RESOLUTION NO. 96-13
AITJ'HORIZING CONDEMNATION PROCEEDINGS
FOR A SANITARY SEWER LINE
ACROSS THE PROPERTY OF DALLAS L. AND BETTY H. COX
WHEREAS, inspection and testing of the existing Wumo Sanitary Sewer has shown that it is a
significant source of infiltration/inflow and it has been determined that a new line is necessary to
eliminate infiltrationlinflow and, the Town Council has determined that a public need for the new
line exists, and
WHEREAS, the Town has obtained easemer-ts from various property owners for the construction
and maintenance of a sanitary sewer line to serve this area of the Town; and
WHEREAS, the Town has made bona fide offers to purchase an easement for said sewer line
across property belonging to Dallas L. and Betty H. Cox but the property owner had declined to
respond to such offers; and,
WHEREAS, the Town Council has determined that a public need exists for an easement across the
property of Dallas L. and Betty H. Cox for the construction and manrtenance of said sewer line;
and
i NOW, THEREFORE, be it RESOLVED by the Town Council of the Town of Pulaski, Virginia,
sitting in regular session on April 16, 1996, that
1. The Town Attorney is authorized and directed to file condemnation proceedings against the
property of Dallas L. and Betty H. Cox for an easement for the construction and maintenance for a
sanitary sewer line to serve the Wumo area, and to seek an immediate right of access for such
purposes; and,
~ 2. The Town Finance Director is authorized to pay the sum of eight hundred dollars ($800.00) into
the Circuit Court of Pulaski Courrty in the manner prescribed bylaw, as the fair market value of
such easemerrt, so that the Town may have immediate access to the property.
This Resolution is effective upon adoption and is adopted by the duly recorded vote of the Town
Council of the Town of Pulaski, Virguua, on this 16th day of April, 1996, as follows:
