HomeMy WebLinkAbout2017-13Ordinance 2017-13 Ordinance Amending a Proffer For Parcel No. 072-140-0000-0006 ADOPTED: November 21, 2017 EFFECTIVE: November 21, 2017 Ordinance 2017-13 Ordinance Amending a Proffer for Parcel No. 072-140-0000-0006 WHEREAS, SHAH Development L.L.C. filed an application to amend a proffer for Parcel No. 072-140- 0000-0006 as approved by Town Council on June 6, 2006; and, WHEREAS, the Town Council and the Planning Commission of the Town of Pulaski, Virginia conducted a duly noticed joint public hearing on November 8, 2017, wherein public comments were received and considered concerning amending the proffer applied to Parcel 072-140-0000-0006; and WHEREAS, the Planning Commission, by Planning Commission Resolution 2017-07, attached here to and expressly made part of this ordinance as if set forth herein, recommended that the Pulaski Town Council approve the proffer amendment for Parcel No. 072-140- 0000-0006 to amend the proffer approved by Town Council on June 6, 2006, to proffer that the developer will not construct multi -family housing on the site. NOW THEREFORE be it ORDAINED by the Town Council of the Town of Pulaski, Virginia sitting in regular session this 21 st day of November that the proffer approved by Town Council on June 6, 2006 for Parcel No. 072-140-0000-0006 is hereby amended to state that the developer will not construct multi -family housing on the aforementioned parcel. This ordinance is effective upon adoption and is hereby adopted this 21 st day of November 2017 by the duly recorded vote of the Town Council of the Town of Pulaski, Virginia as follows: James A. Quesenbe Clerk of Council C.. � RESOLUTION 2017-07 IPULA�SKII TOWN OF PULASKI PLANNING COMMISSION Proffer Amendment WHEREAS the Town of Pulaski Planning Commission, acting upon a request by the Pulaski Town Council to study a request made by Shah Development, LLC for a proffer amendment for Parcel No. 072-140- 0000-0006 to amend the proffer approved by Town Council on June 6, 2006, has found following a duly advertised joint public hearing with Town Council that the public necessity, convenience, general welfare, and good zoning practices (permits / dees nGt pec ) the proffer amendment for Parcel No. 072-140-0000-0006 to amend the proffer approved by Town Council on June 6, 2006 to proffer that the developer will not construct multi -family housing on the site. THEREFORE LET IT BE RESOLVED that the Pulaski Planning Commission (recommends / dQe6 Rei FeceFAFR ) that the Pulaski Town Council approve the proffer amendment for Parcel No. 072-140- 0000-0006 to amend the proffer approved by Town Council on June 6, 2006, to proffer that the developer will not construct multi -family housing on the site. Dated this 8" Day of November 2017. � �__ � t_� tl Kevin Meyer, Chairman Town of Pulaski Planning Commission The above resolution was adopted on motion by Commissioner Hale, seconded by Commissioner Glenn, at a meeting of the Planning Commission following the posting of a public hearing notice and a duly advertised public hearing on the above request on November 8, 2017.
