Ordinance Amending Section 86-5 of the Code of Ordinances
Town of Pulaski, Virginia
WHEREAS, the Town Council has determined that it is in the interest of the Town of
Pulaski to maintain and update the Code of Ordinances for the Town; and,
WHEREAS, having received the recommendation of the Finance Director and Town
Manager that amendments updating Section 86-5 "Billing" were necessary to reflect
changes in current practices to the billing process for utilities;
WHEREAS, the Town Council authorized the Administration and staff to make such
revisions as necessary to reflect current practices regarding the billing of utilities;
NOW, THEREFORE be it RESOLVED by the Town Council of the Town of Pulaski,
sitting in regular session this 19th day of September 2017, that Section 86-5 "Billing" of
the Code of Ordinances, Town of Pulaski, Virginia is hereby amended as shown in
Attachment A -Ordinance 2017-10, affixed hereto and expressly made a part of this
ordinance as if set forth herein.
This ordinance is effective upon adoption and is hereby adopted this 19th day of
September 2017 by the duly recorded vote of the Town Council of Pulaski, Virginia as
follows:

Sec. 86-5. - Billing.
(a) The town reserves the right to administratively establish and revise billing
periods from time to time, such as monthly, quarterly, semiannually and
annually. The customer charges may be based upon estimates or averages,
even if the meters are not read; however, the meters will be read at least
quarterly to verify the accuracy of such averages and to make any
adjustments between the estimated or average billing and the actual use
incurred. The billing period and service period need not be identical.
(b) Each customer will be mailed a statement of the amount due for services
during the preceding billing period, or part of a period, to normally include
water charges, sewer charges, a statement of the provisions of interest and
penalties, and other information deemed appropriate by the town.
(c) Statements shall be mailed to the address provided in writing by the account
holder. The town will not be responsible for updating addresses or for actual
delivery of the statement or any notice, and the failure to receive such
statement or any notice shall not excuse failure of a customer to comply with
this article.
(d) All accounts shall be due and payable in full on or before the 20th day after
the statement is mailed unless such day falls on a Saturday, Sunday or legal
holiday, in which case they will be due the next business day.
(e) If not paid when due, a penalty of ten percent of any new charges shall be
added to the total amount of the bill.
(f) If not paid in full within five (5) days after becoming due, a non-payment fee
of forty dollars ($40.00) will be applied to the account, water service will be
cut off and will thereafter be restored only after payment of all arrears,
penalties and other charges.
(g) The office of the director of finance will provide a list of customers to be cut off
to the department of public works, which promptly will make such cutoffs and
notify the director of finance accordingly.

hereby certify that the forgoing Ordinance 2017-10, Ordinance Amending Section 86-5
of the Code of Ordinances, Town of Pulaski, Virginia is a true and correct copy of the
Ordinance set out and adopted by the recorded vote of the Town Council of Pulaski,
Virginia on May 16, 2017.
