PETITION There was presented a petition from the resid!~nts RE.W .D .RANKIN ABC LIC. in the vicinity of Peirce Avenue, and another petition front' members of the Pentecostal Church of God, voicing objectionto the application of William D. Rankin for ABC license at Puce Avenue Grill on Peirce Avenue. Resolution On motion duly made by 0. 0. Crowell, seconded by J. R. Martin, and carried by~a unanimous vote, the following resolution was adopted: WHEREAS, there was presented to the Council i~~is 4th day of December, 1951, a petition signed by twenty-nin~!of the residents in the vicinity of Peirce Avenue, and WHEREAS, a petition signed by forty-one of t'~ members of the Pentecostal Church of God, located in the itnediate vicinity of Peirce Avenue, was also presented, and i WHEREAS, both these petitions voiced objecti4l~ to the proposed application of William D. Rankin for license 1{b sell alcoholic beverages on and off premises in the Peirce Aventib Grip., and WHEREAS, it is the opinion of the Council that, because of the residential area adjacent to the location a~ifd other immediate surroundings, the denial of an A.B.C. lice~ise as requested by the petitions is desirable; ~~ NOW THEREFORE, BE IT RESOLVED that by copy othis resolution•to.the Virginia Alcoholic Beverage Control Boarj, the same is requested to consider the desires of the local` residents in considering application of W. D. Carper, it was unanimously RESOLVED, that the following,appliaations -lacksos for building permits be approved: To Fred A. Jacks on for frame dwelling west side of Hickory Avenue, between 6th and 8th Streets, estimated 4,000.00; Old Dominion -Old Dom.S'.Ln. Small Loan, Inc. (by J.J.Jones) for neon sign 11 West ~IFhiting Oil Main Str®et, estimated, 100.00; Whiting Oil Company (by William J. Whorrell) for gasoline storage tanks- 1 at First St. Extension and. l at East Main Street, estimated X275.00 and X200.00 respectively: -Linville An application for building permit by Mrs. Rachel B. Linville for six-room cinder block dwelling at 515 Stuart Avenu®, estimated X2,000.00 was not approved, pending further information from the applicant and approval of the Building Committee. DR.C.P.POPE Dr. C. P. Pope appeared before the Council DRAINAGE ON 7TH N.RP, and requested that action be taken to improve the drainage condition in front of his residence on Seventh Street, North, near Jefferson Avenue. It was stated that, as a result of the roof drains from new houses in the vicinity being discharged onto the street, there was a considerable ditch in front of the house, which was objectionable, and it was felt that the Council should take action to improve the condition. The_.matter of deep gull~g. in front of the residence of Dr. C. P. Pope on Seventh Street,N. was referred to the Street Committee and Town Manager for investigation and report. CE'RTIFICATES' The applications for renewal of certif icates PUBLIC CONVENIENCE & NECESSITY ~ convenience and necessity for the taxis were pre- 1952 sented. The Chief of Police reported in particular with regard to certain conditions that appeared objectionable in the operations of Redd~s Cabs. Reuben ' Hash appeared before the Council in regard to this matter. On motion duly made by J. R. Martin, seconded by I. R. Commerce Street, between Lagrange and Lake Stree ts. .4 p1a$t showing-the encroachment was presented. It was reported b~ the Street Committee that they had viewed the situation and did not 1 consider the continuance of the encroachment to be object3~nabley since none of the alleys in Block 115 were open. Painter, and carried by a unanimous vote, the follo ~.ng ordinance was adopted; ORDINANCE AN ORDINANCE TO PERMIT AN ENCROACHMENT ON AN ELEVEN FOOT ALLEY ENCROACHMENT IN SECTION 115, AS SHOWN ON THE MAP OF THE TOWN OF PULASKxy ALLEY SEC. VIRGINIA. 115 BE IT ORDAINID by the Council of the Town -c Pulaski, Virginia, pursuant to the authority of Section 1~~-776 of the Code of Vir ginia, 1950, as amended, that the encros~~hment of a building located on lots 10 to 15 inclusive , Section ~~L15, as shown on a map of the Town -of Pulaski, Virginia, on an eleven (11) foot alley running northerly and southerly inlaid S'ectiori 115 be, and the same is, hereby authorized and pex~#nitted i ,; i~:i~ Council Minutes Conttd. CON. & NEC. -Redd -Hash 1 -Hash Pulaski, Va.~ Dec. 4, 1951. and the owners of said building and its successors in title are permitted and authorized to occupy said alley and to maintain such encroachment as the same existed on January one, nineteen hundred forty-eight until such building or structure is destroyed or removed, provided, however, that nothing herein contained shall be construed to relieve said owner of any negligence on its part on account of any s~xch encroachment, and the Town is expressly relieved of any liability whatsoever by virtue of the existence of said encroachment. There being an emergency existing, in the opinion of the Council, this Ordinance shall be effective from passage. On motion duly made by I. R. Carper, seconded by W'. F. White, it was unanimously RESOLVED, that the following certificates of public convenience and necessity previously in effect are hereby renewed, sub~eet to all the terms and conditions of the Taxicab Ordinance for the year ending December 31, 1952: 19. The matter of T. D. & J. C. Lawson operating three cabs, of which two were operated on a part-time basis was discussed. On mot ion duly made by E. T. Painter, seconded by I. R. Carper, it was unanimously BUSINESS RESOLVED, that a refund be granted to Mark E. Prue LICENSE REFiTD1D for retail merchants license issued November 1, 1951, it being _Mark Pr ice reported that the applicant was unable to obtain suitable buillding location for operation of the business, and that no business ilras a conducted on the license granted. TRAFFIC LIGHT " INTERSEC _ TION The matter of proposed improvements at the inter~ectiom FIFTH & WASH. of Fifth Street and ~1'ashington Avenue to relieve traffic constion was discussed, and it was reported that H. ail. Huff, Jr. had indicated the probability that satisfactory arrangements could ' be made on obtaining the necessary right-of-way. It was alsoa, reported that the type of signal installation required could ~e used in event some modification of the plans were neeess-ary. On motion duly made by 0. 0. Crowell, seconded b J. R. Martin, it was unanimously Purchase RESOLVID, that the purchase of traffic signal for signal ~' auth. Fifth and ~'ashington be authorized from the funds available f~fr improvement of the intersection. SUPPLEMEAITAL On motion duly made by I. R. Carper, seconded by~~ APPROP. E. T~ painter, it was unanimously Parking Meters RESOLVED, that a supplemental appropriation of Seven Hundred Twenty Six (~'72~.00) Dollars from the General Funds be authorized for payment of eleven additional parking ~' 1 meters previously ordered. PETITION A petition from 24 residents in the vicinity of l~'ATER EXTENSION Case Knife Road for water extension was presented. It was CASE KNIFE ROAD decided that this matter should be deferred and placed in line with other pending projects for extensions of water and sewer servic®s. It was reported by 0. 0. Crowell that J. W. Snit was agreeable to providing a twenty-five foot right-of-way on 1~.~ ~~. Council Minutes Contt d. HANEY STREET CHECKER CAB STAND MONTHLY PAYROLL EARLIER IN DEC. APPROPRIATION XMAS PARTY Pulaski, Va., Dee. 4, 1951 Park Lane, and to deed the Town his rights to any water lines serving the vie3lity. It was determined that the Street Committee, Town Manager and Town Attorney should further investigate the matter of right-of-way for Park Lane and Haney Streets and report their recommendation to the. Council. The matter of access to and from the Checker Cab Stand on South Washington Avenue was discussed, and it was determined to drop further consideration of this matter. On motion duly made by I. F.. Carper, seconded by W. F. White, it was unanimously RESOLVED, that the monthly payroll checks for December 3l, 1951 be issued December 20th. On motion duly made by W. F. White, seconded by I. R. Carper, it was unanimously RESOLVED, that an appropriation of One Hundred (100.00) be provided for expenses in connection with a Town employee Christmas party. FILTER PLANT It was reported that it was necessary to ADDtTL OPERATOR NEIDED - operate the water filter plant on a twenty-four hour basis, particularly during the present time, when W'a~den Springs water was used as an auxiliary supply, and careful attention was required in softening and treating the water. It was stated that an additional operator over and above the number provided. by the original budget was required. SIIPPLEMENT~, APPROPRIATION M~SH~ On motion duly made by W+. F. White, seconded by J. R. Martin, it was unanimously RESOLVED, that a supplemental appropriation in the amount of 1,750.00 -One Thousand Seven Hundred A,nd Fif ty Dollars-be provided for payment of salary for operator at the water filter plant. The matter of certain residents contending that Mashburn Avenue was not in the corporate limits, particularly the case of R. F. Hughett, who had failed to purchase Town license tag because of the controversy _ _ ~ in regard to corporate limit line in this vicinity. It was stated that, according to the survey made by Mr. E. H. iViillirons~ for the Town and appeared defintelg that the Mashburn Avenue section was in the corporate 1 units . LEAGUE Mr. E. L. Thacker, 'Field Consultant cif the Virgir3~.a REPRE. - League of Municipalities, discussed with the Council some oP t~e legislative matters that -probably would be brought before the General Assembly.
