIME BEING ments of the Town. Mr. Graham reported that it was the recommendation of the Committee, and so moved, that the adoption of the proposed ordinannce on water rates for multi-family units be withheld for the time being, bu{t that Town Manager Marshall use the contents of the proposed ordinance as a guideline for any new construction for multi-family units. The motion was seconded by Councilman Ratcliff, and carried. Councilman Ratcliff moved that a copy be filed with the Clerk in order that any- one can see it. The motion was seconded by Councilman Graham, and carried. A proposed resolution naming and updating the membership of the NAMING OF Recreation Commission was read by Town Attorney Moore and tabled until ; NEW MEMBERS TO REC. further contacts could be made with those serving on the Commission, COMMISSION TABLED and the resolution put in final form by the Town Attorney. On motion of Councilman Aust, seconded by Councilman Graham, and carried, the following papers were presented by Town Attorney Moore and filed with the Clerk of Council: Petition filed in the PETITION Circuit Court of Pulaski County, Virginia, in the matter of an F ILED IN CIRCUIT election to determine whether the qualified voters of the Town COURT RE: REFERENDUM shall approve the issuance of bonds to finance the improvements of FOR STREET IMPROVEMENTS the town's streets, and certified order entered by the Court calling for the election to be held on November 27, 1973. Said documents to be spread on the minutes, as follows: IN THE CIRCUIT COURT OF PULASKI COUNTY, VIRGINIA. IN THE MATTER OF AN ELECTION ZO DETERMINE WHETHER THE. PETITION PETITION 7.0 THE HONORABLE JUDGE OF SAID COURT: The Town of Pulaski would respectfully show unto the Court the fallowing: (1) That the Council of the Town of Pulaski adopted an ordinance on the 4th day of September, 1973, a certified copy thereof being filed herewith as Exhibit "A", determining it to be expedient for the Town to borrow the sum of $750,000 and issue bonds of said Town of the aggregate principal amount of $75,000 to finance the cost of improving the streets, in- cluding curbs and gutters, maintained by the Town by the re- construction, widening, paving and re-surfacing thereof. (2) That the ordinance did further request this Court to enter an order directing proper election officers of the County and the Town of Pulaski to take all steps necessary to submit to the qualified voters of said Town the question of whether said bonds shall be issued, and for officers of the County of Pulaski and the Tawn of Pulaski to do all things necessary to hold an election as prescribed by the statutes of the Commonwealth of Virginia for holding such special elections. WHEREFO RE the Town would move said Court to allow it to file this its petition, together with certified copy of the October 2, 1973 ordinance, and that said Court would order and direct the holding of an election as requested and moved in the ordinance attached hereto, and for such other and further relief as may be deemed wise and necessary. 1 Signed; GARNETT S. William Arthur, Judge of said Circuit Court, providing for the submission to the qualified voters of the Town of Pulaski at an election to be held on November 27, 1973, of the question, whether the Town of Pulaski should contract debt and issue bonds of the aggre- gate principal amount of $750,000 to finance improvements to BOND ISSUE the streets, including curbs and gutter, maintained by the Town . FOR STREET 2. I have compared the attached copy of said order with IMPROVEMENTS the order as made and said copy is a true copy of said order and of the whole thereof. The Town of Pulaski, a municipal corporation of the Common- wealth of Virginia, having appeared by its Attorney and having presented to the Court a certified copy of an ordinance determining it to be expedient for said Town to borrow the sum of $750,000 and issue bonds of said Town of the aggregate principal amount of $750,+300 to finance the cost of improving streets, including curbs and gutters, maintained by the Town by the reconstruction, widening, paving and re-surfacing thereof, and requesting that an order be entered directing the proper election officers to take such steps and to prepare such means as may be necessary to submit to the qualified voters of said Town the question of whether said bonds shall be issued, And it appearing to the Court that said ordinance was duly adopted by the Town Council of said Town on September 4, 1973, by the recorded affirmative vote of a majority of all-the members elected to such Council, and that this Court is the Ci7cuit Court which has jurisdiction over said Town; n r-- ~L`~~~) October 2, 1973 IT IS HEREBY ORDERED AND DIRECTED that the Electoral Board of Pulaski County and the proper election officers of the Town of Pulaski shall take such steps and prepare such means as may be necessary to submit to the qualified voters of .said Town at a Special Ele ction to be held in said Town on November 27, 1973, the question whether the Town of Pulaski shall issue in accordance with said ordinance its general obligation bonds of the aggre- gate maximum amount of $750,000 to finance the cost of improving streets, including curbs and gutters, maintained by the Town by the reconstruction, widening, paving and re-surfacing thereof, such bonds to bear interest at a rate or rates which shall not exceed the rate permitted by law, provided any such rate or rates shall not exceed 6% per annum. Said bonds shall be serial bonds and shall be payable in annual installments in such amounts as may be determined by the Council over a period of 10 years commencing with the date of the bonds. BE IT FURTHER ORDERED AND DIRECTED that the polling place for said election shall be the Pulaski Firehouse on Jefferson Avenue in the Town of Pulaski, and the polls BOND ISSUE for said special election shall be opened at 6:00 o'clock A. M. and shall be closed at 7100 o'clock P. M,, and that in order FOR STREET to give due publicity to such election, the Clerk of the Circuit Court shall cause a certified copy of this order IMPROVEMENTS to be published in the Southwest Times, which is a newspaper circulating in said Town, at Least twenty days prior to the date of said election. BE IT FURTHER ORDERED AND DIRECTED that the Electoral Board of Pulaski County is hereby directed to cause appropriate ballots to be printed for use in voting on said question at said special election, the,cost of such ballots to be for the account of the Town of Pulaski. The ballots, in the form hereinaf ter set f oath, shall be delivered to the Judges of Election within five days preceding the date of election in the same manner as ballots are delivered to the Judges of Election in a regular election. Graham, Clerk by Maxine Keister, D, C. ~I 1 1 October 2, 1973 ~3 °k ~ ~h• Town Manager Marshall reported that at the last meeting of Council several citizens from the west end area of Town appeared and registered a very adamant complaint about the noise and disturbance they were receiving from the vicinity of the Chi-Cite Club as well as the surrounding area, and that he had talked with the Chief of Police REPORT ON about this complaintand the Chief had prepared instructions for all COMPLAINT officers on this, as well as had inf ormed the operators of these OF NOISE complaints, Mr. Marshall further reported that a time of 12:30 FROM DANCE for the closing of the dance operation had been established on weekends, HALL and 12 midyaight on a week day when permits are granted. Town Manager Marshall reported that Mr. Jerry Crass of VPI, J. CROSS who is a specialist in the area of fish and wildlife, had been contactled VPI WILL COME TO relative to the complaints received about the starlings in the east erld PULASKI & GET RID area and that Mr. Cross and his personnel would come to Pulaski as sodn OF STARLINGS as possible to assist the Town in getting rid of the birds. At the suggestion of Town Manager Marshall a request for an AGREEMENT agreement between the Town of Pulaski and the Appalachian Power Company BET . TOWN AND for the construction of a new line for said Company across a part of APCO. RE: CONSTR.OF the property owned by the Town at the Warden Springs pumping station NEW LINE ACROSS was turned over to the Town Attorney and Town Manager on motion of WARDEN SPG. PROPERTY Councilman Vaughan, seconded by Councilman Meadows, and carried. Councilman Graham refrained from voting.
