HomeMy WebLinkAbout04-03-53~~~~~ SPECIAL MEETING PRESENT Council Minutes Town of Pulaski, Virginia was held in the Municipal Pulaski, Va., April 3, 1953 A special meeting of the Town Council of the Building at 4 p.m., April 3, 1953. There were present: Vice-Mayor W'. F. White, presiding Councilmen: I.R. Carper, 0. 0. Crowell, J.C. Crumbley,Jr., J.L.Kesling, ~.` W.Marshall, J.R.Martin. Absent: C.V. Jackson. Also present: Town Manager: Julian F. Hirst Clerk : Louise D. Logan Town Attorney: Garnett S. Moore The Town Manager advised that the Virginia Department of Highways required either a bond from the Town, saving the Commonwealth harmless from any injuries or damages as a result of construction work by the Town on State roads, or a minimum of X300.00 cash deposit, and that the Town planned to do construction work on Peppers Ferry Road in connection with the Pico Terrace mater Line reclocation. ORDINANCE On motion duly made by I. R. Carper, seconded SAVINGHARMLESS by 0. 0 Crowell and unanimously carried, the following VA.DEPT.OF ordinance xvas adopted: HI G~'AYS AN ORDINANCE TO OBLI GATE THE TOWN OF PULASKI TO HOLD HARMLESS THE COMMONWEALTH OF VIRGINIA FOR ANY AND ALL DAMA(~S ARISING OUT OF THE GRANTING BY THE VIRGINIA DEPARTMENT OF HIGHWAYS OF PERMITS TO THE TOWN OF PULASKI, VIRGINIA, FC}R USE 0 F RI GHT O F WAYS 0 F THE VIR GIN IA DEPARTMENT OF HIGHWAYS BY THE TOWN OF PULASKI FOR INSTALLATION, CONSTRUCTION, MAINTENANCE AND OPERATION OF PUBLIC UTILITIES ALONG, ACROSS, OVER AND UPON SAID RIGHT OF WAYS . BE IT ORDAINED by the Council of the,Town of Pulaski, Virginia, that the Town does hereby bind and obligate itself to hold the Commonwealth of Virginia harmless for any and all expense, damages, or in3ury, which may be sustained by the Commonwealth of Virginia growing out of the granting to the said Town of Pulaski by the Virginia Department of Highways permits for installation, construction, reconstruction, maintenance and operation of certain public utilities along, across, over, and upon the Highway System of Virginia, the said obligation to be binding upon the Town in the following form: KNOW ALL MEN BY THESE PRESENTS, That the Town of Pulaski, a municipal corporation of the State of 1 ~' J ~~± jV Council Min. Pulaski, Va., April 3,x,1953 1 1 Virginia, is held and firmly bound unto the COMMON~i'EALTH OF`' VIR QINIA, in the full and just sum of ONE THOUSAND DOLLARS 01,000.00) current money of the United States, to be paid o the said Commonwealth of Virginia, to the payment whereof i~3 hereby binds itself firmly by these presents, sealed with i#fs seal and dated this 3rd day of April, A.D. 1953. W HEREAS, it becomes necessary from time to time for°the Town of Pulaski to obtain permits from the Virginia Departmennt of Highways to install, construct, reconstruct, maintain, acid operate certain public works along, across, over and upon tl~le highway system of Virginia; and UWHEREAS, expense, damage or injury may be sustainedby the Commonwealth of Virginia growing out of the granting to4~aid Town of Pulaski by the Virginia Department of Highways of sa~~.d a permits for the work aforesaid; and ` W'~iEREAS, one of the conditions of such permit or pefnits is that the Town of Pulaski shall idemnify the Commonwealth&of Virginia against all damages and injuries to the highways ar~a bridges and to persons or property lawfully upon such highwa~'s. NOVA, THEREFC3RE, the Condition of this obligation is ;such that if the said Town of Pulaski shall in all respects comp7.~' with all the conditions of permit or permits that have been, or will be, granted said Town of Pulaski, and shall indemnify and safe harmless the Commonwealth of Virginia against and from all 1~Dss, cost expense, damage or injury to highways and bridges and persons and property lawfully on such highways, growing out ~bf the granting of such permit or permits to said Town of Pulas~~i, then this obligation to be void, otherwise to be and remain n full force and virtue. BE IT FURTHER ORDAINED that this ordinance shall be n L full force and effect immediately upon its passage. On motion duly made by I. R. Carper, seconded by J.CN1 Crumbley, Jr., it was unanimously RESOLVED, that an agreement with Fby Aust,~dated 31,r. March, 1953, covering water line extension as approved by Council Conttd. ~~ ti~.~~ Council Minutes Contd. Pulaski, Va., April 3, 1953 in meeting of March 27, 1953, be approved and that said agreement be filed by the Clerk of the Council with permanent records of the 'down.
