There were present: ~~ Mayor C..V. Jackson, presiding Councilmen; I. R. Carper, 0. 0. Crowell, J. C. Crumbley, Jr. , V1&. A. Lars pn, J.R. Martin, T~. F. White, F.16.Mf~irshall. Absent: J. L. Kesling. Also present: Town Manager: Julian F. Hirst Clerk: Louise D. Logan The Mayor stated the purpose of the meeting tMas to ®ff~ially approve the agreement with the Pulaski County school Board regarding the Fico Terrace water line, and to further s to c~ the budget. On motion duly made by J. R. Martin, seconde« by 0. 0. Crowell, it was unanimously RESOLVED, that the following agreement betwebot~ the Town of Pulaski, Virginia and Pulaski County School Bi`ard be entered into the Minutes. 1 THIS AGREEMENT made and entered into this 3tth day of May, 1953, by and between the Town of Pulaski, Virginia, a municipal corporation, party of the first part, and Pul~ki County School Board, party of the second part; -W IT1~tESS ETH- THAT WHEREAS, by deeds of easement, one date March 27, 1937, and of record in the Clerkf s Office of th~~ Circuit Court of Pulaski County, Virginia, in Deed Book Idd. ?9, page 415, and a second dated March 27, 1937, and of record in the aforesaid Clerkts Office in Deed Book No. 78, page 54~+, the party of the second part did grant and deed unto the part' of the first part easements for constructing, placing, and 1 maintaining a water line in and over certain property which it owned and which is known as the Pico Terrace School pr~erty; and, VI~HEREAS, the party of the second part now co~itemi plates the er®ction and construction of certain new school buildings for high school purposes upon said property, and because of. said construction it becomes necessary to remoi±e or relocate the of oresaid water lines. Pulaski, Va. ,May 21, 1953 and the mutual covenants hereinafter set out, and in the further consideration of the payment to the Town of Pulaski by the County Sehool Board of Pulaski County, Virginia, of the sum of Ten Thousand Dollars (~10,000.Ofl) toward the cost of relocation of the water line which now crosses in a west-east direction the Pico Terrace School property, the receipt of which i.s hereby acknowledged, the parties hereto do agree as f ollowa : (1) The Town of Pulaski hereby agrees to release and quit-claim, and by these presents does release and quit- claim, to the School Board of Pulaski County, all its right, title and interest in and to the easements aforesaid, with the exception, however, that there is reserved to the said Town an easement for the portions of the aforesaid water lines which are needed to serve the buildings now on said property and the buildings to be erected thereupon. ' (Q) The party of the first part will move the aforesaid existing water line and relocate it, and pay any and all additional expense necessary to the said relocation of the lines over and above the Ten Thousand Dollars (10,000.00) contributed by the party of the second part. (3 ) The Town of Pulaski will furnish the party of the second part water for normal consumption at the new high school for a period of ten (10) years at fifth' percent (50~) of the regular monthly rate which is charged elsewhere in the Town of Pulaski for similar services, at the time water is furnished, said volume of water consumed to be determined by a properly installed meter for this purpose. This part of the agreement-to commence upon completion of the said school build- ing and upon the beginning of its normal use of water for daily operations . (4) The Town of Pulaski will leave upon the said school property such portions of the now existing l2-inch line as are necessary to serve both the existing and th® new school buildings, under the easement hereinabove excepted and reserved. (5) The party of the Pirst part is to have, free from any claims of the party oP the second part, all materials such as' fire hydrants, valves, pipes, eta., removed or to be removed from the Pico Terrace Sehool property, 2 ~!1 3 © C Council Minutes Conttd. (6 ) The party of the first part is to begin removal of the aforesaid pipe line at its earliest convenience, anc~ to continue same as promptly as is possible until said removal and relocation is completed. (7) All necessary privileges of ingress and egx~flss are hereby granted to the party of the first part by the patty of the second part for the carrying out of this agreement, end for the continued use of the easement reserved.
