M.,, May 4, 1948. PRESENT There were present: Mayor A. T. Eskridge, presidi~.g; Verna L. Dalton, Clerk; A. W. Gatewood, Director of Public 1~Orks; L. S. Boothe, Chief of Police; Mrs. Lottie R. ' MINUTES The minutes of the meeting held on April 20, 1948 were read and approved. FRANK J. Frank J. Critter, Superintendent of County School`, CRITZER appeared and asked that the Council consider extension of t~(e water line East on Twelfth Street to the Corporate limits atf Brook Avenue - estimated to be approximately two-hundred-and- seventy-one feet, He also requested that a sewer line for tthat section of the Town be given due consideration. ~PIATER LINE On motion of W. F. White, seconded by T. F. Wirt end EXTENSION 12TH ST. unanimously approved, the Council authorized the building o' AU'T'HORIZED ~' with the additional two-hundred-seventy-one feet of six inch watr .; proviso line on Tw"elfth Street, East of Prospect Avenue to the Corporate limits, providing the County will extend the line with four.; inch pipe to the school property, and will give the Town permission to connect to it for services to outside water customers wYiDm the Town may wish to serve in the future. BROOK AVE. On motion of W. F. White, seconded by F. A. Seag~ie SANITARY SEWER and unanimously approved, the Council authorized that outsikie bids be obtained for the construction of the Brook Avenue ~lani- tary sewer line, according to plans already made by A. 1,Y. ~#ate- wood, and including any additions or revisions made theretb~ by Mr. Gatewood. ;, PARKING On motion•of C. V. Kanode, owner of the Diamond Taxi Company on West Main Street who was present, for permission to open a twelve foot driveway about seventy- five feet East of Randolph Avenue and Second.Street corner, and next to the present Jot-Em-Down-Store in order to park cabs off of the street was granted on motion of W. F. White, seconded by T. F. Wirt and unanimously approved. J.G.QUESENBERRY- J. G. Quesenberry and Reed Livesay of Valley Road DUST VALLEY RD. appeared before the Council, presenting a petition signed by twenty-five residents~in that section, requesting that some action be taken to correct the dust condition on said road, whereupon on motion of I. R. Carper, seconded by Howard R. Imboden and duly passed, the matter was referred to the Street Committee for investigation. BILLS & The regular bills and payrolls for the month of PAYROLLS April were read, approved and ordered paid. Said bills are given at the conclusion of these minutes. BLDG. APP. The following building permit applications, coming APPROVED within the requirements o#' the Ordinance, were granted: -Harmon (col) To Chauncey D. Ryan for frame with brick siding coal house at the rear of residence at 220 Lagrange Street, to cost X100.00. ESSO STANDARD The application of the Esso Standard Oil Company OIL CO. APP. DENIED (by C. W. Perkinson) for permit to build office building ant$. tank to store white gasoline and varsol on the northwest side . of Madison Avenue, between Third and Fifth Streets, to cost,: X2,400.00 was denied on motion of G. C.~ Hall, seconded by Iy R. Carper and unanimously approved. ENFORCEMENT In connection with the denial of the ,above applic~.tion, FIRE HAZARD CONTROL it was brought out that enforcement dealing with fire hazarld control was vital in such matters, whereupon on motion of T. F. Wirt, duly seconded and unanimously approved, the mater was referred to the Ordinance Committee to confer with the 'Saw n Attorney, and to prepare an ordinance, if necessary, for prffisen- tation to the Council at the next meeting. WHITE & GLENN APP The application of White and Glenn (by Mary L. WY te) for permission to erect a scaffold while replacing brick and. making repairs on the North side of the two-story White anc3~~Glenn building on the corner of tiNashington Avenue and Second Strut, °l North to cost .2,450.00, was approved with the provision "t'~at the applicants assume full responsibility to provide properiand adequate protection of the public while the repair work is going on, the applicants to be so notified". PETITION A petition signed by seven residents of Fourth and FUNERAL HOME Jeff. Fifth Streets, North and Jefferson Avenue was read, request~.ng Ave.&5th St. the Council to take action to prevent the location of 'a fur~ral home on the corner of Fifth Street and Jefferson Avenue, wl~re- upon the matter was discussed at length, and after consideration, on motion of G. C. REPORTS Council Minutes Contd. ~ Pulaski, Va., May 4, 1948 subdivided into small lots and the possibility of their being used for buildings which were undesirable in the locality. He stated that a garage apartment had been `erected on one lot by a Mr. Kanode, who had stated that a residence was to be erected at some time on the front of the lot, but that this was neither possible nor probable. The Council took no action on the matter due to the fact that the application of Mr. Kanode had been approved. Council as follows: The Director of Public Works reported to the -Dept. Commerce 1- The Department of Commerce Civil Aeronautics Civil Aeronautics Administration had continued the lease on Administration the watchhouse site at the airport for one year, and also, the lease for installing and maintaining beacon lights for one year -from July 1, 194a - all in accordance with the lease contract with the Town. -Petition water 2- Reporting for the Street and Water Committees, Brown Addition the petition of seventeen residents in the residents Brown Addition for water service had been investigated and owing to several factors, it was recommended that same would not be practical at the present time but should be given consideration in the future. -Geo. ~. Baugh 3- Reporting for the street Committee, the -Floyd Avenue request of George S. Baugh of Floyd Avenue, as made to the Council at the last meeting, had been investigated, and it was their recommendation that the section of the street causing the complaint be repaired as well and as soon as possible. -Tank Car Oil Rec. 4- A tank car of oil for dust control had been received and that same had been distributed on graveled and dirt streets in all sections of the Town. -A.E.P. Co. Contracts- He reported that the two letters setting forth certain privileges not outlined in the prepared contract of the Appalachian Electric Power Company, covering installation and operation of a new whitevaay lighting system, as brought before the Council previously, had been recalled by the company - the letter to be forwarded to the Town finally having to be studied as to legal aspects, etc., and that the company was desirous of the Councils approval of the contract, Mr. Minichan assur- ing the Council that the letter forthcoming would cover the special privileges desired by the Town. Ii~~~ Fr t Pulaski, Virginia, May 4, 198 Whiteway System for the Town, said contract as follows: CONTRACT THIS AGREEMENT entered into .this 1st day of April; 1948 by and between Appalachian Electric Power Company, hereafter called the Company, and Town of Pulaski of Pulaski, Virginia. hereafter called the Customer. WITNESSETH: For and in consideration of the mutual covenants end agreements hereinafter contained, the parties hereto agree kith each other as follows: 1. The Company agrees to provide and maintain a street lighting system for the Customer, consisting of the following number and type of lamps, viz: Number of Lamps Size Type 206 100 C. P. " " n n rr together with electric energy through a general system of o1~er- head distribution, sufficient to operate said lamps.continu~u.sly from one-half hour after sunset until one-half hour before - sunrise, every night and all night,. approximately 4,000 hours per annum during the term of years hereinafter set forth. laid lamps shall be so maintained and operated that they will gi~fle the maximum amount of illumination obtainable under commercial conditions. 2. The Company agrees to install such additional amps of respective sizes and types above specified as the Custom may, from time to time, require upon receipt of a written notiice - from a duly authorized representative of the Customer. Pay~lent for the service of such additional lamps shall be at the ra#e hereinafter specified, provided, however, that one addition lamp of not less than shall be installs for each extension of feet from the str t lighting mains of the. Company. Whenever additional lamps a so ordered, the minimum number of lamps to be furnished thr¢~igh- out the remainder of the period covered by this contract shak~ll be increased accordingly. Temporary lamps, if ordered, sha~~. be furnished under special contract. It is further agreed that the location of the min~#num number of lamps contracted for, as specified in "1" above, shall be as follows : As shown on map in office of the Town of Pulaski 3- All material furnished by the Company shall r9~tnain the property of the Company and may be removed at the termi~.jation of this contract, if the Company so desires. 4. The Company shall keep each and every lamp co jtracte for in operation during the time provided and the Customer r,y make deduction for failure to operate any one or more of sa~kl lamps in the following manner: For all outages which shall be reported daily in vt~iting to the Company by the proper officers of the Customer, the st- omer may deduct from the total monthly amount which would hre been paid for any lamp had no outage occurred, a sum bearin 'the ratio to such total as the period of outage bears to the to 1 time the lamps should have been lighted in any month; provi d, ~~ Council Minutes Conttd. Pulaski, Virginia, May 4, 1948 however, that should the lighting of any lamp or lamps be stopped by unavoidable accident, the Company shall be allowed twenty-four hours after notice of the outage in which to again light such lamp or lamps without being liable to deduction as above provided. 5. It is further agreed that lamps shall be moved by the Company. to such new locations as the proper officer of the Customer may bq writing direct, subject, however, to the following conditions. Such moving of lamps shall be completed within 10 days after receipt by the Company of written notice from the proper officer of the Customer (Sundays, legal holidays and stormy days not to be counted),provided that the number of such removals shall not exceed one per day and provided, further, that such removals of such lamps shall not be required on Sundays, legal holidays and stormy days. Notice that the removal of such lamps has. been completed shall be given by the Company to the proper officer of the Customer within 10 days after the completion of the work. The actual cost to the Company of making such relocations shall be paid by the Customer to the Company within 30 days after such notice has been given. 6. The Customer agrees to accept the service herein contracted for during the term hereof and to pay therefor ~t the following rates: For each 100 C. P. tt tt n n n tr 3.25 tt tt Bills shall be due and payable on or before the 10th day of the month succeeding that in which the service is rendered. TTie above prices are subject to a discount of 2~ if payment in full is made within 30 days of the date of bill. The Customer agrees that in case any additional lamps are ordered it will pay for the same at the rates and in the manner above specified for and during the period from the date of the installation of ,such lamps until the termination of this contract. 7. The Company shall, at its own cost, furnish all lamp renewals during the term of this contract. 8. This contract shall be and remain in full force and effect for a period of 10 years from and after the 1st day of April, 1948. 9. If the Customer shall make default in the pay- ment of any bills as hereinbefore provided, the Company may at its option, after having given 10 dayst written notice of its intention so to do, discontinue the service herein contracted for and continue to withhold the supply of electric energy for street .lighting until such time as the Customer has made payment for all bills in which it is in arrears. Any such suspension of service by the Company shall not terminate this contract unless Company so elects. Other- wise, upon payment by the Customer of the amount it is in arrears, the contract shall remain in full force and effect for the period herein specified. 10. The Customer as a further consideration for the promises and agreements made by the Company herein set forth, hereby grants to the said Company the privilege of the use of the streets, alleys and public places of said Customer for the purpose of placing its poles and equipment for carrying out this contract. ,.,, ~~ 1`•~'~ '. ~~ Council rJlinutes Contd. The Customer agrees that during the life of this contract it will provide in its annual budgets and estimates and levy of taxes sufficient funds to pay the Company any mounts due it. 12. Joe P. Gills. VICE- MAYOR seconded by VJ. D . Aus t and unanimously approved, Mr. F. A. Seagle was appointed Vice Mayor. SMOKE C. V. Jackson reported that, as dicussed at the ABATEMENT last meeting of the Council, the meeting of the Smoke Abatement Committee with the heads of the principal plants concerned with smoke abatement had been held and that the latter had expressed themselves to be willing to cooperate in smoke abatement, although they advised that much smoke was not caused by industries themselves but by homes, and further, the cost of abateing smoke entirely would be too expensive to the individual industries, but they were will- ing to cooperate so far as was possible. RAINBOW The matter of Rainbow Cabs being parked on Wash- CABS ington Avenue and in the vicinity of the N. & W. Railway depot was discussed as being quite hazardous to traffic, A. W. Gatewaod advising that he had tried to cont~fact the owner several times but had not succeeded. It was the con- sensus of Council that a letter should be written immediately to the owner, Elbert E. Kinser, advising him that something 'could have to be done soon to eliminate the traffic hazard caused by the parking of his cabs in the above named locations.
