HomeMy WebLinkAbout2014-19ORDINANCE 2014-19 AMENDING SECTION 54-2 OF THE CODE OF ORDINANCES TOWN OF PULASKI, VIRGINIA WHEREAS, the Town Council of the Town of Pulaski, Virginia has determined that it is the best interest of the public health, welfare and safety to update sections of the Code of Ordinances-Town of Pulaski, Virginia to reflect changes in the ownership and operation of Town facilities; and WHEREAS, the Town Council has determined, following a discussion at its regular session on August 5, 2014 that Section 54-2 of the Code of Ordinances, titled "Recreational Activities on Certain Property", requires amendments to further protect and preserve certain properties owned by the Town which are used for recreational purposes; NOW, THEREFORE be it ORDAINED by the Town Council of the Town of Pulaski, Virginia sitting in regular session this 2nd day of September 2014 that Section 54-2 of the Code of Ordinances-Town of Pulaski, Virginia entitled "Recreational Activities on Certain Property" is hereby amended as shown in Attachment A-Ordinance 2014-19, affixed hereto and expressly made part of this ordinance. This ordinance is effective upon adoption and is hereby adopted by the duly recorded vote of the Town Council of the Town of Pulaski, Virginia sitting in regular session this 2nd day of September 2014 as follows Heather L. Penn -Aye THE TOWN OF PULASKI, VIRGINIA .Worrell, Mayor .~ Patricia Cruise, Clerk of Council ATTACHMENT A-ORDINANCE 2014-19 Sec. 54-2. Recreational activities on certain property. (a) Fishing, boating, biking, camping, picnicking and other recreational activities shall be permitted upon property belonging to or under the control or supervision of the Town, and more particularly the properties known as Gatewood Dam and Reservoir, the Draper Mountain Bike Trail, the New River Trail Extension and at other such properties as may be designated by the council. (b) The Town Manager is authorized and directed to plan, draw up, issue, promulgate, post and define in detail the activities to be allowed, the limitations to be placed on such activities, the conditions, rules and regulations under which the activities shall operate, charges to be made, if any, establishment of requirements for permits to do any and all things necessary for the operation of all the activities provided for in this section, and to present all such plans, rules and regulations, etc., to the Council for its ratification and approval prior to their effective date. However, until such time as the rules, etc., contemplated under this section are adopted, or thereafter if the occasion or the need may arise, the Town Manager may put into effect a temporary plan of operation, rules, regulations, etc. to be used in the operation of these facilities. (c) No swimming shall be allowed on any of the property, including Gatewood Dam and Reservoir, as designated in this section. (d) Fishing, boating, hiking, camping, picnicking and other recreational facilities to be permitted under this section shall not be allowed at Gatewood Dam or any other property until such time as the Town Manager shall, with the Council's approval, give notice of such permission, either by newspaper, posting of signs or by such other means as he may deem necessary. (e) No motorized vehicle including, but not limited to all-terrain vehicles (ATV), motorcycles and both on- and off-road vehicles, shall be permitted on any hiking trail or mountain biking trail, except in instances where: (1) such vehicles may be required by law enforcement, fire, rescue or other emergency services personnel in the performance of their duties; (2) such vehicles may be required by Town employees in the performance of their assigned duties. (3) the use of motorized devices, including but not limited to motorized wheelchairs and motorized mobility scooters that are specifically designed to assist handicapped persons with limited mobility, are required ; (4) adult electric bicycles are used. (f) Any person who violates any of the provisions of this section shall be guilty of a Class III Misdemeanor.
