HomeMy WebLinkAbout2017-03Ordinance 2017-03 Closing of an Undeveloped Portion of the Clark Street Right of Way Located Between Howard Street and Crescent Street WHEREAS, Habitat for Humanity and the Pulaski Redevelopment and Housing Authority applied to the Town of Pulaski to close an undeveloped portion of the Clark Street right of way, located between Howard Street and Crescent Street, to assist in the construction of single-family detached residences; and WHEREAS, the Town Manager submitted the proposal to all department heads for comments; and WHEREAS, the Town Council conducted a public hearing on April 18, 2017, on said proposal after advertisement in accordance with law; and WHEREAS, it appears the portion of the undeveloped street right of way under consideration has never been opened and the Town Council finds that it is in the best interest of the Town and its citizens to close and vacate the portion of said right of way; NOW THERFORE, be it ORDAINED by the Town Council of the Town of Pulaski, Virginia sitting in regular session this 2nd day of May 2017, that an undeveloped portion of the Clark Street right of way, approximately 120 feet long by 40 feet wide located between Howard Street and Crescent Street as shown in Attachment A -Ordinance 2017-03, herein affixed to and expressly made a part of this ordinance, is hereby abandoned, closed, and vacated, with title thereto if any be vested in the Town, reverting without warranty to adjacent property owners as provided by law; FURTHER ORDAINED that excluded from this abandonment, closure and vacation and reserved by the Town, are any and all utility or other easements which may exist in favor of the Town, its successors and assigns. This Ordinance is effective upon adoption and is hereby adopted by the duly recorded vote of the Town Council of the Town of Pulaski, Virginia, on this 2nd day of May 2017 as follows: James A.
