HomeMy WebLinkAbout2000-19• Resolution 2000 -19 APPROVAL OF A CONTRACT FOR POLICE SERVICES BETWEEN THE TOWN OF PULASHI POLICE DEPARTMENT AND F&W MANAGEMENT CORD WHEREAS, the F&W Management Corporation has requested the Town to utilize four (4) Town of Pulaski Police Officers for the purpose of providing services to its properties within the Town of Pulaski, in accordance with the provisions in the grant obtained by F&W Management Corporation entitled, 1999 New Approach Anti-Drug Program, NOW, THEREFORE, be it resolved by the Town Council of the Town of Pulaski, Virginia, sitting in regular session on July 6, 2000, that the Town approves the contract between the Town of Pulaski, specifically, the Pulaski Police Department, and F&W Management Corporation, attached hereto and expressly made a part thereof. This resolution is effective upon adoption and adopted by duly recorded vote of the Town Council of the Town of Pulaski, Virginia on this 6th day of July, 2000 as follows: Lane RPenn - Aye Bettye H. Stewart, Jr., Mayor Attest: . < ~ (, °~" Patricia Pendergrast, Cler of Council .] PULASKI POLICE DEPARTMENT CONTRACT FOR POLICE SERVICES TffiS AGREEMENT, by and between the TOWN OF PULASKI, a political subdivision of the Commonwealth of Virginia, and F&W MANAGEMENT CORPORATION, a Virginia Corporation, having been duly entered into with an effective date of '7 - 7 -,~ ~ o 0 WTINESSETH: WHEREAS, the Town of Pulaski, through the Pulaski Police Department provides services to the F&W Management Corporation as outlined in this contract, located at F&W's properties within the Town of Pulaski, namely: 1. Washington Square Apartment Complex located at 205 Oakhurst Avenue, Pulaski, VA 2. Meadowview Apartment Complex located at 1021 Lee Hwy, Pulaski, VA 3 Projected Area, which is the Town of Pulaski; and whereas F&W .Management Corporation has applied for and obtained grant funds from the U.S. Department of Housing and Urban Development for the 1999 New Approach Anti-Drug Program. NOW THEREFORE, in consideration of the terms and conditions herein contained and other good and valuable consideration, receipt of which is hereby acknowledged, the parties hereto agree as follows: • 1. During the term of this contracf and any extensions or renewals thereof, the Pulaski Police Department of the Town of Pulaski agrees to provide the services as described herein, and F&W Management Corporation shall provide monetary compensation equal to the salary and all fiinge benefits, to the Town ofPulaski for the four (4) Police Officers assigned the specific duties of this contract. 2. The four (4) additional officers will be covered under the Town of Pulaski's Comprehensive General Liability insurance, Automobile insurance, and Workers' Compensation insurance. 3. The Pulaski Police Department will hire and train four (4) additional police officers for the duration of this contract, (which shall terminate within two years from May 10, 2000, unless otherwise extended) to provide the services as outlined herein. 4. The Pulaski Police Department will be responsible for the officers' training, equipment, supervision, and the administrative oversight of all employee activities. S. F&W Management will maintain all records relating to the 1999 New Approach Anti-Drug Program Grant and any expenditure thereof, and the Pulaski Police Department shall have the right to review any and all such records upon giving F&W Management ten days notice. 6. The Pulaski Police Department will assign the four (4) said officers to spend a minimum of seventy percent (70%) of their time at the three properties. The remaining thirty percent (30%) will be spent throughout the project area, which is the Town of Pulaski. These officers wiU provide service above the baseline now provided as indicated in the memorandum of understanding. The Pulaski Police Department will maintain the records regarding the baseline services. F&W Management shall have the right to review any and • DO I~ o~~ '~ ~~ all such records upon giving the Pulaski Police Department ten days notice. The officers will be responsible for the duties as stated in their specific job description. • 7. The Chief of Police will designate a Department liaison to meet and or discuss or correspond with resident leadership and management representatives on a routine basis, at least once a month, for the purpose of reviewing the enforcement and prevention efforts and planning for future changes or modifications. However, all modifications to this agreement must be made in writing and executed by all parties hereto. 8. Subject to the availability of grant funds, the F&W Management Corporation will continue to budget money to provide the additional security on the properties by the Pulaski Police Department, in accordance with the aforesaid grant. 9. All officers employed under this grant shall be under the supervision of the Pulaski Police Department Chief of Police and designated chain of command, and shall be subject to all rules, regulations, directives, policies and procedures of the Pulaski Police Department and the Town of Pulaski at all times. Officers are agents of F&W Management for the limited purpose of delivering no trespassing notices and or prohibitions (whether verbal or written) and are not under their supervision or control, and are not employees of F&W Management. 10. The four (4) officers funded by the 1999 New Approach Anti-Drug Program Grant will abide by and perform the general duties assigned to the position of Police Officer as outlined in Pulaski Police Department General Order 1-2 of the policy and procedure manual. The officers will perform the duties described in the attached "Police Officer, Town of Pulaski Police Department, Grade 7" job description in addition to the following: • Officers are to provide a detailed, written account of all major incidents (i.e., robbery, fire, shooting, arrest) and any incident involving a property resident. • • Report any unsafe condition and hazard such as broken windows, light outages, etc. • Notify the property manager(s) of any scheduled time off or absence relating to sickness or emergency. • Retain an updated resident list to be available at all times. • Patrol the complex on foot, bike, and/or by vehicle. • Ensure all common area buildings aze secure, investigate suspicious vehicles, persons, and activities. • Be familiar with and be in strict compliance with Fair Housing and Landlord Tenant Laws. • Respond to all resident police related complaints. • Update and maintain the Trespassing manuals at both complexes and correlate it with the notices at the Police Department. • Coordinate the Crime Watch Program in the community and attend all meetings held within the complexes. Use problem-solving techniques to identify concerns and work with the community to resolve the problems. (Build acommunity- oriented policing relationship.) • Actively participate in all functions held within the community, as authorized by the Pulaski Police Department. • Proactively provide continuous police service to the residents within the community of the F&W Management Corporation. F&W Management Corporation hereby represents that it has adopted and approved this • contract at a regularly scheduled and properly noticed meeting of their Boazd of Directors as required by law. • ENTIRE AGREEMENT: No modifications of the Agreement shall be allowed unless in writing and signed by the parties hereto. FURTHER DOCUMENTS: Each party agrees to execute any and all documents, instruments, or further writings or documents which maybe necessary or appropriate to effectuate the terms of this Agreement. SEVERABILITY: >f a Court of competent jurisdiction at any time holds that a portion of this Agreement is invalid, the remainder shall not be affected thereby and shall continue in full force and effect. VOLUNTARY EXECUTION: The parties acknowledge that they are entering into this agreement freely and voluntarily and that no coercion, force, pressure or undue influence has been used in the execution of this agreement, either by the other party hereto or by any other person or persons; that they have ascertained and weighted all facts and circumstances likely to influence their judgment herein, that they have sought or had the opportunity to seek and obtain legal advice independently of each other or have freely waived such opportunity; and that they clearly understand and assent to all provisions hereof. All questions pertinent thereto, have been fully and satisfactorily explained to them; that the settlement embodied in this agreement is in all respects acceptable to them, and that accordingly they assent to aU the provisions hereof. INTERPRETATION: This agreement shall be interpreted in accordance with the laws of the State of Virginia.
