Minutes of a special meeting of the Pulaski Town Council held
June 21, 1974 at 4:00 P. ,M. in the Council Chambers in the Municipal
Building.

WAIVER OF Nt~TIGE OF SPECIAL MEETING
We, the undersigned, duly elected members of the Council of
the Town of Pulaski, Virginia, hereby waive notice of a special meeting
of said Council at 4:00 P. M. on the 21st day of June, 1974,. called by
Mayor C. Robert Edens for the purpose of holding a public hearing on the
budget for the fiscal year ending June 30, 1975, at which time any citize*
of the Town of Pulaski may attend and will be heard regarding the budget;;
and any other items that may legally be brought bef ore the Council.

Mayor Edens stated the special meeting was called to consider
the proposed budget for the fiscal year ending June 30, 1975, at which
time Council would hear any citizen of the Town of Pulaski regarding
the budget; and to consider any other items that may legally be
brought before the Council.
REQUEST FROM Councilman Graham, as co-Chairman of the Utilities Committee,
THE UTILITIES reported the Committee had met recently, but it was the feeling of
the Committee that additional information is needed by the Town
COMMITTEE TO before a report can be made to Council, and asked Council for
EMPLOY A authority to employ a consultant., Mr. Graham moved that the matter
CONSULTANT be put on the agenda for immediate discussion and action. The motion

SYSTEM
Councilman Graham moved the Utilities Committee be allowed to
contact, through the Town Manager, a consultant to obtain additional
information pertaining to the Town's Water System. The motion was
seconded by Counci]_maxi Frye, and carried.
Town Manager Marshall reported that an Ordinance had been
prepared amending and re-enacting Section 13-23, Article 4, Rates
and Charges for Garbage Services, and an Ordinance to provide for
the establishment of a Grievance Procedure for the employees of the
Town of Pulaski, and asked they be placed on the agenda for Council's
consideration. Councilman. Vaughan moved that these be placed on the
agenda, which motion was seconded by Councilman Graham, and carried.,
Town Manager Marshall read the ordinance relative to the rates and
charges for garbage services, and after consideration of same,
Councilman Vaughan moved, seconded by Councilman Congrove, and carried
on the following recorded vote; the following Ordinance was adopted:

AMEND RATES & AS AMENDED, SECTION 13-23, ARTICLE
CHARGES FOR 4, RATES AND CHARGES FOR GARBAGE
GARBAGE SERVICES, OF CHAPTER 13 OF THE
SERVICES PULASKI TOWN CODE
BE IT ORDAINED BY THE COUNCIL OF THE TOWN OF PULASKI,
VIRGINIA, as follows:
SEC. 13-23. SCHEDULES.
The Town, for services rendered by it in providing for municipal
collection and disposal of garbage and rubbish under this chapter,
does hereby provide for assessing fees, collecting and enforcing
the provisions of this article and does more particularly
establish those certain charges and fees contained in Schedules
A and B, as follows:

Town Manager Marshall reported that Mayor Edens had appointed a
special committee to work with the Town Manager in developing a Grievande
Procedure for the employees of the Town of Pulaski, and that Town

AN ORDINANCE TO PROVIDE .FOR THE
ESTABLISHMENT OF A GRIEVANCE
PROCEDURE FOR THE EMPLOYEES OF
THE TOWN OF PULASKI, VIRGINIA,
AND TO AUTHORIZE THE TOWN
MANAGER TO PROMULGATE AND ISSUE
DETAILED REGULATIONS, RULE5 OF
PROCEDURE, AND PROVIDE FORMS FOR
USE OF EMPLOYEES
BE IT ORDAINED BY the Council of the Town of Pulaski,
Virginia, that:
(1) Pursuant to 15.1-7.1 of the Code of Virginia of
1950, as amended, and in order to afford an immediate and
.fair method for the resolution of dispute which may arise
between the Town of Pulaski and its employees, there is
hereby established the .Town of Pulaski Grievance Procedure.
(2) A grievance is herein defined to be a complaint or
dispute of an employee or employees regarding the application,
meaning or interpretation of personnel policies or procedures
as they affect the work activity of such employee or employees.
However, any work activity that is. accepted by the employee
as.a condition of employment shall not be grevable.
(3) An employee filing a grievance shall have at every
step the right to present witnesses and evidence to support
his grievance with complete freedon from reprisal. This
procedure shall not confer the right upon anyone to make
slanderous or libelous statements.

(4) The Town Manager is authorized to set up details
of the procedures to be followed, which shall provide the
necessary steps from the initial complaint of employee to
his immediate supervisor to the final determination of an
independent panel, and shall provide the time sequence in
days for each step in.order to provide an employee who has
a grievance an opportunity to be fairly heard, and shall
include the following:
(a) Set out policy statement and information data.
(b) Opportunity to discuss the problem with his
immediate supervisor.
(c) Procedure to reduce grievance to writing,
filed with immediate supervisor, a hearing by supervisor
and Town Manager or his designee, and reply by Town
Manager or his designee.
(d) Selection of an Independent Panel with authority
for final determination of the grievance, together with the
procedure to be used at each step.
(e) Statement of Town's right to do certain things
as long as the rights are not exercised arbitrarily or
capriciously.
(f) Provide necessary forms to be used by the parties
at each step.
ORDINANCE TO
ESTABLISH A (5) The Town Manager shall file at the time this Ordinance
GRIEVANCE is adopted a detailed procedure which shall be attached to

(6) Copies of this Ordinance, Addendum "A" and all subse-
quent addenda shall be made available to the Public during
regular office hours.
(7) This procedure shall be followed by the Town and
employees in all applicable circumstances.
This Ordinance shall become effective upon passage.

COMPLAINT AND GRIEVANCE PROCEDURE
June, 1974
Policy Statement
When an employee of the Town thinks or feels any condition
affecting him or her is unjust, inequitable, a hinderance to
effective operation, or creates a problem, the employee should
use the following procedures for the solution of such problem (s)
without fear of recrimination. An employee filing a grievance
will have the right to follow all the steps of the grievance
procedure with complete freedom from reprisal. This does not
however, confer .the right upon anyone to make slanderous or
libelous statements.
To assure rompt attention, grievance must be submitted
within seven (7~ calendar days of the event prompting the
grievance. The term grievance as set out in this procedure
shall not be interpreted to mean wage negotiations, salaries,
or fringe benefits.

Step I
An employee who has a grievance, will discuss the problem
directly with his immediate supervisor. The grievance need
not be reduced to writing at this step. The supervisor will
respond as quickly as possible, but at least within five (5)
working days.
Step II
If the employee is not satisfied with the Step I decision,
ORDINANCE TO he may file a written grievance with his immediate supervisor

GRIEVANCE PROCEDURffive (5) working days of the Step I response. This statement
FOR THE will be the employee's explanation of what has occurred. The
TOWN OF PULASKI employee's immediate supervisor and Department Head will then
meet with the grievant within two (2) working days of receipt
of the written statement. If more than one level of super-
vision exist .between the grievant and the Department Head, they
may also attend this meeting if so requested by the Department
Head or grievant. The employee at. his request may have another
Town employee accompany him.,
A written reply by the Department Head shall be made to
the grievant within three (3) working days following the
completion of this step.. A copy of the grievant's statement
and the Department Head's response shall be forwarded to the
Town Manager at the same time.
Step III
If the aggrieved is not satisfied with the decision at
Step II, he or she may appeal to the Town Manager within five
(5) working days of the decision rendered at Step II. The
Manager will review the facts of the case and meet with those
involved in Step II. He will:render his. decision within ten
(10) working days.
Step IV
If the Maxiager's response does not resolve the grievance,
the grievant may proceed by requesting a panel hearing.., This
request must be made in writing on forms: to be provided and
must state the reasons for the request.. This request must be
received by the Town Manager within seven (7) working days of
the grievants receipt of a response from Step III., The Town
Manager will supply_ahe aggrieved employee within five (5)
working days with a list of at least ten (10) prospective
panel members to hear-the grievance, none of .whom may have
been_involved in or concerned with an earlier phase of the
grievance. Such prospective panel members shall be selected
by the Town Council and normally will be composed of three (3)
members chosen as follows: One (1) member selected by the
Town Manager or his authorized representative; One (1)
member selected by the grievant, and the remaining member
chosen by the two appointees. _
The .panel has the::responsibility to interpret the
application of appropriate government policies and procedures
in the case. It does not have the prerogative to formulate
or to change policies or procedures.
The panel shall then select its panel chairman, set the
time for the :hearing which shall be held .as soon as practicable,
but no more than ten (10) full working days after the panel
has been selected, and notify the employee. _,_
The grievant may have present at this meeting a representative'
or legal. counsel at his own expense. Copies of the grievance
form shall be sent by the Town Manager to the panel members.

The conduct of the hearing shall be as follows:
1. The panel shall determine the propriety of attendance at
_the hearing of personsnot_havixrg a direct interest in the
hearing.
2. The panel may at the beginning of the hearing ask for
statements from the Town Manager or Department Head
clarifying the issue or issues involved.
3. Exhibits when offered, may be received in evidence by the
panel, and when so received, shall be marked and made
part of the record.
4. The grievant, or their representative, shall then present
their claim, proofs .and witnesses, who shall submit to
questions or other exami.nations.The panel may at its
discretion, vary this procedure but shall afford full
and equal opportunity to all parties and witnesses for
presentation of any material or relevant proofs..
5. The parties may offer evidence and shall produce such
additional evidence as the panel may deem necessary to an
understanding and determination of the dispute. The panel
shall_be the judge. of relevancy and materiality of the

PROCEDURE 6. The majority decision of the panel shall be-final in all

PULASKI 7. Failure to comply with a panel decision or reprisals taken
as a result. of a panel-decision. shall be grievanle.,
The Panel Chairman shall specifically inquire of all parties
whether they have any further proofs to offer or witnesses to
be heard. Upon receiving negative replies, the chairman shall
declare the hearing closed.
The hearings may be reopened by the panel on its own motion
or upon application of a party for good cause shown at any time
before the final decision is made.
The decision shall be filed in writing by the Panel Chairman
with the Town Manager not later than fifteen (15) full working
days at'ter the completion of the hearing. Such decisions
shall contain a summary of the panel's reasoning in the case
as well as the decision per se.
Copies of the decision shall be transmitted to the Department
Head, the employee and the employee's supervisor.
The employee's failure to process a grievance within the
time. limits shall constitute termination of the grievance.
Time limits may be extended by mutual agreement.
Nothing in this procedure is intended to circumscribe or
modify the existing right of the Town government to do the
following, provided, however, that none of these rights may
be exercised in an arbitrary or capricious manner:
l.~ Direct the work of its. employees..
2. Hire, promote, transfer, assign and retain employees
in position within the Town government.
3. Demote, discipline, or dismiss employees for proper
cause.
4. Maintain the efficiency of governmental operations.

5. Relieve employees from duties because of lack of work,
lack of funds or for other ligitimate reasons.
6. Take actions as may be necessary to carry out the
duties of the Town in emergencies.
7. Determine the methods, means and personnel by which
operations are to be carried on.
Councilman Aust moved that a copy of the grievance procedures be
made available to each employee of the Town, and'that they be required
or asked to read same and sign it; that each Department Head be
responsible for the employees in his department being made aware of
these procedures. The motion was-seconded by Councilman Frye, and
carried._
Town Attorney Moore stated-a Resolution accepting Grant Agreement
naming New River Valley Airport Commission Agent of the Town of Pulaski,.
to receive payment of federal funds for FAA Project No. 74-1-7-51-0012-01,
and to authorize the Mayor and Clerk to execute same, had been prepared
and ready for Councils consideration. Mr. Moore also stated a Resolutibn
RESOLUTION had been prepared for Council's nonsideration, to dismiss a petition
RE: GRANT and proceedings therein, to vacate and abandon a portion of English

WHEREAS, the A~m~nistrator of the Federal Aviation
Agency has tendered to the Town of Pulaski, Virginia, the
Grant Agreement for Project No. 74-1-7-51-0012-01, whereby the
Sponsors, jointly and severally, acknowledge, recognize and
represent the New River Valley Airport Commission to be their
Agent to receive the payment of Federal funds under the terms
of said Grant Agreement, executed between the Sponsors and
the United States; and

AND ABANDON PORTION OF ENGLISH FOR-
EST ROAD, IN THE TOWN OF PULASKI,
VIRGINIA, AND TO PROVIDE FOR PAYMENP
OF COSTS OF THIS PROCEEDING.
WHEREAS, Anne N. English filed her Petition on the 21st
day of May, 1974, with the Council of the Town of Pulaski,
Virginia, after posting on the 26th day of April, 1974,
Notice as required by law in at least three places in said
Town, which posting was at least ten days prior to the
filing on June 21, 1974, said Petition requesting the Town
to vacate and abandon a certain portion of English Forest
Road, in the English Forest Subdivision, set out and
described by metes and bounds in said Petition; and

TO DISMISS WHEREAS, by Resolution adopted on the 23rd day of May,

WHEREAS, subsequent thereto, all the landowners who would
be affected by the vacation of the aforesaid portion of English
Forest Road were notified of the filing of said Petition and
the Public Hearing thereon set for the 18th day of June, 1974,
in the Town Office of Pulaski, Virginia, by Notice mailed to
the landowners, if any, and also by proper publication of a
Public Notice in ,the Southwest Times, a local newspaper; and
WHEREAS, on the 18th day of June, 1974, said Public
Hearing was-held pursuant to the. aforesaid Notice for the
vacation and abandonment of said portion of English Forrest
Road, as set out in the Petition and hereinafter described,
and upon the Viewer's Report dated-the 17th day of June, 1974,
stating that "in the opinion of the Viewers, closing the street
would cause inconvenience and would prohibit the orderly
extension of the street into possible new development"; and
upon hearing ore tenus the Attorney for Petitioner, and
property owners in the neighborhood; and
WHEREAS, the Council of the Town of Pulaski, Virginia, is
of the opinion and so finds from all the facts that inconvenience
would result from the closing of the aforementioned portion of
English Forest Road;
NOW, THEREFORE, Be it Resolved by the Council of the
Town of Pulaski, Virginia, that:
Vacation and Abandonment of that portion of English
Forest Road, as shown on a plat entitled "Plat of
English Forest Subdivision" dated October 20, 1953,
and recorded in the Pulaski County Circuit Court
Clerk's Office in Plat Book 2, page 132:
"BEGINNING at the Northeastern corner of Lot 3 of
said Subdivision and running South 25 30'East 50
feet to the Northwestern Corner of Lot 4 in said
subdivision; thence South 61,. 52' East 107 feet to
a point at the West boundary of said Lot 4; thence
with a curve radius of which is 20 feet, the
tangent of which is 20.2 feet to the point in the
Southern boundary of said Lot 4, which point is
/~6 feet from the Southern corner of the property
owned by Hairy Loftus; thence North 24 32' West 70
feet, more or less, to a point in the Eastern

be, and the same shall not be vacated and abandoned as a public
street in the Town of Pulaski, Virginia, and the Petition filed

BE IT FURTHER RESOLVED that Edward L. Barr, Dan C. Bell
and W. Marvin Board, the aforesaid Viewers, be paid the sum of
Ten Dollars 010.00) each, and that all the costs, including
attorney,~s fees involved in the proceeding to vacate the
aforesaid portion of street be paid by the Petitioner.
WHEREUPON, this Resolution 'is hereby Adopted by the

Mayor Edens asked if there was anyone who wished to speak either
for or against the proposed budget for the fiscal year ending June 30, 1975.
No one spoke either for or against the proposed budget, and Councilman Frye

Mayor Edens read to Council the letters of resignation of Councilman
Frye and Aust, as of June 30, 1974. Councilman House moved that Council
