HomeMy WebLinkAbout2015-14 Ordinance 2015-14 Ordinance Authorizing the Operation of Golf Carts On Certain Designated Streets within the Town WHEREAS, the use of golf carts to ferry citizens between Calfee Park and new parking areas located further from the ballfield has been proposed for the safety and convenience of the citizens; and WHEREAS, the Code of Virginia under§§46.2-916.1--46.2-916.3 permits golf carts to be utilized on designated highways within a municipality subject to conditions outlined in the aforementioned sections; and, WHEREAS, the Town Council, as required in §46.2-916.2 of the state code has (i) considered the speed, volume, and character of motor vehicle traffic using such streets and (ii) determined that golf cart and utility vehicle operation on particular streets is compatible with state and local transportation plans and consistent with the Commonwealth's Statewide Pedestrian Policy provided for in § 33.2-354 of the state code; and that permitting the use of such vehicles on certain streets in the vicinity of Calfee Park is consistent with the public health, safety and welfare; NOW, THEREFORE be it ORDAINED by the Town Council of the Town of Pulaski, Virginia, sitting in regular session this 7th day of July 2015, that golf carts may be operated on the designated portions of the following streets during events at Calfee Park by personnel employed by or specifically authorized by Historic Calfee Park L.L.C.: • Pierce Avenue-from the intersection of Pierce Avenue and Dora Highway to the intersection of Pierce Avenue and\South Washington Avenue (Rt. 11). • Bunts Street-from its intersection with Pierce Avenue to its terminus. • Floyd Avenue-from the intersection of Floyd Avenue and 4th Street, S.E. to the intersection of Floyd Avenue and 6th Street, S.E. • Fifth Street, S.E.-from the intersection of 5th Street S.E. and Graham Street to the intersection of 5th Street, S.E. and Floyd Avenue. FURTHER ORDAINED, that any golf cart operated on the designated town streets shall be in compliance with §46.2-916.3 of the Code of Virginia and shall be equipped with such lights as required by §46.2-1010, Article 3 of the Code of Virginia. FURTHER ORDAINED, that the Town of Pulaski, as authorized under§46.2-916.3 (E) of the Code of Virginia, may recover, from Historic Calfee Park, L.L.C., the cost of all signage and any maintenance costs for such signage concerning the operation of golf carts on the designated streets. This ordinance is effective upon adoption and is hereby adopted by the duly recorded vote of the Town Council of the Town of Pulaski, Virginia sitting in regular session this 7th day of July 2015 as follows: Heather L.
