ORDINANCE GRANTING AN ENCROACHMENT ON BOWLING COURT
WHEREAS, Pulaski County applied to the Town of Pulaski, Virginia for a six inch
encroachment on the Town right of way on Bowling Court to accommotlate exits from
the County offices in the former Maple Shatle Shopping Center; and,
WHEREAS, the Town Council held a public hearing on May 3, 2011 on the said request
after advertisement in accordance with applicable statutes;
NOW, THEREFORE be it ORDAINED bZ the Town Council of the Town of Pulaski,
Virginia sitting in regular session this 1]' day of May 2011, that Pulaski County, be and
hereby is granted asix-inch encroachment upon the Town right of way on Bowling
Court as illustrated in Attachment A, ahixetl to and expressly matle part of this
ortlinance.
FURTHERMORE this permission is subject to the proviso that the Town will not be
responsible for any loss or tlamage to said structure by reason of the public use or
maintenance of the street and public utilities; antl if the structure is tlamagetl by street
or utility repair or replacement by the Town, the cost of repair to the structure shall be
on the property owner.
This ordinance is effective upon atlop[ion and is hereby adopted this 1]'" tlay of May
2011 by the duly rewNetl vote of the Town Council of the Town of Pulaskl, Virginia as
follows:
