Ordinance Approving a Special Exception
for 94 West Main Street
WHEREAS 89 West Main Street, L.L.C., owner, applied for a special exception under
Section 411.3-3 of the Zoning Regulations of the Town of Pulaski, Virginia, to establish
apartments as part of a proposed mixed use development at 94 West Main Street; and,
WHEREAS the subject property is zoned B-3 Central Business District and is identified as
Tax Map No. 072-051-0022-022C, 0246, 0266, 0286; and,
WHEREAS, after advertisement required by law, the Planning Commission and the Town
Council conducted public hearings on November 12, 2013, and December 3, 2013,
respectively, wherein the comments and concerns of the public were heard, the factors listed
in Section 702.4-5 of the Zoning Regulations of the Town of Pulaski, Virginia, were
considered. by the Planning Commission and by Town Council, and the recommendation of
the Planning Commission was reviewed and considered by the Town Council; and,
WHEREAS the Town Council did consider and found as fact that the proposed special
exception is compatible with the surrounding uses, is consistent with the intent of the Zoning
Regulations and the Comprehensive Plan, is in the public interest, and will comply with other
provisions of law and ordinances of the Town of Pulaski,
NOW, THEREFORE be it ORDAINED by the Town Council of the Town of Pulaski, Virginia
sitting in regular session this 17th day of December 2013, that the application of 69 West
Main Development, L.L.C., owner, for a special exception to establish apartments as a part of
a proposed mixed use development at 94 West Main Street, is hereby approved as
submitted.
This ordinance is effective upon adoption and is hereby adopted this 17th day of December
2013 by the duly recorded vote of the Town Council of the Town of Pulaski, Virginia as
follows:
