There were present: Mayor C. Robert Edens, presiding. Councilmen: S. G.Frye, J. L. Congrove, William A. House, Glen K. Aust, Arthur L. Mgadows, Mason A. Vaughan, Andrew L. Graham, Raymond F. The minutes of the Council meeting of May 6th were approved as recorded. Attorney T. J. McCarthy, Jr. appeared bef ore Council relative to two matters, the first being a request on behalf of his client, Mrs. Anne English, that a portion of a street, unopened, in the English Forest section, be closed. Mr. McCarthy advised that the proper legal Notice fpr such request h,ad been:,posted:,-and requested Council. to: consider the matter, or suggested that it ~be referred to.the proper.Committee for action. Notice of Application was filed to be made a part of the minutes. May 21, 1974 The second matter presented by Mr. McCarthy was in reference to a business license for his client,. C & S Hosiery Company, a new concern in the Town, which sells hosiery products. Mr. McCarthy advised that C & S Hosiery Company is neither a full scale manufacturer, or producer of hosiery, nor wholesaler, and because of REQUEST FOR A BUSINESS this unique status, it appears that the Town License Ordinance does ndt LICENSE REF: TO ORDINANCE cover this business. He asked the Council to consider the matter and COMMITTEE determine the proper category under the present License Tax Ordinance) Councilman Frye moved that the matter be referred to the Ordinance Committee, Town Attorney, Town Treasurer and Town Manager for consid'r= ation and report to the'Council. The motion was seconded by Councilmaln Graham, and carried. Milton Clark .inquired about the Highland Terrace sewer project, and was advised that a report iuould be made on this later in the meeting. Mr. Clark brought to the attention of Council the conditions existing..in frbrat_ :©f_ the Churdr on Johnson Street, and the property adjoining Barrett!s.as well as the. parking .lot~~across from Barrett's. He INQUIRY RE: stated. these areas neederi,attention,,,and cleaning up - there are lots PARKING LOT ON RANDOLPH of wdne bottles lying around as well.. as the gr-ass needs cutting. There AVE. was some discussion relative to the parking lot as well as the propert~ adjoining Barrett's being private property, and what could be done about it. Councilman House recommended that that the Town Manager look into this and if it is the property of the Town, that it be cleaned up, and if it is private property "Lots of Luck". REQUEST FOR HELP Mr. Clark asked for Police help in directing traffic during DURING FUNERALS REF: TO POLICE funerals, and on motion of Councilman Ratcliff, seconded by Councilman DEPARTMENT Graham, and carried, the matter was turned over to the Police Departmek~t and Town Manager. Councilman Meadows stated he had no report, but inquired as to what has been done about summer mowing of vacant lots. Town Manager INQUIRY RE: Marshakl stated this matter is being taken care of by personnel in thee; MOWING OF PROPERTY Police Department, who is in contact with someone who has the proper equipment to do this type of work. Mr. Marshall also stated the Town is behind at this time in mowing of town-owned property, but hoped to get some help from the Green Thumbers on this. 555g May 21, 1974. Councilman House stated the street blacktopping is moving along REPORT RE STREET PAVING PROJECT well, there having been some comments made relative to a build-up of the streets, on narrow streets especially. Mr. House stated that he and the Town ,Manager had recntly made a survey of this and the situation would soon be worked out with the help of the Engineers. Councilman Ratcliff advised that at the last Council meeting MONIES FOR THE HIGHLAND TERRACE SEWER FUNDED FROM THE SEWER FUND a group of citizens frAm the Highland Terrace area attended the meeting and were advised- that the sanitary sewer project for that area was in the budget for 1974-75, and they are now .wondering if Council can get it started bef ore the fiscal year. Mr. Ratcliff also reported the matter was referred to the Utilities Committee and Finance Committee, and that the Committees have met, and moved that the project be started as soon as possible and that whatever money is needed to fund it until July first, be taken from the Sewer Fund. Congrove - aye During the discussion on the above motion, there was mentioned the fact that at least one, or maybe two houses in the Highland Terrace section would not be able to connect to the new sanitary SOME RESIDENTS sewer line inasmuch as their prop_rty will be below the sewer line, IN THIS AREA MAY NOT BE and it was felt that these owners shoul., be advised of this ABLE TO HOOK ON TO THE situation. It was also brought out that deposits cannot be SEWER accepted by the Town for these connections. Councilman House moved that the Sewer Committee follow up on the possibility that some of the residents may not be able t o hook on to the new sewer line. The motion was seconded by Councilman Graham, and carried. Town Attorney Moore reported that in reply to an inquiry from Town Manager Marshall regarding the new Constitution having to do with Council voting on various matters and the method by which the [l ~1 C May 21, 1974 vote is recorded, in Article VI, Section 7, it states - "on final ROLL CALL VOTING voting on any ordinance or resolution, the name of each member and USED FOR COUNCILMEN how he voted should be recorded". Mr. Moore advised the best and safest practice would be a roll call vote of the Council on all final actions. Mr. Moore stated he would make a further study on the question as to whether Council should go back and consider a list of all final actions. Mr. Moore reported that each member of Council had received a REPORT RE: copy of the amortization schedule pertaining to the bond issue bonds THE BOND ISSUE and it would be necessary that an executive session be called for a brief discussion of this matter, and .other legal matters. Town Attorney Moore stated that several years ago Mr. John Warf of Valley Road had appeared bef ore Council several times with regards to the right-of-way from Valley Road to Route 11; that he had appeared for Mr. Warf before the Board of Supervisors, and it was finally determined that some U. S. Army Engineer Company would attempt to grade the road, but a right-of-way was necessary across. the Town owned property. He further stated the Town had said that INQUIRY RE: if a plan is made, the Town would go along with the right-of-way, and RIGHT-OF-WAY FROM VALLEY RD. if it was the Council's desire he would go ahead with the necessary TO ROUTE 11 REF: TO LAND easements. Councilman House suggested that inasmuch as the land lies & BUILDINGS COMMITTEE outside the corporate limits it be made clear that it would not be a maf~ttenance or police problem of the Town. Town Manager Marshall pointed out potential .problems involved on the part of the Town becausle of .the 1_ocation .of they landfill .and r-the. possibility of having to re- locate the,-landfill to comply with-..State regulations. Councilman Graham moved that the Land ..and.;Bu~ildings;Committee review this matter with the Town_Manager and bring back a recommendation to the Council. The motion was seconded by Councilman Meadows, and carried. Council was advised that the U. S. ?nvironmental Protection Agency (EPA) is now in the process of reviewing the Town's application for a. Grant from EPA for the Infiltration/Inflow Study. However, it now appears a Resolution adopted by the Council authorizing the Town Manager 5560 May 21, 1974 to submit the application is not sufficient, but an ordinance is necessary authorizing the Town Manager to execute any and all documents pertaining thereto, together with legal authority set out in the resolution that the Town is authorized to conduct the project as well as to the method of financing. Such a Resolution was presented by the Town Attorney, and on motion of Councilman House, seconded by Councilman Graham, and carried on the following recorded vote, the following Resolution was RESOLUTION RE: adopted: AUTHORIZING TOWN MANAGER Glen K. Vaughan - aye RESOLUTION AUTHaRIZING..TOWN MANAGER TO EXECUTE AND FILE APPLICATION FOR CONSTRUCTION GRANT, PURSUANT TO PUBLIC LAW 92-500, AND TO EXECUTE ANY AND ALL DOCUMENTS PERTAINING THERETO BE IT RESOLVED by the Council of the Town of Pulaski, Virginia, meeting in regular session on this 21st day of May, 1974, that: James E. Marshall, Town Manager, is hereby authorized to execute and file an application on behalf of the Town of Pulaski, Vir ginia; with the Virginia State Water Control Board and the U. S. Environmental Protection Agency for grants to-aid in financing Wastewater Treatment Works Construction under provisions of Public Law 92-500, and is authorized to execute any and all documents pertain- ing thereto.. Councilman Graham moved that the Town Manager be authorized to advise the Virginia State Water Control Board, and the U. S. TOWN MANAGER Environmental Protection Agency-that there would be no election AUTHORIZED TO CONTACT BOARDS required to begin the planning Grant, and, theref ore, none was THAT THERE WOULD BE anticipated at this stage. Congrove - aye TOWN OFFICIALS Town Attorney Moore reported that with inf ormation available TO BEGIN OFFICE SEPT. 1 to him, and to the best of his knowledge, the new Town officials would take office September 1st. Mr. Moore further reported that Attorney General Andrew Miller's opinion on the matter was May 21, 1974 TOWN ATTORNEY TO PREPARE PAPERS STATING TOWN OFFICIALS WOULD BEGIN OFFICE ON JULY 1 that the state law says July 1 to be the ,date for the new term to begin, unless otherwise provided for or not withstanding local ordinances or charters, and the Town's charter states that newly 561 elected officials shall take office on September first, following the election. There followed some discussion as to whether the Council would be forced to make a change in its. charter to this effect, and the majority of Councilmen felt that the change should be made. ~~ ~~ Councilman Graham moved that the Town Attorney be directed to draw up the necessary legal papers for such a change to take place in the year 1976 election. Congrove - aye Town Manager Marshall reported that he had been unable to con tacit REPORT ON TENNIS COURTS the contractor relative to completing the tennis courts in Town, but had been advised by his office that the materials needed to complete these courts are located in Baltimore, Maryland and would be shipped to Pulaski next week. Mr. Marshall reported work should be started on these courts by the first week in June, and he would try again to get in touch with the contractor. Town Manager Marshall reported that in answer to an inquiry of Congressman Wampler's office as to whether funds from the Farmer's FUNDS FOR WATER EXpANSIONHome Administration would be available for the expansion of the Town's FROM FAF~IERS HOME ADMIN. water facilities, indicated that funds would not be available through NO AVAILABLE that agency because of a statutory provision limiting such to 10,000 population, and, of course, the population for Pulaski is more than 10,000. Toen Manager Marshall reported that Mr. Ralph B. Rutherf ord had REPLACEMENT IN BICENTENNIAhresigned from the Town of Pulaski Bicentennial Committee and suggested' COMM. May 21, 1974 Town Manager Marshall reported that by letter dated May 14, 1974 the Highway Department advised that it would be necessary to revise thH plans for Memorial Drive at the property of Claremont Corporation on REPORT Monte Vista Drive and Bob White Boulevard because there has been FROM HIGHWAY considerable grading and filling by said Corporation. Mr. Marshall DEPT. RE; MEMORIAL also reported that the letter indicated it would be necessary to use DRIVE whatever diversion ditches or facilities Claremont Corporation provided, and they further indicated that the Highway Department would not acqui~te an easement for the ditch and would not share any responsibility for any damages which might-occur because of the change in the natural dra~n- age way. It was the opinion of the Town Manager that in view of this having been private property and no right-of-way acquired from Claremont Corporation, the Town could not have restricted Claremont Corporation from using any of the property owned by them in the general area to de any of the grading or filling which they have done. There was some discussion of the situation, and Councilman House moved that the Town should stay out of this situation and that the Highway Department be so advised. The motion was seconded by Councilman Meadows. More discussion followed, and a substitute motion was made by STREET COMM. TO STUDY Councilman Graham that Town Attorney Moore and the Street Committee THIS SITUATION study this situation and bring back a report to Council. Congrove - aye TROY JACKSON T man Manager Marshall reported that Mr. Troy Jackson was APPOINTED BUILDING appointed Building Inspector for the Town May 20, 1974, and would be INSPECTOR working under the Engineering Department. M: Councilman Vaughan moved that Council go into executive session to discuss a legal and personnel matter. The motion was seconded by Councilman Graham, and carried. At 9:35 P M. Council returned to regular session, and Mayor Edens asked if there was further business to come bef ore the Council.
