HomeMy WebLinkAbout2019-02Ordinance 2019-02 Ordinance Amending the Town Code for Adoption of the Special Assessment for the Electronic Summons System WHEREAS, the Town Council of the Town of Pulaski seeks to utilize mobile dispatch and electronic summons systems to enhance the safety and capabilities of first responders in the field, and, WHEREAS, the Code of Virginia §17.1-279.1 authorizes the governing bodies of cities, counties and town to assess a sum not to exceed five dollars ($5.00) as part of the costs in each criminal or traffic case in the district or circuit courts located where such cases are brought in which the defendant is charged with a violation of any statute or ordinance, which violation arose within the town; and, WHEREAS, the proceeds from this assessment are used to fund software, hardware and associated equipment costs for the implementation and maintenance of an electronic summons system; and, WHEREAS, the Town Council conducted a public hearing on February 5, 2019 regarding adopting the special assessment for the electronic summons system, wherein the comments of the public were heard and considered; NOW, THEREFORE be it ORDAINED by the Town Council of the Town of Pulaski, sitting in regular session this 5th day of March 2019, that the Town does hereby amend the Code of Ordinances Chapter 50 "Offenses and Miscellaneous Provisions", as shown in Attachment A - Ordinance 2019-02 affixed hereto and expressly made part of this ordinance as if set forth herein, to adopt the special assessment authorized by the Code of Virginia §17.1-297.1 for the implementation and maintenance of an electronic summons system for use by first responders within the Town. This ordinance is effective upon adoption and is hereby adopted this 5th day of March 2019 by the duly recorded vote of the Town Council of the Town of Pulaski, Virginia as follows: Lane R. C I a Mayor Attachment A -Ordinance 2019-02 Article VII. Special Assessment for Electronic Summons System Sec.50-145. Special Assessment for Electronic Summons System. (a) There shall be assessed an additional sum not in excess of five dollars ($5.00) as part of the costs in each criminal or traffic case in the district or circuit courts located where such cases are brought in which the defendant is charged with a violation of any statute or ordinance which violation rose within the town. (b) Proceeds from the assessment shall be held by the Finance Department until as such time as disbursement of funds to the Police Department is authorized. Funds shall be used solely to fund software, hardware and associated equipment costs for the implementation and maintenance of an electronic summons system.
