Ordinance Amending Chapter 10 of the Town Code Prohibiting Possession
Of Open Containers of Alcoholic Beverages in Town Parks
and Certain Public Places
WHEREAS, the Town Council of the Town of Pulaski, Virginia wishes to provide a
positive and community oriented environment for citizens to use and enjoy the Town's
parks and public places; and,
WHEREAS, the consumption of alcohol in Town parks and public places has resulted in
various offenses against the public order which have given rise to complaints from
citizens denied the peaceful and undisturbed use of the Town's parks and facilities; and,
WHEREAS, Section 4.1-128 (B) of the Code of Virginia 1950 as amended, authorizes
the governing body of any county, city or town to adopt ordinances which regulates or
prohibits the possession of opened alcoholic beverage containers in its local public
parks, playgrounds, public streets and any sidewalk adjoining any public street;
NOW, THEREFORE be it ORDAINED by the Town Council of the Town of Pulaski,
Virginia sitting in regular session this 1st day of August 2017 that Chapter 10 of the
Code of Ordinances, Town of Pulaski, Virginia is hereby amended to prohibit
possession of open containers of alcohol beverages in the Town's parks and certain
public places as set forth below:
Article III. Prohibition of Possessing Open Containers of Alcoholic Beverages in
Town Parks and Certain Public Places
Sec. 10-33. Possessing Open Containers of Alcoholic Beverages in Town Parks
and Certain Public Places
(a) Prohibition-- In addition to any other prohibitions pertaining to alcoholic
beverages as contained in the Code of Virginia or other applicable law, it
shall be unlawful for any person to possess an open container of an
alcoholic beverage in any of the following parks or designated public
areas:
1.
MacGill Park
2.
Kiwanis (Dora) Park
3.
Valley Street Park
4.
Sixth Street Park
5.
Cool Springs Park
6.
Jackson Park
7.
Heritage Park
8.
Dora Trail
9. Pulaski Passenger Station and environs including the station, porch
and open seating areas, yards and green spaces, parking lots,
caboose and all accessory structures.
10. Raymond F. Ratcliff Transportation Museum and environs.
11. Public streets and sidewalks adjoining public streets.
(b) Exemptions
Gatherings and events sponsored by the Town of Pulaski in
the aforementioned parks and facilities, subject to vendors
securing a permit from the Town and presenting proof of
having obtained the required licenses from the Virginia
Department of Alcoholic Beverage Control to the Town
Manager or his designee, to serve alcohol at a Town
sponsored event.
2. Private gatherings that have secured a permit from the Town
to use the aforementioned parks and facilities and have
presented proof of having obtained the required licenses
from the Virginia Department of Alcoholic Beverage Control
to the Town Manager or his designee, to serve alcohol
during the event.
(c) Penalty -Any person violating the provisions of this chapter shall be
guilty of a Class 4 Misdemeanor. Each day a violation of this
chapter continues shall constitute a separate violation.
This ordinance is effective upon adoption and is hereby adopted this 1st day of August
2017 by the duly recorded vote of the Town Council of the Town of Pulaski as follows:
