Ordinance Approving a Special Exception for a Vehicle Repair Facility
At 131 West Main Street
WHEREAS, Warren J. Schuyler, applicant., and Antonio Jones; property owner, submitted an
application for a special exception for an automobile, truck and vehicle repair business at 131 West
Main Street; and,
WHEREAS, the subject property is zoned B-3 Central Business District and is identified as Tax Map
No. 072-032-0001-0037, 0039 and 0041; and,
WHEREAS, a special exception under Section 411.3-10 of the B-3 zoning regulations is required for
automobile, truck or other vehicle repair, but not storage of junk or an automotive graveyard; and,
WHEREAS, the Planning Commission and Town Council conducted duly noticed public hearings on
April 11, 2016 and May 10, 2016 respectively, wherein the concerns and comments of the public and
the factors listed in Section 702.4-5 of the Town of Pulaski Zoning Regulations were considered and
reviewed; and,
WHEREAS, at its April 11, 2016 hearing, the Planning Commission recommended approval of the
application subject to recommended conditions applicable to the proposed use;
NOW, THEREFORE be it ORDAINED by the Town Council of the Town of Pulaski, Virginia, sitting in
regular session this 24th day of May 2016 that the application of Warren J. Schuyler, applicant and
Antonio Jones, property owner for a special exception to operate an automobile, truck and vehicle
repair business at 131 West Main Street is approved, subject to the conditions as set forth below:
• All parts, including faulty parts, tires, etc. are to be kept inside the garage or a fully enclosed
building (including a roof) until disposal.
• All waste petroleum products and/or chemicals are to be disposed of and are not to
accumulate upon the premises. Provisions are to the made for the capture of leaking
petroleum products and/or chemicals for all vehicles left for repair.
• All vehicles on the property are to have a State inspection decal that is either valid or dated no
more than 90 days from its expiration and are to be stored as close to the building as practical.
• There shall be no storage of waste products closer than fifty (50) feet to the Peak Creek Wall.
This ordinance is effective upon adoption and is hereby adopted this 24th day of May 2016 by the duly
recorded vote of the Town Council of the Town of Pulaski, Virginia as follows:
