MINUTES The minutes of the meeting held November 10, 1949 were read and approved. T.V~.KERSEY Mr. T. SIP. Kersey appeared before the Council to request that, when the existing Commerce Street Bridge is removed, as much as necessary of the same be used to build a bridge to the Kersey Bottom Addition, to be located on Palmer Avenue to cross Peak Creek. PBr. Kersey stated that he felt that he could constr~,zct the requested bridge at a cost of 1,000.00. This matter tivas deferred for future consideration. SEWER EXT. On motion of H. R. Imboden, seconded by OtNeal OFF 0 F5th Amos, it was unanimously PARALLEL RANDOLPH RESOLVED, that the Town accept the offer of Sam Martin to contribute Three Hundred (300.00) Dollars and Martin- Lee Boothe Two Hundred (200.00) Dollars toward the cost of Boothe offer accepted constucting sewermai.n to serve their properties on Randolph Avenue, and that the construction of the sewer main be autho- rized to extend along Fifth Street to an alley parallel to Randolph Avenue and 3ust east thereto, and extend nor therly along the alley to an intersection with another alley, and further, that an appropriation cif' Seven Hundred And Two appropria- (~702.62,}~Dollars and Sixty Two Cents be authorized from the tion General Fund for the construction. Charles Warren Matherly T/A West End Cabs (2 tars ) FINANCIAL A financial statement covering the months of Septlmber STATEMENT and October was presented and discussed. The Town Manager state that in connection with the installation of the new system, there rem~iined the setting up of more adequate records in the control of water ~iccounts receivable, the General Fund necessary accounts receivable, and records on equipment in shop operations. He stated the basic installati~ln work had been completed and the the cost of the equipment and service~k of the State Auditor was within the appropriations for this projPet, bufi~ that it appeared, that there would be some additional cost to complete ;, the system as a number of difficult; es had developed. On motion duly made by T. F. Wirt, seconded by H.~. Imt~oden, it was unanimously ' _ COPIIMERCE RESOLVED, that the Mayor'be authorized to executbl, and STREET BRIT)GE the Clerk to attest the following contract with Trin?ile and Doby~is for PROJECT the construction of the Commerce Street Bridge: STANDARD FORM OF CONTRACT THIS AGREED,ZENT made the fifth day of October in t]~e year Nineteen Hundred and forty nine by and between Trinkle & Do~lyns, Dublin, Virginia hereinafter called the Contractor, and Town of ~tzlask3.~ Virginia hereinafter call led the Owner, V~'ITNESSETH~ that the (3ontraetor and the Owner for the considerat$;ons hereinafter named agree as follows; Article 1. Scope of the Work - The Contactor shall furnish all !~f the materials and perform all of the work shown on the Drawings and described in the Sx~ecifications entitled "Commerce Street Bridge Pulaski, Virginia^, prepared by Lublin, McGaughy & Associates, 7~0 Front Street, Norfolk 7, Virginia, acting as an i.n these Contract Documents entitled the Engineer and shall do everyt~i.ing required~by this Contract, the General Provisions of the Contract, the Speci~ica- tions and the Drawings. _ ~+ I ~1 ' 1~9~ Council Minutes Cont t d. Time of Completion - The Contractor will be required to commence work under the contact within ten (10) calendar days after the date of receipt by him of notice to proceed and to prosecute the said work with faithfulness and energy and to complete the entire work within 120 calendar days. In case of failure on the part of the Contractor to comp]e to the entire work tluithin the time limit-, the Contractor shall pay to the Town of Pulask i, Virginia the sum of15.00 for each calendar day of delay until the entire work is completed or accepted, providing however, in the event that the contractor is delayed in the completion of his contract by the failure on his part to secure steel for the pro3ect, and that said failure to secure steel is due to any strike of said steel industry, o~ of a strike in an industry which affects said steel production, and provided further that contractor has exercised due diligence in his effort to secure the steel, then in such event the number of says which the con tractor is dd.ayed shall be added to the one hundred and twenty (120) days allowed for said completion of bridge, before the penalty for such days delay as hereinabove provided shall begin to run; and the determination of the number of says ~of delay eha.ll be made by the engineer- and he shall so certify same. Article 3. Article 4. Progress Payments - The Owner shall make payments on account of the Contras t as provide d them in, as follows On or about the tenth (10th) day of each month payments will be made on estimates of the Engineer as to the amount of work which has been executed in accordance with the specifications up to the first (1st) day of that month and not included in any prior estimate, except that ten (10) per cent of the amount of each estimate will be retained until the Contract is fifty (50) per cent completed. After which the total amount retained will remain unchanged until comple tion and acceptance of all work under the Contract, when final payment is rre. de, Article 5. geeeptance and Final Payment - Upon receipt of written notice that the work is ready for final inspection and acceptance, the Engineer shall promptly make such inspection, J f'. 1 s ~.~3 Council Minutes Contd. -Pulaski, Va., November 21,:;1949 and when he finds the work acceptable under the Contract and thee:Con- tract fully performed he shall promptly issue a final certifiea~, over his own signature, stating that the work provided for in t s Contract has been completed and is accepted by him under the tes and conditions thereof, and the entire balance found to be due the C n- tractor, including the retained percentage, shall be paid to the Contractor at the office of the Owner within thirty da~r s after t~,e date of said final certificate. Before issuance of final certificate the Contractor shall submit;evi- dence satisfactory to the Engineer that all payrolls, materials fills, and other indebtedness cor_nected with the work have been paid. The making and acceptance of the final payment shall constitute waiver -of all claims by the Owner, other than those arising from+ unsettled liens, from faulty work appearing after final payment fr from requirement of the Spe cifications, and of all claims by the Contractor, except those previously made and still unsettled. If after the work has been substantially completed, full completion thereof is materially delayed through no fault of the Contractor and the Engineer so certifies, the Owner shall, upon certificate ~;of the Engineer, and without terminating the Contract, make payment ,of the balance due for that portion of the work fully comple ted and' accepted. Such payment shall be made further under the terms arx~! conditions governing final payment, except that it shall not constitute a waiver of claims. ' Article 6. The Contract Documents - The General Conditions of tie Contract, the Specifications and the Drawings, together with this Agreement, form the Contract, and they are as fully a part of th Contract as if hereto attached or herein repeated. A.E.P.COMPANY The Town Manager reported that he had made a -Street light 'adjustments survey with representatives of the Appalachian Electric Garner Avenue ~ -Dora Hwy. I OA~'OOD CEMETERY Council Committee appointed 1 AD JOURNMEI4"I.T Power Company with regard to street light services, for the purpose. of improving some of the exiting services, and additions of needed lights, and that it was considered that the light requested on Garner Avenue should be instal]_ed, also, that increased size of lights on Dora Higl~xway from 2500 to 4000 lumen was justified, in~~tead of 6000 lumen requested, and in event the 4000 lumen were not sufficient, they could be changed later to the 6000 lumen. T_he Council met v'+ith the Board of Trustees of the Oakwood Cemetery Association, and discussed possible means of improving the cemetery. It was stated that the Trustees would very probably be. able to obtain sizeable funds for endowment to be invested an d used in the upkeep of the cemetery, although the Town would have to undertivrite and support current maintenance for several years. It was suggested that the control of the cemetery should be given to the Trustees. There appeared t o be a number of recommen- dations, and it was thought desirable that a special committee from the Board of Trustees and the Council should jointly discuss the matter and develop more specific recommen- dations. The Mayor then appointed Messrs. ~'h.ite, Wirt and Aust, and the Board of Trustees Chairman appointed Mrs. T. J. t~"allner, J.L. Bunts and Mfatta 3t®ger. The meeting was adjourned.
