ORDINANCE AMENDING SECTION 86-2
OF THE TOWN CODE
WHEREAS, the Town Council of the Town of Pulaski, Virginia has decided that it is in
the best interest of the public to amend Section 86-2 of the Town Code to clarify use of
the town water system and sewer system;
NOW, THEREFORE be it ORDAINED by the Town Council of the Town of Pulaski,
Virginia sitting in regular session this 4th day of September, 2012, that Section 86-2 of
the Town Code, is hereby amended to read as attached.
This ordinance is effective upon adoption and is hereby adopted this 4th day of
September, 2012, by the duly recorded vote of the town Council of the Town of Pulaski,
Virginia as follows:

(a) The area within the corporate limits, as from time to time established, is designated as
the exclusive service area for the town water system and sewer system.
(b) All persons and entities in the exclusive service area using water for domestic,
commercial, or industrial purposes, or any other use other than watering of crops and
livestock, are required to connect to the town water system, to disconnect from any
other source, and to purchase such water from the Town unless and only to the extent
that:
1.) the Town expressly declines, in writing, to furnish such water; or
2.) the Town expressly consents, in writing, to allow an exception for the
collection and/or storage of water under subsection (g), below.
(c) In furtherance and not in limitation thereof, the use of subsurface water in the exclusive
service area for domestic, commercial, and industrial purposes is prohibited unless and
only to the extent that:
1.) the Town expressly declines, in writing, to furnish such water; or
2.) the Town expressly consents, in writing, to allow an exception for the
collection and/or storage of water under subsection (g), below.
(d) In furtherance and not in limitation thereof, the use of watercourses within the
exclusive service area for domestic, commercial, and industrial purposes is prohibited;
provided, however, that nothing contained in this Chapter will restrict or enlarge any
existing privilege of withdrawal from and/or discharge into watercourses lawfully made
under any state water control board permit.
(e) All persons and entities within the exclusive service area producing sewage or
wastewater are required to connect to the town sewer system, to disconnect from any
other sewer or wastewater system, and to pay the required connection fee and service
charge wherever the town sewer system and connection is available. In the event that
discharge into the town sewer system is not available, discharge must be made into a
septic system that meets the installation and use requirements of the Health Director
and the State Board of Health.
(f) The Town may provide water or sewer service to users outside the exclusive service
area, and may designate such users as a separate class in setting rates.
(g) The Town may consent to the use of subsurface water, and the collection and retention
thereof, under subsections (b) 2. and (c) 2. herein, provided that use of such water,
including withdrawal from permitted storage, may occur only during any period of time
the Town water supply to the customer is interrupted and otherwise unavailable to the
customer, and provided that such water is only utilized for non-potable uses.
