Minutes of a special meeting of the Town Council of the
Town of Pulaski, Virginia, held on the 10th day of May, 1957, at 4 p. m. in
the municipal office.
There were present: Mayor C. V. Jackson, presiding.
Councilmen: W. F. White, W. A. Larson, J. R. Martin,
F. L. Carrico, I. R. Carper, W. S. Cummings,
W. H. Wysor
Absent: A. E. Lemons
Also present: Town Manager: T. B. Noland
Acting Clerk: Gladys R. Dalton
Town Attorney: Garnett S. Moore
Visitors: A. M. Harman, Attorney for Virginia Oak Flooring Co.
On motion of J. R. Martin, seconded by 'r~'. H. Wysor, it was
unanimously
RESOLVED, that Gladys R. Dalton act as Clerk in the absence
of Audrey Eidson, Clerk.
riayor Jackson said the meeting had been called to consider
certain encroachments existing on Dora Highway and Maple Avenue, in the
Town of Pulaski, of certain buildings belonging to Virginia Oak Flooring
Company, Incorporated. Whereupon, Garnett S. l~.oore, Town Attorney, read
an Ordinance which had been prepared, permitting certain encroachments
on Maple Avenue and Dora Highway, which said Ordinance is set out in
detail herein.
AN ORDINANCE TO PERMIT CERTAIN ENCROACHMENTS
ON MAPLE AVENUE AND DORA HIGHWAY IN THE TOWN
OF PtTLASKI, VIRGINIA, PURSUANT TO THE PROVISIONS
OF SECTION 15--776 OF THE CODE OF VIRGINIA
WHEREAS, certain encroachments existed on January 1, 194$, on
Dora Highway and Maple Avenue, in the Town of Pulaski, of certain buildings
belonging to Virginia Oak Flooring Company, Incorporated; said encroach=
ments being as shown by a certain Plat of Survey entitled, "Plat Sho~ring
Virginia Oak Flooring Company Buildings Located at Pulaski, Virginia,
Scale 1 inch equal 20 feet, July 7, 197", prepared by E. H. Millirons,
Registered Professional Surveyor, a copy of which Flat is hereto affixed
and made a. part hereof by reference, and
WHEREAS, application ha.s been made to the Council of the
Town of Pulaski to permit and authorize such encroachments to continue
to exist pursuant to the provisions of Section 1.5-776 of the Code of
Virginia, as amended. Now, therefore,

Be it ordained by the Council of the Town of Pulaski,
pursuant to Section 15-776 of the Code of Virginia, 1950, as amended, than'
t he encroachments of buildings of the Virginia Oak Flooring Company,
Incorporated, on Dora Highway and Maple Avenue, in the Town of Pulaski,
as shown by the Plat hereto affixed be and the same are hereby authorized .'
and permitted, and the owner of said buildings, its successors and
assigns, are permitted and authorized to occupy that portion of Dora
Highway a.nd Maple Avenue as shown by said Flat, and to maintain such -
encroachments as the same existed on January 1, 1948, until such buildings',;,
or structures are destroyed or removed; provided, that nothing herein
contained shall be construed to relieve said owner of any negligence on
its part on account of such encroachments, and the to-~an is expressly re-
lieved of any liabi-lity whatsoever by virtue of the existence of said
encroachments. '
There being an emergency existing in the opinion of the
Council, this ordinance shall be in full force and effect from passage.
On motion of F. L. Carrico, seconded by W. H. Wysor, it was
unanimously

The Town I~ianager explained that Town Officers had con- +

fiscated a 1957 Chevrolet Sedan which had been driven an],y 3,700 miles, be~~i-
cause the car was being used to transport illegal whiskey. In disposing
of the case the Court might allow the Town to take title to the car if the°'~;
Town would pay off the lien on the car, which lien and legal costs may
amount to about $830.00. It was further expla:~ned that possibly the Town
could trade the Pontiac Police car, which has been driven about 50,000 miles
for a new three wheel motorcycle, a vehicle needed by the Police Department;
and which is valued at about X1340.00.

RESOLVED, that'the Town Manager shall attempt to wor1~ out
t he best possible exchange between the automobile and the motorcycle,
with the understanding that the confiscated car would be placed in
police service to replace the Pontiac.
The meeting adjourned at 5:00 p. m.
