HomeMy WebLinkAbout2014-22Ordinance 2014-22 Ordinance Amending Sections of Chapter 38, Article III of the Town Code Regarding Property Maintenance and Weeds and Grass Violations WHEREAS, the Town Council of the Town of Pulaski, Virginia has determined that it is in the interest of the public health, welfare, and safety of the Town to amend provisions of the Code of Ordinances, Town of Pulaski, Virginia regarding property maintenance processes and violations involving weeds and grass; and, WHEREAS, the Town Council conducted a public hearing on December 2, 2014 wherein the comments of the public concerning amendments to the Town Code were heard and considered; NOW, THEREFORE, be it ORDAINED by the Town Council of the Town of Pulaski, Virginia, sitting in regular session this 2nd day of December 2014, that Chapter 38, Article III, Premises and Property Maintenance" of the Code of Ordinances, Town of Pulaski, Virginia is hereby amended as shown in Attachment A-Ordinance 2014-22, affixed hereto and made expressly part of this ordinance, the remainder of said Ordinance not amended herein deemed to be still in effect. This ordinance is effective upon adoption and is hereby adopted by the duly recorded vote of the Town Council of the Town of Pulaski Virginia, this 2nd day of December, 2014 as follows: Heather L. Worrell, Mayor Attachment A Ordinance 2014-22 Chapter 38 Article III -Premises and Property Maintenance Division 1 -Generally Sec. 38-76. -Notice to comply (d) The notice or notices provided for in this section shall state the time within which the action or work ordered to be done is to be completed. Such time shall be not less than seven (7) days if personal service on an owner is had, and not less than ten (10) days if the notice is properly mailed in accordance with subsection (b) of this section; however, for violations involving the repair or removal of buildings, the owner will be given at least fifteen (15) days following the later of the return of the receipt or of newspaper publication to bring the property into compliance. Each owner shall have seven (7) days to appeal upon receipt of this notice. Sec. 38-79. -Removal by the Town; collection of costs (a) Upon the failure, neglect or refusal of any owner of real property upon whom notice has been given pursuant to this article to comply within the time indicated in the notice or any written extension granted by the Town, the Town Manager is authorized to have the corrective action performed by Town personnel or by contract; and the actual cost of such corrective action, and an additional fee of $250, and an additional charge for administration costs of twenty-five (25) percent of all other expenses, shall be charged to all owners. Division 3 -Weeds; Grass Sec. 38-121. -Condition prohibited (b) This section shall not apply to farmland or woodland, unless such farmland or woodland is within fifty (50) feet of a building of any kind or description of another owner on an adjacent tract or parcel of land.
