HomeMy WebLinkAbout2011-10ORDINANCE 2011-10 ORDINANCE APPROVING A SPECIAL EXCEPTION TO KEEP A HORSE AT 1017 WISLER PLACE WHEREAS, Cecil Hutchinson applied for a special exception under Section 402.3-9 of the Zoning Regulations of the Town of Pulaski, Virginia to keep a horse at his home located at 1017 Wisler Place and, WHERAS, the subject property is zoned R-1 Residential District and is identified as Tax Map No. 072-040- 0000-0006, 0007-0010, 0012-0016, 0019-0027; and, WHEREAS, after advertisement required by law, the Planning Commission and Town Council conducted a public hearing on July 11, 2011 and August 2, 2011 respectively, wherein the comments and concerns of the public were heard; the factors listed in Section 702.4-5 of the Zoning Regulations of the Town of Pulaski, Virginia were considered by the Planning Commission and Town Council; and the recommendation of the Planning Commission was reviewed and considered by Town Council; and, WHEREAS, the Town Council did consider and found as fact that the proposed special exception is compatible with the surrounding uses; is consistent with the intent of the Zoning Regulations and the Comprehensive Plan; is in the public interest; and will comply with other provisions of law and ordinances of the Town of Pulaski, NOW, THEREFORE be it ORDAINED by the Town Council of the Town of Pulaski, Virginia sitting in regular session this 23rd day of August 2011, that the application of Cecil Hutchinson for a special exception to keep a horse at his property, consistent with state statutes and Town ordinances, is hereby approved with the following conditions: Should the horse be removed from the property for a period of one (1) year, this special exception shall lapse and shall not thereafter be permitted. A lawful fence as defined in Sec. 55-299 (5) (c) shall be maintained to generally acceptable standards so that the horse cannot exit through the fence thereby remaining confined to the property. This ordinance is effective upon adoption and is hereby adopted this 23rd day of August 2011 by the duly recorded vote of the Town Council of the Town of Pulaski, Virginia as follows: Morgan P.
