This Ordinance is effective upon adoption and is adopted by duly recorded vote of the Town Council of the Town of Pulaski, Virginia, on this 16th day of August, 1994, as follows: John A. The purpose of this policy is to adopt regulations controlling and regulating smoking by all persons in portions of town-owned and controlled buildings and work areas and to direct and authorize the town manager to develop and implement smoking policies and procedures for town personnel and visitors in remaining areas of such buildings and work areas. The basic goal of the town will be to provide a comfortable, smoke-free environment for its employees and visitors, and to eventually eliminate smoking through a combination of bans and educationaUmedical programs which may be instituted in the future. However, in recognition of the fact that nicotine products have been demonstrated to be addictive in nature and that it would be a hardship on many employees to have an immediate total ban on all smoking in town facilities, this policy is intended to give the town manager and department heads the flexibility they need to balance the best interests of the town, the protection ofnon-smokers, and the needs of smokers. ADMINISTRATION Sec. 1.1. Authority; definitions. • The town is authorized by its Charter, by general law, and as the owner of property anti the employer of personnel to regulate the use of its buildings and the conduct of its personnel. This policy also complements and parallels the authority found in the Virginia Indoor Clean Air Act, § 15.1-291.1, et seq., Code of Virginia. The definitions used there also apply here. Sec. 1.2. Areas Where Smoking Is Prohibited. It is forbidden for any person to smoke in any of the following areas of town-owned or controlled buildings or public places: (1) Elevators, regardless of capacity; (2) Common areas in any municipal building open to the public including, but not limited to, offices normally open to the public on an unrestricted basis, hallways, restrooms, and public meeting rooms; (3) Indoor service lines and cashier areas; (4) Public conveyances. • Smoking Policy Proposed jorAdoplion on 8/!6/94 Pagel Sec. 1.3. Other Areas of Town-Owned and Controlled Buildings and Work Places. • (a) The town manager shall provide in all other areas of town-owned and controlled buildings or enclosed public space reasonable smoking, and no smoking areas, considering the nature of the use and the size of the building. The town manager shall post as appropriate signs stating "Smoking Permitted" or "No Smoking." (b) Designated smoking areas shall not encompass so much of the building structure, space, place, or area open to the general public that reasonable no smoking areas, considering the nature of the use and the size of the building, are not provided, or, that such no smoking areas are contaminated by smoke emanating from smoking areas. (c) Designated smoking areas shall be separate to the extent reasonably practicable from those rooms or areas entered by the public in the normal use of the particular facility. (d) In designated smoking areas, ventilation systems and existing physical barriers may be used when reasonably practicable to minimize the permeation of smoke into no smoking areas. However, this article shall not be construed as requiring physical modifications or alterations to any structure. (e) The town manager shall develop and implement further policies and procedures governing smoking in parts of town-owned and controlled buildings or work areas not • open to the general public in the normal course of business, except by invitation. The town manager shall enforce these policies and procedures through administrative methods. Any total ban on smoking in any entire building shall only be enforced by the town upon an affirmative vote of a majority of the affected employees voting. (f) Nothing contained herein shall be construed to limit the authority of the Town Manager or Department Heads to determine that it is in the best interest of the Town to restrict or ban smoking by employees under their supervision while on duty. Sec.1.4. Signs. (a) No person shall smoke in a designated no smoking area. Any person who continues to smoke in such area after being asked to refrain from smoking may be directed to leave the premises by any town employee. Any person who fails to either refrain from smoking or leave the premises may be considered a trespasser. (b) Any town employee who violates this Article or any rules and regulations promulgated by the town manager hereunder, may be subject to internal disciplinary action as well as any other penalty.
