HomeMy WebLinkAbout2010-08ORDINANCE 2010-08 ORDINANCE ESTABLISHING AN AUXILIARY POLICE FORCE PROGRAM WHEREAS, the Town Council desires to maintain and enhance the public safety of the citizens of the Town of Pulaski; and, WHEREAS, upon review and consideration, the Town Council has determined that establishing an auxiliary police force program would assist the Town in maintaining the necessary levels of staffing for the Police Department should circumstances require additional on-duty personnel; NOW THEREFORE be it ORDAINED by the Town Council of the Town of Pulaski, Virginia sitting in regular session this 21St day of September 2010, that Chapter 30 of the Town Code is hereby amended to include the following: ARTICLE III. ESTABLISHMENT OF AN AUXILIARY POLICE FORCE Section 30-35. Authority to establish an auxiliary police force. The town is authorized to establish an auxiliary police force by the Code of Virginia, 1950, as amended, §§15.2-1731 through 15.2-1735. The Pulaski Police Department's Chief of Police is authorized by Town Council to establish, equip, train, maintain, and develop operating procedures for an auxiliary police force program. Section 30-36. Auxiliary police force defined. Within the Town of Pulaski Police Department, the auxiliary police force is defined as a supplemental police program to be comprised of citizen volunteers selectively used to conduct a variety of operational support or administrative assignments. Section 30-37. Appointment of auxiliary police officers. The Chief of Police shall have the authority to appoint as auxiliary police officers as many persons of good character as he deems necessary (not to exceed fifteen (15) percent of the paid force as from time to time established), and these appointments shall be revocable at any time by the Chief of Police. Ordinance 2010 - 08 Page 1 of 3 Section 30-38. Eligibility requirements. Any citizen, certified as a law enforcement officer by the Virginia Department of Criminal Justice Services (DCJS), or who is eligible for a waiver to re-establish law enforcement certification through DCJS, and who retired or resigned from their former agency in good standing, shall be eligible to make application to become a member of the auxiliary police force. Applicants shall apply and will be selected in the form and manner prescribed by the Chief of Police. Section 30-39. Authority to prescribe uniform, equipment, organization and regulations. The Chief of Police shall have the authority to prescribe the uniform, equipment, organization and such rules and regulations as he shall deem necessary for the operation of the auxiliary police force program. Section 30-40. When auxiliary police personnel may be called into service. The Chief of Police or designee may call into service such auxiliary policemen as may be deemed necessary. Section 30-41. Powers and immunities of auxiliary police personnel. The members of the auxiliary police force shall have all the powers and immunities of constables at common law. Section 30-42. Jurisdictional limitations of auxiliary personnel. The members of the auxiliary police force shall not be required to act beyond the limits of the jurisdiction of the Town, except when called upon to protect any public property belonging to the Town which may be located beyond its corporate boundaries. Section 30-43. Compensation and civil service status of auxiliary personnel. The members of the auxiliary police force shall serve as such without compensation and shall not be subject to the provisions of any law providing for law enforcement officers procedural guarantees as established for the members of the regular police force. Section 30-44. Liability coverage for auxiliary personnel. The Town and its Police Department shall be directly liable for the activities of auxiliary police personnel while on duty non-withstanding their "volunteer" status. They shall be covered under the Town's general liability coverage plan. If necessary, a special risk accident insurance policy shall be purchased by the Town for coverage of auxiliary personnel injured in the line of duty which is not covered by the Virginia Workman's Compensation Act. Ordinance 2010 - 08 Page 2 of 3 Section 30-45. Auxiliary personnel to wear uniforms and equipment. The members of the auxiliary police force shall wear the uniform and equipment prescribed by the Chief of Police at all times while serving as auxiliary policemen. Section 30-46. Auxiliary personnel and conflicts of interest. Applicants for the auxiliary police force must not be employed in positions presenting a potential conflict of interest. This restriction includes police officers, security guards, military police officers, civilians in Virginia law enforcement positions, and firemen. This ordinance is effective upon adoption and is hereby adopted this 21St day of September 2010 by the duly recorded vote of the Town Council of the Town of Pulaski, Virginia as follows: Morgan P.
