Ordinance Approving a Special Exception for an Indoor Recreation Establishment
at 1040 East Main Street
WHEREAS RAS Properties, L.L.C., owner; and Todd Davis, agent/applicant, applied for a
special exception under Section 4.9.2-2 (c) of the Zoning Regulations of the Town of Pulaski,
Virginia, to establish an indoor recreation establishment at 1040 East Main Street; and,
WHEREAS the subject property, located at 1040 East Main Street, is zoned B-2 General
Business District and is identified as Tax Map No. 072-140-0000-109G; and,
WHEREAS, after advertisement required by law, the Planning Commission and Town
Council conducted a duly noticed joint public hearing on January 15, 2019, wherein: the
comments and concerns of the public were heard; and,
WHEREAS, the Planning Commission, through Planning Commission Resolution 2019-01,
attached hereto and expressly made part of this ordinance as if set forth herein, found that
the public necessity, convenience, general welfare and good zoning practice permitted the
issuance of a special exception to Todd Davis for an indoor recreation establishment on Tax
Parcel No. 072-140-0000-109G with four conditions applied thereto; and,
WHEREAS the Town Council reviewed the recommendation of the Planning Commission
and approved it as written, by the duly recorded vote of the Council;
NOW, THEREFORE be it ORDAINED by the Town Council of the Town of Pulaski, Virginia
sitting in regular session this 5th day of February 2019, that the application of RAS
Properties, L.L.C. owner; and Todd Davis, agent/applicant; for a special exception to
establish an indoor recreation establishment at 1040 East Main Street is hereby approved
subject to the following conditions:
a. the building shall be in conformity with building and fire regulations to the satisfaction
of the Pulaski Building Official and Fire Marshal;
b. the special exception shall be subject to inspections and approval of the parking area
by the Zoning Administrator. The Town of Pulaski requires the parking area comply
with and maintain the required number of spaces based on use, appropriate
dimensions for parking spaces, and striping of the parking area. Lighting shall be
provided if off-street parking spaces are to be used at night in conjunction with a
business activity on the premises. Lighting facilities shall be arranged and installed,
and the lighting sources shielded, to minimize glare on adjacent property or streets;
c. the property is to be maintained in a clean, sanitary, and sightly manner; and,
d. the special exception is valid for the applicant only and is not transferable.
This ordinance is effective upon adoption and is hereby adopted this 5th day of February
2019 by the duly recorded vote of the Town Council of the Town of Pulaski, Virginia as

PULASKI TOWN OF PULASKI PLANNING COMMISSION
SPECIAL EXCEPTION
WHEREAS the Town of Pulaski Planning Commission, acting upon a request by the Pulaski Town Council
to study a request made by Todd Davis for a special exception to construct an indoor recreation
establishment on tax parcel 072-140-109G in the B-2 General Business District, has found following a
duly advertised Joint Public Hearing with Town Council that the public necessity, convenience, general
welfare, and good zoning practice <EEits does not permit) the issuance of a special exception to
Todd Davis for the construction of an indoor recreation establishment on tax parcel 072-140-109G,
THEREFORE LET IT BE RESOLVED that the Pulaski Planning Commission ommends does not
recommend) that the Pulaski Town Council approve the special exception with the following conditions:

The above resolution was adopted on motion by HALL. seconded by IHomAS at
a meeting of the Planning Commission following a duly advertised Joint Public Hearing on the above
request on January 15, 2019. Upon a call for an aye and nay vote on the foregoing resolution, the
Planning Commission members present throughout all deliberations on the foregoing and voting or
abstaining, stood as indicated opposite their names as follows:
