July 16, 2024 Closed Session 5:30 p.m.; Open Session 7:00 pm Resolution 2024-32 Resolution Appointing Nathan Smythers as Acting Building Official WHEREAS, the Virginia Uniform Statewide Building Code (USBC) requires that every local building division have a building official, appointed by the local governing body, as the executive in charge of the division; and, WHEREAS, the position of Building Official for the Town of Pulaski is currently vacant; and, WHEREAS, Nathan Smythers, due to his education, training, and experience has been adjudged qualified to both meet the position requirements of and perform the duties as acting building official for the purposes of administering the Virginia Uniform Statewide Building Code and the Code of Ordinances, Town of Pulaski, Virginia NOW, THEREFORE be it RESOLVED by the Town Council of the Town of Pulaski, Virginia, sitting in regular session this 2nd day of July 2024, that the Town Council hereby appoints Nathan Smythers as Acting Building Official for the Town of Pulaski, Virginia. This resolution is effective upon adoption and is hereby adopted this 2nd day of July 2024 by the duly recorded vote of the Town Council of the Town of Pulaski, Virginia as follows: Gregory C. Shannon Collins Mayor ATTEST _____________________________ Olivia C. Hale Clerk of Council Town Council Meeting Minutes Tuesday, June 18, 2024 1. The Mayor called the meeting to order at 7:49 p.m. and asked for a roll call. Gregory C. East- Absent James A. Radcliffe- Absent Mayor Collins- Aye Jeremy L. Clark- Aye G. Tyler Clontz- Aye Brooks R. Dawson- Aye Michael P. Reis- Aye 2. Councilman Reis lead the audience in the Pledge of Alliance. 3. Councilman Dawson gave the invocation. 4. The Mayor welcomed all in attendance and viewing online. 5. Modification to Public Session- No modifications were made. 6. Virginia Outdoors Foundation Draper Mountain Trails Grant Nate Repass, Outdoor Facilities Coordinator, reported that the Draper Mountain Trails project was recently chosen by the Virginia Outdoors Foundation, as part of their preservation trust fund, to be fully funded through this grant round. He stated the grant will help bring revitalization to the trails, to survey and separate the 100 to 60-acre parcel, which will generate more reportable plot to have better defined the boundaries. Part of the grant is to dedicate the acres as an open space under the Open Space Land Act to preserve that area as a park and green space for the Town. Mr. Repass stated we would need to maintain ownership, name the facility, and the rest of the grant money could be used to bring in a professional trail builder and designate a trails master planner. He reported the grant could also be used to replace several features on the trail including a 30ft wall ride, teeter totters and other wooden features that need updating. 7. Charter Amendments Effective July 1, 2024 Olivia Hale, Clerk of Council, reported that in October 2023 there was a public hearing held and a resolution adopted to make amendments to the Town Charter and those amendments were adopted in April by the General Assembly. She stated the amendments, effective July 1, would include the Mayor being included in the council, the Mayor will serve a four-year term, and the Mayor will now be allowed to vote, the Mayor will be included to determine a quorum, and the dates of the election for councilmembers have changed from May to November. Councilman Reis asked the Town Attorney if the Mayor, being elected a year and a half ago, still serve the term or does the change to the charter change his term. The Town Attorney stated he would research the question and have an answer at a later time. 8. Regional Commission Update Manager Day reported the Regional Commission is moving from Fairlawn to Christiansburg. 9. EDA Bylaws Manager Day reported the EDA changes to the bylaws regarding majority vote. Councilman Reis stated he had concerns regarding Article II, limitation of powers, regarding holding individuals responsible if their violating state law or board duties. July 5th Holiday Manager Day read a formal letter that was sent to Town Council regarding July 4th falling on a Thursday and request Council to consider to allow employees to also have Friday July 5th as an additional paid holiday. The motion was made by Councilman Clark and seconded by Councilman Reis to approve July 5th as an additional paid holiday for employees. Gregory C. East- Absent James A. Radcliffe- Absent Jeremy L. Consideration of June 4, 2024 Town Council Meeting Minutes The motion was made by Councilman Clark and seconded by Councilman Dawson to adopt the minutes as written. Gregory C. East- Absent James A. Council Comments Councilman Dawson stated he was excited to see the new Food City opening and it’ll help draw and support additional businesses in both the Town and County. Councilman Reis thanked the Convenience Center staff for their work and that’s a great service to our residents. Mayor Collins reminded listeners of the Music and Merchants Festival on Saturday and announced the street closures that will start occurring on Friday for the event. 14. Reis- Aye The following councilmembers and staff entered in to Closed Session: Councilman Clark, Councilman Dawson, Councilman Clontz, Councilman Reis, Mayor Collins, Town Manager, Mr. Day, Town Attorney, Mr. Farthing, and Clerk of Council, Ms. Hale. Councilman Clontz exited Closed Session before the discussion on VA Code 2.2-3711 (A) 3 Real Property Acquisition/Disposition. Return to Open Session 10:00 p.m. 17. The motion was made by Councilman Reis and seconded by Councilman Clontz to authorize the Town Manager to release the lien on the Tilly Building owed by Reynolds Performance and any other necessary documentation.
