There were present: Mayor C. Robert Edens, presiding. Councilmen: Mason A. Vaughan, Andrew L. Graham, S. G. Frye, William A. House, Raymond F. Ratcliff, J. L. Congrove Absent: Councilmen Aust and Meadaws Also present: Town Manager: J. E. Marshall Clerk: Gladys R. Dalton Town Attorney: Garnett S. Moore Visitors: Members of the Press and Radio Stations The Invocation was given by Councilman House. a WAIVER OF NOTICE OF SPECIAL MEETING We, the undersigned, duly elected members of the Council of the Town of Pulaski, hereby waive notice of a Special Meeting of said Council at 1:00 P. M. on the 23rd day of May,. 1974, called by Mayor C. Robert an Ordinance Edens for the purpose of considering the adoption of ~~escrhzt-~cm for short-term borrowing for the Street Up-grading Program; and any other items that may legally be broug~at before the Council. WITNESS our` signatures this 23rd day of May, 1974. ~VCJ ASSESSMENT OF TAXABLE PROPERTY 8fay 23, 1974 Mayor Edens advised that the purpose of the special meeting was to consider the adoption of an ordinance for short-term borrowing for the street up-grading program, and any other items that may legally come bef ore the Council. Town Attorney Moore presented to Council a certificate of Town Treasurer J. L. Patterson indicating the assessed valuat- ion of the taxable property of the Town of Pulaski, and the outstanding bonds or interest-bearing obligations of the Town, as of the 21st day of May, 1974, and said certificate was filed and made a part of said minutes, as follows: TO THE COUNCIL 'OF THE TOWN OF PULASKI, VIRGINIA: I, J. Lloyd Patterson, the undersigned, Treasurer of the Town of Pulaski, Virginia, do certify to the Council as follows: The assessed valuation of the Taxable Property in the Town of Pulaski, subject,to taxation as shown by the last preceding assessment for taxes is as follows: Assessment on Real Estate Assessment on Public Utility Property Assessment on Personal Property Assessment on Personal Froperty (Machinery and Tools) TOTAL DF ALL ASSESSED PROPERTY $ 9,241,010.00 1,401,990.00 1,515,750.00 1,363,180.00 $13,521,930.00 That the outstanding bonds or interest-bearing obliga- tions for any purpose whatsoever of the Town of Pulaski, Virginia, on March 7, 1974, were as follows: Sewer Bonds (7/1/58) (Revenue) $ 627,000.00 Water Bonds (7/1/58) (Revenue) 457,000.00 Total $ 1,084,000.00 The of oresaid inf ormation concerning evaluation of property is that which was submitted to the Town of Pulaski, Virginia, by the Commissioner of Revenue of the County of Pulaski, Virginia. LLiOYD PATTERS'ON, Treasurer Town of Pulaski, Virginia Town Attorney Moore presented and read to Council an Ordinance authorizing the issuance of negotiable notes of the Town of Pulaski, in the total amount of $200,000.00, in anticipation of the issuance and sale of bonds for the street paving project.' Councilman Vaughan moved the adoption of the ordinance, which motion was seconded by Councilman Frye, and carried on the following May 23, 1974 recorded vote: Mason A. Vaughan - aye Andrew L. Congrove - AN ORDINANCE AUTHORIZING THE ISSUANCE"OF NEGOTIABLE NOTES OF THE TOWN OF PULASKI, VIRGINIA, IN THE TOTAL AMOUNT OF $200,000.00, IN ANTICIPATION OF THE ISSUANCE AND SALE OF BONDS FDR THE STREET PAVING PROJECT WHEREAS, the Town of Pulaski, Virginia, needs funds to pay Pendleton Construction Corporation on its paving contract with the Town in anticipation of the issuance and sale of bonds heretof ore approved by Referendum on the 27th day of November, 1973, for payment of said ORDINANCE project; and AUTHORIZING THE ISSUANCE OF WHEREAS, the Virginia National Bank and the Bank of NEGOTIABLE Virginia have agreed to loan the Town of Pulaski, Virginia, NOTES in anticipation of the issuance and sale of bonds, a sum not to exceed $750,000.00, at an interest rate of five per cent (57) per annum, the Virginia National Bank to Loan $375,000.00 thereof, and the Bank of Virginia to loan $375,000.00 thereof; with interest on said loans payable semi-annually; and 569 absent'. aye aye aye WHEREAS, the Town of Pulaski, Virginia, needs to borrow for the present the sum of $200,000.00 in order to provide funds for payment now due on the paving contract, or which will become due in the immediate future; and WHEREAS, the Treasurer of the Town of Pulaski has filed with Council a certificate showing the total assessed value of all taxable property in the Town and the indebtedness of the Town of Pulaski to be as follows Assessment on Real Estate $ 9,241,010.00 Assessment on Public Utility Property 1,401,990.00 Assessment on Personal Property 1,515,750.00 Assessment on Personal Property . (Machinery and Tools) 1,363,180.00 TOTAL OF ALL ASSESSED PROPERTY $13,521,930.00 The outstanding bonds or other interest-bearing. obligations for any purpose of the Town of Pulaski, Virginia, on March 7, 1974, were as follows: Sewer Bonds (7/1/58) (Revenue) $ 627,000.00 Water Bonds (7/1/58) (Revenue) 457,000.00 Total $ 1,084,000.00 all of which are self-liquidating; a copy of said certificate of the Treasurer is incorporated herein and made a part of this ordinance; and WHEREAS, the present issuance of the negotiable notes totaling $200,000.00 together with all other existing indebted- ness for any purpose, will not exceed eighteen per cent (18q,) of the assessed valuation of the real estate in the Town of Pulaski subject to taxation as shown by the last preceding assessment for taxes, and the indebtedness of the Town of Pulaski will theref ore not exceed .the limitation provided in Article VII, Section 10 of the Constitution of Virginia, or the statutes of the Commonwealth of Virginia; and 55`0 May 23, 1974 WHEREAS, this loan and this ordinance are made under the authority of and in compliance with the provisions of .Article VII, Section l0 of the, Constitution of Virginia, Section 15.1-223 of the Code of Virginia of 1950, as amended, and the Charter of the Town of Pulaski, Virginia. NOW, THEREFORE, BE IT ORDAINED by the Council of the Town of Pulaski, Virginia, that: (1) The Town of Pulaski, Virginia, borrow a sum of money not to exceed, $200;000.00 and duly issue its negotiable promissory notes in evidence thereof, one note in the amount of $100,000.00 payable to the order of Virginia National Bank, at said Bank in Pulaski, Virginia, bearing interest from date said ,note is executed at the rate of five (5%) per cent per annum, said interest to be paid semi-annually, the principal of said not e: to be,paid within twenty-f our (24) months from the date- of said note; with right of anticipation reserved; and one note in the amount of $100,000.00 payable to the order of Bank of Virginia, at said Bank in Pulaski, Virginia, bearing interest from date said note is executed at the rate of five (5%) per cent per annum, said interest to be paid semi-annually, and the principal of said note to be paid within twenty-f our d24) months from the date thereof, with right of anticipation reserved; said notes to be issued under authority of and in full compliance with the Constitution,the statutes of the Commonwealth-of ~Virginia, and the Charter of the Town of Pulaski, Virginia. (2) On behalf of the Town, the notes shall be signed by the Mayor and Treasurer of said Town .and attested by the Clerk, with the corporate seal of the Town of Pulaski, Vir ginia, affixed thereto. (3) The full faith, c~'edit, and resources of the said-Town of Pulaski, Virginia, and of this Council as such, be, and the same are hereby, irrevocably pledged for the punctual payment of the interest and principal of said notes at or prior to maturity. Town Attorney Moore also reported that at the May 21st meeting, Mr. T. J. McCarthy, Jr. had presented a petition on behalf of his client, Mrs. Anne English, together with Notice of Publication, and asked that a certain portion of English Forest Road lying within RESOLUTION the Town of Pulaski, Virginia, and bounded on either side by NAMING VIEWERS RE; THE PORTION Property owned by the Petitioner, be closed. Mr. Moore presented OF ENGLISH FOREST ROAD a Resolution to Council for its consideration, and in said Resolution Council named Dan C. Bell, Edward L. Barr, and W. Marvin Board as Viewers, with Curtis C. Jordan, as Alternate, and set the 18th day of June, 1974 for a public hearing in this matter. Councilman Vaughan moved the adoption of said Resolution, which motion was seconded by Councilman Congrove, and carried. i~ L~ May 23, 1974 RESOLUTION BE IT RESOLVED BY THE COUNCIL OF THE TOWN OF PULASKI, VIRGINIA, meeting in Special Session on the 23rd day of May, L974, as follows: 5~~i WHEREAS, a petition and application to close that certain portion of English Forest. Road lying within the Town of Pulaski, Virginia, and bounded on either side by. property owned by Petitioner (Anne A. English) which street is described as follows: That portion of English Forest Road as shown RESOLUTION on a plat entitled "Plat cf English Forest Subdivision" NAMING THE dated October 20, 1953, and recorded in the Pulaski VIEWERS RE: County Circuit Court Clerk's Dffice in Plat Book 2, THE PORTION OF page 132. BEGINNING at the. northeastern corner of Lot ENGLISH FOREST 3 of said subdivision and running South 25 degs. 30' East ROAD 50 .feet to the northwestern corner of Lot 4 in said subdivision; thence South 64 degs. 52' East 107 feet to a point at the west boundary of,said Lot 4; thence with a curve radius of which is 20 feet, the tangent of which is 20.2 feet to the point in the southern boundary of said Lot 4, which point is 46 feet from the southern corner of the property owned by Harry Loftus; thence South 24degs. ~~ 32' East 70,feet., more or less, to,a point in the eastern boundary of'Lot 2. in said subdivision; thence with the eastern boundary of Lot 2, 25 feet, more or less, to a point, the southern boundary of Lot 3 in said subdivision; thence with the eastern boundary of Lot 3, North 64 degs.. 52' East 100 feet to the point of EEGINNING. WHEREAS, it appears that proper notice as required by statute has been posted'in at least two public places in the Town of Pulaski, and also at the Courthouse of the Circuit Court. of Pulaski County, Virginia, on the 26th day of April, 1974, and at least ten (10) days have expired since the said posting; and WHEREAS, the council of said Town, upon viewing the petition filed herein, finds it to be in proper order and directs it to be received and filed, and further directs that the viewers hereinafter appointed, view the described portion of English Forest Road and that alI other steps necessary be followed to bring this matter properly bef ore the Council for its final consideration; NOW, THEREFORE, BE IT RESOLVED, that: (1) The application be received and filed. (2) Viewers be appointed as follows: 1. Dan C. Bell 2. Edward L. Barr 3. W. Marvin Board Alternate: 1. Curtis C. Jordan (3) Such viewers shall meet and report in writing whether in their opinion any, and if any, what inconvenience would result from the vacation and closing of the portion of the street as requested in the said petition. ~~~~ May 23, 1974 (4) That the Clerk of Council give public notice by publication of same in The Southwest Times, a local newspaper, once a week for two consecutive weeks, and that said notice describe the said portion of street and set out therein that the Town may vacate and close the same, and that on the 18th day of June, 1974, at the Town's Council regular meeting be fixed as a date upon which the said Council will hold a public hearing upon said matter pending before it, and that all persons interested may be heard either for or against any or all of said petition under consideration. (5) That the Mayor and Attorney for said Town do any and all other things necessary for the proper determination of this matter. There being no further business of Council, Councilman Vaughan moved that the meeting be adjourned at 1:15 P. M. The motion was seconded by Councilman Graham, and carried.
