Ordinance Approving a Special Exception for a Recreational Establishment
at 37 West Main Street
WHEREAS, 37 West Main L.L.C., owner: Steve Critchfield, agent/applicant, applied for a
special exception under Section 7.2.4-5 (5) of the Zoning Regulations of the Town of Pulaski,
Virginia to operate an indoor recreation and amusement establishment at 37 West Main Street:
and,
WHEREAS, the subject property, located at 37 West Main Street, is zoned B-3 Central
Business District and is identified as Tax Map No. 072-051-0021-0037, 00397 0041; and
WHEREAS, after advertisement required by law, the Planning Commission and Town Council
conducted public hearings on October 21, 2019 and November 6, 2019. respectively, wherein
the comments and concerns of the public were heard: and,
WHEREAS, the Planning Commission. through Planning Commission Resolution 2019-06,
attached hereto and expressly made part of this ordinance as if set forth herein, found that the
public necessity. convenience, general welfare and good zoning practice permitted the issuance
of a special exception to 37 West Main, L.L.C. for an indoor recreation and amusement
establishment on Tax Parcel No. 072-051-0021-0037, 0039, 0041 with four conditions applied
thereto; and,
NOW, THEREFORE be it ORDAINED by the Town Council of the Town of Pulaski, Virginia
sitting in regular session this 6th day of November 2019, that the application of 37 West Main
L.L.C., owner, and Steve Critchfield, agent, for a special exception to operate a
recreational/amusement establishment at 37 West Main Street is hereby approved subject to
the following conditions as shown in Attachment A -Ordinance 2019-10 affixed hereto and made
part of this ordinance as if set forth herein.
This ordinance is effective upon adoption and is hereby adopted this 6th day of November 2019
by the duly recorded vote of the Town Council of the Town of Pulaski, Virginia as follows:

Attachment A -Ordinance 2019-10
Conditions Applied to the Special Exception at 37 West Main Street
The building shall be in conformance with state and local Building and Fire Regulations to
the satisfaction of the Pulaski Building Official and Fire Marshal.
The property is to be maintained in a clean, sanitary, and sightly manner.
This special exception is valid for a period not to exceed 24 months from the date of
issuance of a Certificate of Occupancy. A new special exception must be obtained to
extend the use beyond this 24 -month period.
This special exception is valid for the applicant only and is not transferrable

hereby certify that the forgoing Ordinance 2019-10, "Ordinance Approving a Special
Exception for a Recreational Establishment at 37 West Main Street" is a true and
correct copy of the Ordinance set out and adopted by the recorded vote of the Town
Council of Pulaski, Virginia on November 6, 2019.
