HomeMy WebLinkAbout2021-11Ordinance 2021-11 Ordinance Clarifying Separation Pay Provisions Regarding Benefits WHEREAS, following study and consideration, an amendment to the Personnel Manual was deemed necessary to clarify the personnel policy concerning the awarding of unused benefits by an employee separating from the Town; and WHEREAS, the amendment was deemed necessary for the proper administration of the separation process; and, NOW, THEREFORE be it ORDAINED by the Town Council of the Town of Pulaski, Virginia sitting in regular session this 20th day of April 2021, that Section 3: "Employment Process"; Subsection O "Separation Pay", shall be amended as shown on Attachment A -Ordinance 2021-11 attached hereto and expressly made part of this ordinance as if set forth herein. This ordinance is effective upon adoption and is hereby adopted this 20th day of April 2021 by the duly recorded vote of the Town Council of the Town of Pulaski, Virginia as follows: Lane R. Shannon Collins Mayor Attachment A -Ordinance -2021-11 Section 3: EmRloyment Process Benef its: The employee will receive compensation for any unused benefits (vacation, compensatory time and sick leave up to allowable amounts) as stipulated by this Manual. Unused, accrued vacation time may be forfeited if an employee does not provide a two-week notice or is terminated for reasons other than their position elimination or reduction in force. and that decision will be made by the Town Manager at the time of the separation. Depending on the date of separation, Town health benefits may continue through the end of the month. Retirement: If employees are not retiring, monies for the employee's retirement account as defined by the plan are refundable from the Virginia Retirement System and forms are available from the Virginia Retirement System or the Finance Department. Unemployment Compensation: Employees are eligible for unemployment compensation provided they meet the requirements. The Finance Department shall process unemployment forms. P Exit Interviews Purpose: It is the Town's policy to perform exit interviews with employees who are terminating their employment with the Town. Coverage:—Employees who will no longer be employed with the Town will be asked to complete an exit interview with the Town Manager. However, not all employees will be asked to complete an exit interview. Exit interviews will be conducted based on available time, Department Head request, or Town Council request. Participation: An employee's participation in the exit interview is not mandatory. They will not receive any compensation for their time, however every effort will be made to complete the interview before they are no longer employed with the Town. The employee should be made aware that the results of the interview will be made available to Department Heads. Results of Interview: Results of the interview will be shared with the employee's, Department Head, and may be provided to the Town Council. Supervisors may respond to the employee's comments via memo, through their Department Head, to the Town Manager. 3-13 Revised 11-19-09
