The meeting also featured a general live cast to the public via the Town's Facebook page. In attendance were: Mayor: Shannon Collins, presiding Councilmen Present: G. Tyler Clontz Brooks R. Dawson; Gregory C. East Lane R. Penn; James A. Radcliffe; Michael P. Reis Administration: Darlene L. Burcham,Town Manager Legal Counsel Spencer A. Call to Order Mayor Collins called the meeting to order at 5:30 p.m. 2. Roll Call of Council Present for roll call were Mayor Collins; Mr. Clontz; Mr. Dawson; Mr. Penn, Mr. Radcliffe; and Mr. Reis. Absent from Roll Call was Mr. East. A quorum was present for the conduct of business. 3. Modifications to the Closed Session Agenda None. 4. Closed Session Mayor Collins then asked for a motion to enter Closed Session for five items as follows: one item under Virginia Code 2.2-3711 (A) 1-personnel matter concerning a committee appointment; and four items under Virginia Code 2.2-3711 (A) 8-consultation with legal counsel regarding two specific legal matters requiring legal advice by such counsel; one matter concerning zoning matter language; and one consultation with legal counsel on a zoning matter. Mr. Dawson moved to enter the Closed Session for the stated items. The motion was seconded by Mr. Penn and approved on the following roll call vote: Lane R. Penn -Aye James A. Radcliffe -Aye Brooks R. Dawson -Aye G.Tyler Clontz -Aye Gregory C. East -Absent Michael P. Reis -Aye Council entered Closed Session at 5:32 p.m. Mr. East joined the Closed Session at 5:34 p.m. Page 1 of 7/September 7, 2021 5. Certification of Closed Session Council returned from Closed Session at 6:55 p.m. Mayor Collins requested a motion that Council discussed only those five items for which it went into Closed Session: one item under Virginia Code 2.2-3711 (A) 1-personnel matter concerning a committee appointment; and,four items under Virginia Code 2.2-3711 (A) 8-consultation with legal counsel regarding two specific legal matters requiring legal advice by such counsel; one matter concerning zoning matter language; and one consultation with legal counsel on a zoning matter. Mr. Penn moved to certify the Closed Session. The motion was seconded by Mr. East and approved on the following roll call vote: Lane R. Penn -Aye James A. Radcliffe -Aye Brooks R. Dawson -Aye G.Tyler Clontz -Aye Gregory C. East -Aye Michael P. Reis -Aye 6. Pledge of Allegiance Mr. Clontz led the Pledge of Allegiance. 7. Invocation Mr. East gave the Invocation. Swearing-In of Chief of Police Following the Invocation, Mayor Collins administered the oath of office to Lt. Jill Neice,who was sworn in as the new Chief of Police of the Town of Pulaski. 8. Modification of the Public Session Agenda None. 9. Guests and Visitors Mayor Collins welcomed all the guests in attendance and those watching online. 10. Presentation Mayor Collins next presented resolutions to the Stevens family and the family and friends of former councilman, E.G. Black, Jr. a. Resolution Recognizing the Service of Stevens Funeral Home and the Stevens Family to the Town of Pulaski, Resolution 2021-38 Council then recognized the Stevens Family and Stevens Funeral Home for their service to the community. Mayor Collins read Resolution 2021-38 in its entirety before the Council and members of the Stevens family. After the reading of the resolution, Mr. East moved to adopt Resolution 2021-38"Resolution Recognizing the Service of Stevens Funeral Home and the Stevens Family to the Town of Pulaski?The motion was seconded by Mr. Reis and approved on the following roll call vote: Lane R. Penn -Aye James A. Radcliffe -Aye Brooks R. Dawson -Aye G.Tyler Clontz -Aye Gregory C. East -Aye Michael P. Reis -Aye Following the presentation, Mayor Collins presented the Stevens family with framed and signed copies of the resolution. Page 2 of 7/September 7, 2021 b. Recognition of the Life and Service of Elbert G. Black, Jr., Resolution 2021-44 Council next recognized the life and service of former councilman, Elbert G. Black, Jr. Mayor Collins read Resolution 2021-44 before the Council and friends of Mr. Black. Following the reading of the resolution. Mr. Dawson moved to adopt Resolution 2021-44"A Resolution Recognizing the Life and Service of Elbert G. Black, Jr." as written. The motion was seconded by Mr. Penn and Mr. Radcliffe and approved on the following roll call vote: Lane R. Penn -Aye James A. Radcliffe -Aye Brooks R. Dawson -Aye G. Tyler Clontz -Aye Gregory C. East -Aye Michael P. Reis -Aye Mayor Collins then gave framed and signed copies of the resolution to friends of Mr. Black. 11. Public Hearings Council conducted three public hearings. a. Proposed Amendment to Section 5.4;Adding Section 5.4.10-2, Requirements for Temporary Signage Mr. Deal told Council that adding the proposed temporary signage requirements as Section 5.4.10-2 to the zoning regulations, was necessary because there was no appendix describing requirements for temporary signage either by zoning district or land use. The Planning Commission reviewed the requirements at its June 14th meeting and adopted them at its August 9th meeting. Referring to the packet, Mr. Deal explained that the requirements as shown were classified by zoning district and land use. Council asked questions concerning how the need for the regulations came about and their potential application to residential areas. Mayor Collins then opened the public hearing at 7:19 p.m. With no comments, the public hearing was closed at 7:19 p.m. al. Consideration of Ordinance 2021-23 Mr. East moved to adopt Ordinance 2021-23 as written. The motion was seconded by Mr. Dawson and approved on the following roll call vote: Lane R. Penn -Aye James A. Radcliffe -Aye Brooks R. Dawson -Aye G. Tyler Clontz -Aye Gregory C. East -Aye Michael P. Reis -Aye b. Request for a Special Exception for a Junkyard and Automotive Graveyard for Property at 34 First Street, N.E. Mr. Deal presented the staff report on the application of Good 01' Boys, agent Kelly Dalton, for a special exception for a junkyard and automotive graveyard at 34 First St., N.E. The applicants sought the special exception for temporary storage of vehicles at this location to assist in establishing their business. Mr. Deal reviewed the requirements for screening and the commercial land use designation for the property. Noting opposition from a neighboring property owner on the basis of lowering property values, he told Council that conditions could be applied to limit the impact on other properties as provided by the state code. Page 3 of 7/September 7, 2021 Council inquired about the area of the lot to be actually used for vehicle storage; the relationship between the applicant and the property owner; and, screening for the site. Mr. David Gibas, speaking for the applicant said the relationship was a lease that was anticipated to be 12-18 months in duration before they moved to another location. Their intent was that the site be screened both in front and in back. Traffic concerns were mentioned given both traffic volume in the area and use of a"roll back"vehicle. Also questioned was the zoning of the parcel (1-2) in relation to the intended commercial use shown on the Future Land Use Map. While favoring new business, Council questioned if there was a better location for the business that the Town could help with and that the proposal appeared not to conform to the long-term vision for the area. Concerning whether or not a special exception would go with the applicant or the property, Mr. Deal thought it applied only to with the applicant. Clarification was made that the applicant had the permission of the property owner to file for the special exception. Mayor Collins then opened the public hearing at 7:36 p.m.With no comments received he closed the public hearing at 7:36 p.m. Following the public hearing, Council entered into extensive discussion on the nature and application of conditions particularly with regard into time limitations for the special exception. Mr. Gibas mentioned a 12-18 month"window"was desired which would allow them into the Police rotation for towing as well as responding to accidents. In response to questions on the length of usage of the site, Mr. Gibas said a six-month term was not feasible for them and that their original plan used a 12-18 month period to give time to find a permanent site as well as to establish their business. Council discussed imposing a surety bond as a condition in case the business moved to cover site clean-up costs. In the event of the sale of the property, Mr. Gibas said the owner would be able to give them ample notice before a sale to give time to move out. b1. Consideration of Ordinance 2021-24 Mr. Clontz felt that Council would like to look at applicable conditions from a standpoint of protecting the public while allowing the use of the site.A short discussion then ensued regarding the form of a motion to develop conditions including screening;time period; ingress/egress; and a surety bond. Mr. Rygas suggested that tabling the motion would allow staff the time to develop potential conditions applicable to the special exception, which might be acceptable and considered by Council at the next meeting. On the advice of legal counsel, Mr. Clontz moved to table the request until the September 21St work session. The motion was seconded by Mr. East and approved on the following roll call vote: Lane R. Public Hearing for the Brookmont Project Bond Issue Mrs. Burcham told Council while the hearing had been legally advertised, it was later determined that the Town would be not be able to close on the bond issue until next summer. Bond counsel advised the Town to proceed with the public hearing. The hearing would also give Page 4 of 7/September 7, 2021 Mr. Pedigo the opportunity to update Council on aspects of the infrastructure. Action would not be required. Mr. Pedigo briefed Council on the service area of the Brookmont Project and the changes in the project that were designed to reach the goal of reducing water storage time in the system to 1.5- 2 days,thereby reducing chlorine use and disinfection byproducts. Changes included moving the location of a new tank from Loving Field to Veteran's Hill and installation of new lines resulting in a new pressure zone.Additional project benefits included removal of antiquated storage tanks with reduction in maintenance costs and filter plant improvements that would benefit water quality and cost.Total project cost would be approximately $3.2 million dollars. The major benefit of the project sought would be the reduction of the time water remained in the system.Additional benefits included removal of 4 storage tanks and taking 4 pump stations out of service. Other utility improvements discussed included general upgrades to the Filter Plant consisting of: upgrade of a polymer feed; operational changes; and improvements to the super-pulsator. Mr. Pedigo outlined several specific projects and their cost which included: replacement of two filters at the Filter Plant($455,000); air scour for cleaning filters and their controls($500,000); polymer land sled ($100,000); and painting five water tanks($1.1 million). Mr. Pedigo then told Council about the major water break in the vicinity of the Passenger Station and the difficulties repair crews not only faced with that particular break but with breaks in general. He praised the work of the Public Works crews and felt they should be commended. He also informed Council on current training of Public Works personnel for the use of a valve insertion machine. Mr. East and Mr. Reis expressed their appreciation for Public Work's efforts. Mayor Collins opened the public hearing at 8:20 p.m. There being no comment the hearing was closed at 8:20 p.m. 12. Public Comment Period None. 13. Consent Agenda a. Consideration of August 17, 2021 Council Work Session Minutes Mayor Collins asked for a motion to accept the minutes of August 17, 2021. Mr. Clontz moved to adopt the August 17, 2021 meeting minutes as written. Mr. Dawson seconded the motion which was approved on the following roll call vote: Lane R. Penn -Aye James A. Radcliffe -Aye Brooks R. Dawson -Aye G. Tyler Clontz -Aye Gregory C. East -Abstain Michael P. Reis -Aye 14. Resolution Giving Notice to Withdraw Membership from the Cardinal Criminal Justice Academy, Resolution 2021-42 Mrs. Burcham told Council that Police Department staff and the Administration had considered the appropriate locale for law enforcement training. She had met with Chief Neice and local academy officials, including the Sheriff, who favored the move from Cardinal Academy back to Page 5 of 7/September 7, 2021 the New River Criminal Justice Training Academy (NRCJTA). Given the advantages of returning to a local based training facility, a recommendation was made to return to the NRCJTA by submission of the enclosed resolutions by October 1, 2021, as required by the state code, to withdraw from the Cardinal Academy and apply for membership in the New River Academy. Mr. East and Mr. Radcliffe expressed approval of and support for the recommendation. Mr. Radcliffe moved to accept Resolution 2021-42 as written. The motion was seconded by Mr. Dawson and approved by the following roll call vote: Lane R. Penn -Aye James A. Radcliffe -Aye Brooks R. Dawson -Aye G.Tyler Clontz -Aye Gregory C. East -Aye Michael P. Reis -Aye 15. Resolution Applying for Membership in the New River Criminal Justice Training Academy, Resolution 2021-43 Mr. Radcliffe moved to accept Resolution 2021-43 as written. The motion was seconded by Mr. Clontz and approved by the following roll call vote: Lane R. Penn -Aye James A. Radcliffe -Aye Brooks R. Dawson -Aye G.Tyler Clontz -Aye Gregory C. East -Aye Michael P. Reis -Aye Adoption of Pay-Classification Plan/Appointment of Braxton Cox to the ARB/Authorization of Loan for Jefferson School Purchase Mrs. Burcham in consultation with the Town Attorney, determined that Council needed to take a111 vote on its previous decision to authorize a $50,000 loan to Steve Critchfield for the purchase of the former Jefferson School. The loan will be payable in two years and bear interest at a rate of 4% per year. Interest payments will be required on the first day of each quarter while the loan is outstanding. Also,the Town of Pulaski will place a lien on the property as collateral. While Mr. Rygas identified the proper name of the business entity for the Council's action, Mr. Reis moved to approve the pay and classification plan (appended to the minutes) as presented by the Town Manager. The motion was seconded by Mr. Dawson and approved on the following roll call vote: Lane R. Penn -Aye James A. Radcliffe -Aye Brooks R. Dawson -Aye G.Tyler Clontz -Aye Gregory C. East -Aye Michael P. Reis -Aye Concerning the application of Braxton Cox for membership on the Architectural Review Board, Mr. Dawson moved to pass Resolution 2021-45"A Resolution Appointing Braxton Cox to the Architectural Review Board".The motion was seconded by Mr. East and approved on the following roll call vote: Lane R. Reis -Aye Mr. Reis then moved to approve the loan, with the terms as described by Mrs. Burcham, to Page 6 of 7/September 7, 2021 JS Pulaski Property, L.L.C. Mr. East seconded the motion which was approved on the following roll call vote: Lane R. Penn -Aye James A. Radcliffe -Aye Brooks R. Dawson -Aye G.Tyler Clontz -Aye Gregory C. East -Aye Michael P. Reis -Aye 16. Council's Comments Mr. Penn expressed concern over the blockage of Morehead Lane by parents parking on the both sides of the road while waiting to pick up their children. Mrs. Burcham said she would talk with the Police Department and the school system. Mr. Radcliffe thanked the staff for their efforts and Mr. David Hall for his interest in serving the Town. 17. Manager's Report Mrs. Burcham reported on the effort of a local Boy Scout Troop who cleaned up Counts Crossing. Plantings would be placed there later courtesy of Poor Boys. Concerning Mr. Radcliffe's request for trimming of trees, as soon as some of the vacant positions could be filled the Town was committed to making those improvements happen. 18. Reminder of Future Council Meetings and Adjournment Mayor Collins reminded Council of the upcoming Council Work Session on September 20, 2021, with the Closed Session beginning at 5:00 p.m. and the Public Session beginning at 6:30 p.m. There being no further business, Mayor Collins adjourned the meeting at 8:36 .m.
