M., April 8, 1948. A GREEMENT RE. ,The regular monthly meeting of the Council, POSTPHONEMENT due to be held on the first Tuesday of the month,. April 6, 1948, was postphoned to this date by agreement of a majority of the Council, the signed agreement filed in the Town Files. PRESENT. There were present: Mayor A. T. Eskridge, presiding; Verna L. Halton, Clerk; A. W.' Gatewood, Director of Public Works; L. ~. Boothe, Chief of Police; Mrs. Lottie R. Runion, Treasurer; Roby K. Sutherland, Attorney, and Councilmen: C. V. Jackson, F. A. Seagle, I. R. Carper, W. .D. Aust, G. C. Hall and W. F. White. Absent: T. F: Wirt and Howard R. Imboden. MINUTES' The minutes of the regular semi-monthly meeting held on March 16, 1948 were read and approved. BILLS & The bills and payrolls for the month of March PAYROLLS were read, approved and ordered paid. Said bills are given at the conclusion of these minutes. BLD G. PER. The following building permits, coming within the requirements of the Ordinance, were granted: To William - Patton Marvin Patton for two story concrete block (with smcaoth white stucco finish} dwelling on East side of Jefferson Avenue, South, between Bellevue and Hill Terrace, to cost 3,000.00 - White to 4,000.00; To W. Carper, Councilmen of tY1e Fourth Ward, for investigation with power to act: G. M. McMillan for one story cinder block - painted store building on North side of First Street, S. W., between Lagrange and ~lifP Streets, to cost 5,000.00. EZRA D.HALL The Council approved the application of Ezra ~~ Hall 'AUCTIONEER `; BLOCK PER. for permit to operate an auctioneer block for the sale of iribtor vehicles and other items, to be located on the Aust Show gz+bunds on Third Street, N. E. (old Pulaski Iron Company property).; Said application is filed in the Town Files. SMOKE A delegation of residents of the North side of` ABATEMENT DELE GATION Pulaski, represented by Charles E. Bowles, Jr., Attorney, appeared ~, before the Council, stating they were present to hear repos in ' connection with the smoke abatement matter which was brought to the attention of the Council on August 19, 1947, the Southvu~st Times having stated that such reports were expected to be presented. The delegation was informed that such reports "were not available for presentation, whereupon several of those present, namely Charles E. Dyer, Jr. and Miss Effie Boothe spoke at'some length to the Council regarding the urgency of the situatio~ and demanding that action be taken at once by the Council, advi~ing Request that unless such was done immediately, they would be forcec~to appointment of committeer,esort to other means. They requested finally that a smoke~~abate~ ~. ment committee from the Council be appointed to contact at ; certain date the various manufacturers in Town who had beer~~ Council Minutes Contd. Pulaski, Virginia, April 8,1948 presented reports made by the Coal Producers Committee for Smoke Abatement to see what could be done toward alleviating the smoke and soot hazard as soon as possible. The Mayor informed them that some action in line with the request would be taken in executive session. COMMITTEE In executive session, on motion of F. A. APPOINTED EXVE.SES. Seagle, se conded and unanimously approved, the Council authorized (Wirt, the Mayor to appoint a committee of three to contact the various Jackson & V9hite) industries concerned with smoke abatement, and ascertain from them their attitudes in~the matter, said appointed committee to report back to the Council, whereupon the Mayor appointed T. F. Wirt, C. V. Jackson and tiV. F. White, suggesting that they proceed as soon as possible. GEORGE George Baugh, of Floyd Avenue between First and BAUGH REQ. REF. TO Second Streets, South, appeared before the Council stating that STREET C. the street in front of his house was impassable and asking that something be done to improve the condition as soon as possible, whereupon on motion of I. R. Carper, seconded by C. V. Jackson and unanimously passed, the matter was referred to the Street Committee for investigation. ELBERT E. A letter from Elbert E. Kinser, owner Rainbow KINSER - RAINBOW Cabs, who was also present, was read requesting permission to CABS REQ. move his cab stand from 6 South Washington Avenue to the lot -ref, to doing on the North side, and requesting permission to have one Gatewood driveway entrance into the lot, whereupon on motion of C. V. Jackson, seconded by W. F. White and unanimously approved, the matter was referred to A. W. Gatewood for investigation. N.& W. Councilman C. V. Jackson informed the Council SUB-STATION that the N. & W. Railway Company was building a sub-station, calculated to be approximately ten feet by thirty feet, about one-hundred-fifty feet East of Jefferson Avenue on the park area, next to the present railroad track, the sub-station to be of steel construction with concrete base and a high fence around same. On motion of W. F. White, duly seconded and unanimously passed, the Council approved the building of same - as presented, it being understood that~~an application for building permit wou ld be filed in due time with the Town. ~~°" Council Minutes Conttd. ~ Pulaski, Virginia, April 8, 1948 RILEY S. NEW POLICE Chief of Police L. S. Boothe advised the Co~.ncil DEPT. CARS that he had sold the two old police cars, after contacting the Finance Committee and the Mayor personally and receiving their individual approvals, and had purchased two new cars, the differ- ence in cost being merely 362.60, The Council received sa~tle with approbation. PARKING The Mayor informed the Council that the parading METERS ACCT. SETTLED meters installed in the Town had been paid for, the last voldchers to the Karpark Corporation in the amounts of 505.3? and ~5~3.00, and included in the bills at the conclusion of these minuted having constituted the`.last payments on the contract price cif 12,128.50. COMPLAINTS Councilman Carper advised that several people RE. FINES " OVERPARKING had registered complaints concerning the Police Departmentts unwillingness to excuse them for parking violations nor giv~+ them time to obtain nickels when they were short of change. The~~hief of Police informed him that such was not the case, the Department having been counseled and instructed along that line. CROWELL, ~ A bill from Crowell, Deeds & Sutherland, am~anting DEEDS & " SUTHERLAND to 1200.00 for preparation of the Town Charter of 1948 and" TOWN CHARTER PREP. BILL expenses incurred therewith was presented and on motion of I~. A. APPROVED Seagle, seconded by W. F. White and unanimously passed, was approved and ordered paid. DIRECTGt The Director of Public Works reported to this PUB. WKS. REPORTS Council as follows: -A.E.P. contract 1- A contract from the Appalachian Electri0! Power Company had been received in rega to the "Whiteway System" of the Town, and at most matters were well covered in the cdi trac although no provision was made concerni the Townts right to attach signs, fire ala con- nections,' Christmas decorations, etc. t ~ the light posts. He stated that the A. E. Co. had advised they would forward a specia letter granting the•latter privilege at ~n early date. . ~~~ti) Council Minutes Conttd. Pulaski, Va., April 8, 1948 -Aust Sub-Division. Sewer 2- Reporting for the Water and Sewer Cor~nittee on the petition submitted to Council by residents in the Aust Sub-Division for a sanitary sewer, the Committee ,had investigated the matter and, owing to a distance of approximately two thousand feet, the cost of putting in a fewer line in consideration of the absence of resi- dents in that vicinity, the acreage not having been subdivided and laid off into streets, it was their opinion that it would not be practical at the present time to install the sewer line, but that, in the future if the terri- • tort' grew and more connections became available, same should be given further consideration. -Slusher-Third St.,East P. 3- Mrs, L. S. Slusher of Third Street, East Pulaski, had advised him that water was running off of Bank Street onto her property. The Street Committee had in- vestigated the matter and had found same to be caused by a ditch having been filled ' with ashes, etc. He advised that the street had been reditched and so corrected the offending condition. -T.W. Kersey Requests 4- T. W. Kersey asked the Council to approve Sub-division & a small sub-division in West Pulaski in drain pipe what is known as "Kersey Bottom"- a dead- end street located in the vicinity. A sketch, which is filed in the Town Files, was presented which set forth the sub- division layout. • Further, T. W. Kersey requested the Town to furnish and install a drain pipe in that section, stating he would make the road passable if the Town would take such action. A. VJ. Gatewood advised that it was imperative that same be done to give tae citizens in that locality means of ingress and egress to their homes . Same approved On motion of I. R. Carper, seconded by V1. D. Aust and r~nanimously passed, the two requests of T. W. Kersey as outlined above were approved. -Noise Little Rr. bridge 5- He reported that the matter of noise caused by traffic on the bridge in the Little Railroad section, as brought before the Council at the last meeting,, had been investigated and that the noise had been eliminated so far as was practical. -Baptist Church request 6- Dr. Henry b~7artin, representing the First Baptist Church, requested that a space of approximately forty-four feet be painted yellow in front of mentioned church so as to prevent parking and to afford access to same. No action taken -CLEAN-UP WEEK May 3 The matter was not acted upon due to absence of details pertinent to the park- ing situation. 7- He suggested that Clean-Up Week for the present year begin on the third of May to conform to the national date of same. V~ Jackson and unanimously passed, the Council sanctioned the week of May, beginning with the third, as Clean-Up Week and atithor- ized that publication of such action b~ made in the Southwest Times. ~J EV 8c DD DAVIS (SLIDE) 8- He reported that E. V. Davis and D. D.~Davis had secured permit previously for building a service station on the West side of `' Washington Avenue, and that said parties had excavated the bank at said locatiof~., had erected a stone wall to serve as retaining; vrall to hold bank intact, and that recently ~~ the bank pave away, causing a slide ofld' of Columbia Drive. A fence had been erected by the Town around the slide, and he hid, upon advice of the Tovrn attorney, contacted the above parties verbally and by letter, advising them they would be required t~1 take care of any expense incurred by tie Town in correcting the above situations and that they would be required to do whate,was necessary and advisable to put Columbia Drive in a safe and satisfactory condition. , PROCEDURES WHEN Roby K. Sutherland, Attorney for the Town, COUNCIL IS POSTPHONED advised the Council that, under the provisions of the new .Town -Req. under Charter, no Council meeting should be postphoned unless a new charter 1 majority of the Councilmen agreed to same, and that in th~i futur vrhen a meeting was postphoned, it would be necessary to have a signed agreement by a majority of Council filed for a per~ianent record and mention of said agreement duly recorded in the; minutes on each occassion that a meeting was postphoned. RESOLUTION In accordance with instruction of the Town RE. POLICE JUSTICE Attorney, the following; resolution, upon being read in entirety, ADOPTID ' was approved on motion duly made, seconded and unanimously? passed: WHEREAS, the Town of Pulaski, Virginia is a~ incorporated town within the County of Pulaski, Virginia,and for which said county there has heretofore been appointedra trial justice in conformity with the laws of the State of Virginia, and; V`dHEREA5, it is the desire of the Council of'~the Town of Pulaski, Virginia to confer upon and invest in th' police justice of the Town of Pulaski, Virginia, end his ly authorized substitutes, the right and authority to issue warrants, summon witnesses and try cases involving violations of Town Ordianances; ~~ NOW, THEREFORE, BE IT RESOLVED by the Counc~ the Town of Pulaski, Virginia, that the police justice of town and his duly authorized substitues be, and they herel are, authorized and empowered to issue warrants, summon w~~ and try cases involving violations of Town Ordinances, and is conferred upon and invested in said police justice and;: duly authorized substitues all the jurisdiction and autho` conferred upon such police justice by the charter of the of Pulaski, Virginia, all of which is done pursuant to S'e 498?f (6) of the Code of Virginia 1942 as amended. of aid nessa there is ty wn ion ,+4; a_k C7 Council Minutes Contd. Pulaski, Va., April 8, 1948 Be it further resolved that the fees in conneetion•with any such cases and all fines imposed by said police justice or his duly authorized substituts, shall be collected by them and paid into the treasury of the Town, or as the Charter of the Town may otherwise direct. MAYOR ESKRID GE On motion of W, F, White, seconded by NAMED A3 POLICE JUSTICE F. A. Seagle and unanimously approved, the Council designated and appointed Mayor A, T. Eskridge as Police Justice of the Town of Pulaski, Virginia, and directed that he execute the oath prescribed for state officers, and execute a bond of Five Hundred (500.00) Dollars, conditioned upon the faith- ful performance of his duties as Police Justice - it being understood that the Vice Mayor, F. A, Seagle, automatically became his duly authorized substitute. BLANKENSHIP & Upon recommendation of the Chief of Police, ELIZ. CAVES_ ISSUING JUS, and on motion duly made, seconded and unanimously passed, C, G. Blankenship and Mrs. Elizabeth Hudson Caves, Night and Day Desk 8argeants, respectively, were appointed as Issuing Justices. CONTRACT It was the consensus of th® Council A.E.P. CO. that the contract with the A. E. P. Company regarding the "Whiteway System" would be acted upon when a special letter was forwarded from said company granting the privilege of attaching posters, etc. to the light posts. DUNLAP F. A. Seagle, Chairman of the Fire Committee, VENEER SPARKS reported that in accordance with directions of the Council, the MATTER matter of sparks and live embers emitting from the stack at the Dunlap Veneer Corporation had been investigated, and that a letter had been forwarded to said company, admonishi~.g them to take immediate action to correct the condition. He reported receipt of a letter from same which advised installation of new screen and dampers, stating to the Council that he would sea that installation of the same was made. LEAGUE OF On motion of C. V. Jackson, seconded by VA. MUN. W. F. White and duly passed, the Council rescinded its action Action rescinded taken at the m::eting held on February 9, 1948 to withdraw from membership in the League of Virginia Municipalities.
