Mayor asked for a motion to go into Closed Session to discuss the following item: a. VA Code 2.2-3711 (A) 1 (1 item)- Appointment- Town Manager The motion was made by Mr. East and seconded by Mr. Dawson. Open Session Lane R. Penn- Aye Brooks R. Dawson- Aye Gregory C. Certification of Closed Session- The Mayor asked for a motion to certify that only the following item was discussed: a. VA Code 2.2-3711 (A) 1 (1 item)- Appointments- Town Manager The motion was made by Mr. Reis and seconded by Mr. Dawson. Lane R. Penn- Aye Brooks R. Dawson- Aye Gregory C. East- Aye James A. Radcliffe- Aye G. Tyler Clontz- Aye Michael P. Reis- Aye 4. Mr. Penn lead the audience in the Pledge of Allegiance. 5. Mr. East gave the invocation. 6. Guests and Visitors- The Mayor welcomed all in attendance and viewing online. 7. Modification to Public Session- Mr. Reis asked for a motion on the Town Manager's contract to the agenda. Presentation a. New River Criminal Justice Academy Graduate- Danielle Stephens Chief Jill Neice introduced Danielle Stephens to the council, gave a brief history of previous employment and her awards while at the Criminal Justice Academy. The councilmen welcomed Officer Stephens to the department. b. Pulaski Police Department Accreditation Award- VLEPSC Commissioner Chief Joel Hash with the Wytheville Police Department read the qualifications and standards for an accredited department and presented accreditation award to the Pulaski Police Department. 9. Public Hearing a. Case 2022-11ZA Zoning Amendment to Section 4.4.2-2(f) Daycare Center Definition- Ordinance 2022-20 Caroline Smith, Planner gave the staff report regarding the request to add "daycare center" as a special exception to the R-3 District. The Planning Commission recommended approval on a unanimous vote. Mr. Reis questioned if this would be included other districts and suggested that staff evaluate allowing other districts to add this to the special exception. The Mayor opened the Public Hearing. Dr. Richard Garretts spoke to council on behalf of Memorial Baptist Church, which would like to become a licensed child care center to serve children zero to five years of age. Dr. Garretts stated there is a need for childcare in the area and the church plans to have an experienced childcare staff for age appropriate development care. Mr. East thanked Dr. Garretts for recognizing the need for child care in the area. The Mayor closed the Public Hearing. Resolution 2022-48 Appointing Candidates to the Planning Commission and Pulaski Redevelopment Housing Authority The motion was made by Mr. Reis and seconded by Mr. Clontz to approve the resolution. Penn upon his Retirement from the Town of Pulaski Town Council The Mayor read the resolution. The motion was made by Mr. East and seconded by Mr. Radcliffe to approve the resolution. Lane R. Resolution 2022-50 Honoring William D. Pedigo upon his Retirement from the Town of Pulaski The Mayor read the resolution. Tyler Clontz- Aye Michael P. Reis- Aye The Mayor presented the resolution to Mr. William Pedigo. 13. Resolution 2022-51 Conflict of Interest Policy The Town Manager explained to council that the auditors recommended the town adopt a Conflict of Interest Policy. Ordinance 2022-21 Amending Chapter 38 and Chapter 68 of the Code of Ordinances The Town Manager explained the amendments to Chapter 38 and Chapter 68 regarding refuse collection to include the list of eligible items for bulk collection and specifying the violation for leaving items on the street. The motion was made by Mr. Dawson and seconded by Mr. Radcliffe to approve the ordinance. Lane R. Penn- Aye Brooks R. Dawson- Aye Gregory C. East- Aye 15. Presentation a. Summary of ARPA Funds to Date James A. Radcliffe- Aye G. Tyler Clontz- Aye Michael P. Reis- Aye The Town Manager reported to council the projects that have been identified for use of ARPA funds, most significantly the water system. Other projects with ARPA funds included equipment for both the Police Department, Fire Department, Public Works Department, and the outdoor facilities. The Town Manager reported a lot has been accomplished and we will continue to work on these and other projects with guidelines from the federal government. She also mentioned she was very pleased with how the residents are caring for the new facilities. She stated the town is going through a lot of changes but believes these changes will make the town bigger and better in the future. 16. Modification to Public Session a. Approval of the Town Manager's contract for one year The motion was made by Mr. Reis and seconded by Mr. Dawson to approve the contract. Lane R. Penn- Aye Brooks R. Dawson- Aye Gregory C. Consent Agenda- Consideration of December 6, 2022 Minutes Page 4 of 7 / December 20, 2022 The motion was made by Mr. Dawson and seconded by Mr. East to approve the minutes. Lane R. Penn- Aye James A. Council Comments Mr. Penn thanked each councilmember for being kind and easy to work with over the last 24 years. Mr. Penn thanked Mike Williams with the Pulaski Patriot newspaper for his reporting over the years. Mr. Dawson stated it was an honor to work with Mr. Penn and thanked him for his many years of advice. Mr. Dawson stated his concerns on the unknown aspects of the streetscapes and y -intersection. The Town Manager stated the town has received two grants from VDOT, one for the north side and the other for the south side of West Main. While the streets are being designed together, they will be completed one side at a time which will allow one side of the street to reopen once the water line is completed on West Main Street. She reported the design for the streetscape is still under state review but will hopefully be ready by the January council meeting. Mr. Dawson noted his concerns regarding when projects are being completed we need to ensure the "special touches" are also done to enhance the downtown area. The Town Manager explained that some of the streetscape changes include new lighting, new and possibly fewer trees, and different and improved storm drainage. Mr. East stated it's been a pleasure to serve with Mr. Penn. Mr. Radcliffe stated it has been a pleasure to work with Mr. Perm and Town Council and on several boards. Mr. Radcliffe thanked the Town Manager for the report on the ARPA funds stating the money is being well spent. Mr. Clontz stated it has been a pleasure working with Mr. Penn. Mr. Reis stated it has been and honor serving with Mr. Penn, his knowledge of the history of Pulaski, his guidance, grace, and kindness. Mr. Reis stated the sidewalks on Memorial Drive look great and the money being spent will benefit more people. Mr. Reis questioned if the flashing lights on Main Street are supposed to be yellow and suggested that turning lanes be added to the y -intersection when it's being redone. He thanked the Town Manager and staff for their continued work in a short amount of time. Page 5 of 7 / December 20, 2022 The Mayor thanked Mr. Penn for making his first year of Mayor easier with his knowledge, wisdom, and wit. The Mayor stated he has gotten complaints from residents on the flashing lights on Washington and Main. Residents do not like the idea of not having a street light. The Mayor thanked the Town Manager and Town Council members for all the hard work this year and wished residents a Merry Christmas and Happy New Year. 20. Manager's Report The Town Manager stated she appreciated the comments on what has been accomplished and recognized the town staff for their dedicated work. She stated the transition to Green for Life will be January 2 and delivery of the trash cans will begin December 27th Maps have been posted showing which areas will be picked up on each day of the week. The bulk items that will be accepted will be announced at a later time. Letters will be going out to residents who currently receive alley service but will be serviced on the street in the future. The Town Manager reported that the new convenience center will be located at the former brush site, at the end of Sheriff F.R. Conner Drive and will have the same hours and days of the week as the previous site. She stressed the new site will be for town residents only with the users being identified by the town decal on the vehicle or other identification of town residency. She introduced Jarried McFarland from Green for Life to provide more updates regarding refuse pickup. Mr. McFarland presented to Council the map showing quadrants by the pick-up days and stated if there is any issues Green for Life will work with town staff to come up with solutions. Mr. McFarland thanked town staff for their willingness to work with a new company. He described the different bins that will be located at the convenience center including bins for bulk items, recycling, and tires. Mr. Dawson asked if the site will be level to allow residents to easily use the bins at the convenience center. Mr. Radcliffe asked if the trash cans cannot be picked up by the truck how will the trash be collected. Mr. McFarland stated when the trash cans are delivered, they will be placed where they need to be for collection on the day of the resident's pick-up day. Mr. Reis questioned how alley pick up will take place. Mr. McFarland stated a rear load truck will be used for those residents who will receive curb side service. He stated Green for Life will be working with town staff to ensure this change will be successful. The Town Manager stated there will be hiccups with this change in refuse collection but town staff and Green for Life staff are committed to working through issues quickly.
