HomeMy WebLinkAbout2001-23RESOLUTION 2001-23 Authorizing the Town Manager to Enter Into An Agreement Between the New River Valley Planning District Commission And the Town of Pulaski For Flood Mitigation Plan WHEREAS, portions of the Town have been subject to periodic flooding resulting in loss of property; and, WHEREAS, reduced flood insurance rates through the National Flood Insurance Program/Community Rating System may result from a Flood Mitigation Plan; and, WHEREAS, the Community Rating System (CRS) floodplain management activities provide enhanced public safety, a reduction in damage to property and public infrastructure, avoidance of economic disruption and losses, reduction of human suffering, and protection of the environment; and, WHEREAS, a community can evaluate the effectiveness of its flood program against a nationally recognized benchmark; and, • WHEREAS, a CRS community's flood program benefits from having an added incentive to maintain its flood programs over the years; and, WHEREAS, implementing some CRS activities, such as floodplain management planning, can help projects covered under this plan qualify for certain other federal assistance programs such as the Flood Mitigation Assistance Program (FMA), the Hazard Mitigation Grant Program (HMGP), and the U. S. Army Corps of Engineers; and, WHEREAS, the Town has recognized the importance of additional Flood Mitigation planning; and, WHEREAS, the PDC is authorized by Chapter 42 of Title 15.2 Code of Virginia (a950) as amended, to assist local governmental units in planning their development; and is working toward a New River Valley All Hazards Mitigation Plan. NOW, THEREFORE, be it resolved by the Town Council of the Town of Pulaski, Virginia that the Town Manager is hereby authorized to enter into an agreement as shown in attachment "A", attached hereto and made a part hereof as if expressly set forth herein, on behalf of the Town with the New River Valley Planning District Commission for a flood mitigation plan. • • This Resolution is effective upon adoption and is hereby adopted this 2°a day of October, 2001, by recorded vote of the Town Council of the Town of Pulaski Virginia, as follows: Jeffrey S. Stewart, Jr., Mayor • ATTEST: Patricia Cruise, Clerk of Council • • Agreement Between the New River Valley Planning District Commission And the Town of Pulaski For Flood Mitigation Plan This agreement, entered into October 2, 2001, by and between the New River Valley Planning District Commission, hereinafter referred to as the "PDC", and the Town Council of Pulaski, Virginia, hereinafter referred to as the "Town". Funding The Town agrees to provide $9,000 in planning funds. 2. Scope of Work Required of PDC The PDC agrees to provide the technical assistance and staffing to develop a Flood Mitigation Plan, which will include a CRS application. Should funds become available for the preparation of a New River Valley All Hazards plan, this scope shall be expanded to include consideration of • all hazards. . 3. Time of PDC Performance The PDC agrees to commence performance of the activities called for herein, in compliance with the terms and conditions of this agreement, on this date and agrees to complete performance of the same by September 30, 2002. 4. Duties and Responsibilities The PDC agrees to do the following elements as a part of the Flood Mitigation Planning process, which correspond to the CRS credit system: * Organize to prepare plan. * Involve the public. * Coordinate with other agencies. * Assess the hazard. * Asses the problem. * Facilitate the setting of goals. * Review possible activities. * Draft, an action plan. * Recommend a flood mitigation plan for adoption. 5. Duties and Responsibilities of the Town The Town agrees to do the following: . * Provide or make available all known data and information on flood incidents and hazards as well as related documents such as maps, including electronic files if available. * Appoint a planning committee to include pertinent town employees, business owners, and residents; and appoint or recognize a point person who will officially lead the planning committee. * Provide engineering services. 6. Compensation and Method of Payment The County agrees to pay the PDC, cash consideration not to exceed $9,000.00, which will constitute full and complete payment for the PDC's work and activities as set forth herein. Such sums will be paid in the following manner in every case, subject to receipt of the PDC's invoice for the payment. Such invoice shall specify the PDC expenditures to the date of the invoice. Invoices shall not be submitted more often than once a month. It is expressly understood and agreed by all parties hereto that in no event will the total funding to be paid to the PDC hereunder exceed the maximum sum of $9,000.00. It is further understood that the PDC will request payment for only those costs that are incurred by the PDC in the fulfillment of the work responsibilities outlined herein. Specifically, if the PDC is able to fulfill its obligations with actual costs less than $9,000.00, the Town will retain the difference. • • • 7. Ownership and Status of Documents All project documents produced under this Agreement becomes the property of the Town upon the completion. The PDC is entitled to permanently retain appropriate copies of all project documents for reference purposes. Any report, information, data, etc., given to, prepared or assembled by the PDC under this Agreement shall be kept confidential by the PDC until released or approved for release by the Town. 8. Amendment This contract may be amended from time to time by written agreement of the PDC and the Town and shall be subject to re-negotiation if such amendment results in a change in the scope of services, compensation, and method of payment.
