There were present: Mayor E. W. Calfee, presiding; Lottie R. Runion, Clerk; A. ~. G.ate~ovd, Director of Public Works, and Councilmen: A. T. Eskridge, L. E.I~~itesell, J. E. Bunts, T. L. James, and G. C. Hall. Absent: A. ~~~. Bushong T. J. iNallner and F. A. Seagle. The minutes of the regular meeting held on December 2nd and the special meeting hAld on December 17th, 1941 were read and approved. The bills and payrolls for the month of December were audited, approved and ordered paid. Said bills are given at the conclusion of these minutes. The following building permits coming within the requirements of the ordinance, were granted: To R. J. Coker for a 2-story brick dwelling on the south side of 9th St., N. W., between Jefferson and Randolph avenues, to cost $5600.00; Kermit K. Riggle for 1-1/2-story frame dwelling on the north side of Pico Terrace, East Pulaski, to cost $3500.00; James L. Gibbs for a one-story frame dwelling on the south side of 6th St. N. E., corner of Walnut Avenue and 6th St., East Pulaski, to cost X1,000.00; Fred A. Jackson for one-story fre.me dwelling on the west side of Hiekory Ave., East Pulaski, to cost X1,000.00; H. E. Bocock for one-story brick garage on the east side of YYashington Ave., South, corner of 6th St., to cost X400.00. On motion duly made, seconded and unanimously passed, the Council ordered that the penalty of 5~ be added on February 1st, 1942, on all unpaid 1941 taxes. A petition presented by Mr. I. G. Cecil, and signed by citizens and property owners in the Locust Hill section, requesting that a stop-sign be placed at the intersection of Maple Avenue and Spruce Street, was referred to the Street Comu;ittee for investigation and report. James, the Street Repairs Council agreed to make certain repairs ~n 3~adison Avenue, ~~adison Ave. S. South, dust back of Dvra Highway. The request for a light on Water Street was referred Street Light to Councilman James for investigation. Water St. AGREE- The mayor presented to the Gouncil a copy of agreement ~fENT N & W entered into between the Town of Pulaski and the Virginia RAILWAY Co. Bolding Corporatio n, under date of April 8th, 1941, relative FOLDING to right of way for an 18-inch outfall sewer pipe line. CORP. Said resolution reads as follows: On motion of Councilman A. T. Eskridge, duly secondekt SEWER LINE by Councilman J. E. Bunts, the said deed of easement was DORA approved, accepted and ordered filed with the minutes of HIGHPp~AY this meeting: THIS DEED OF EASE~6.ENT, BADE THIS 8th day of April, 1941, by and between the Virginia Holding Corporation, hereinafter called Grantor, party of the first part, and the Town of Pulaski, a municipal corporation of the Stdte of Virginia, hereinafter called Town, party of the second part, W ITN E S S E T H: 1. WHEREAS, by agreement dated the 17th day of April 1913, the Virginia Company (GrantorTs predecessor in title) granted an easement to the Town for an 18-inch outfall sewer pipe line; and, 2. WHEREAS, a Like agreement of the same date was ex~- cuted between the Norfolk and Western Railway Company and the Town; and, 3. '~iHEREAS, the Railway Company has since acquired k from the Virginia Holding Corporation a portion of the landsa' across which the said sewer pipe line extends; and, 4. Y~HEREAS the Town now desires to enlarge or extend its sanitary sewer system with a 10-inch pipe line in Maple `' _itgenue, conncecting with the 18-inch outfall sewer pipe link above mentioned on the orpoerty of the Railway Company at a, point about opposite to the Railway Company+s ~dile Post N-31~ plus 460 feet; and, , ~' (cont'd) 34~ Council Minutes Cont+d. WHEREbS, it is desired to execute this contract and easement in order that present conditions may be agreed upon, and thereby cancel the said agreement of l~pril 17th, 191 between the Virginia Company and the Town: 6. NOW, THEREFORE, For and in consideration of the premises, the Grantor hereby grants unto the Town the right, privilege and easement to maintain, operate, repair and renew an 18-inch outfall sewer pipe line about 300 feet in length in, under and across its lands in the Town of Pulaski, Virginia, between points about opposite to the Railway Company+s Mile Post N-414 plus 5300 feet and mile Post n-315 plus 315 feet; and to construct, maintain, operate, repair and renew a 10-inch sewer pipe line about 450 feet in length between points about opposite to the Railway Company-s ~1ile Post N-315 plus 485 feet and bile Post N-315 plus 815 feet; and about 240 feet in length between points about opposite to file Post N-315 plus 1200 feet and Mile Post N-315 plus 1430 feet, said 10-inch sewer pipe line to connect with one of same size on the southern right of way line of the Norfolk and Western Railway Company at about opposite to the Railway Company+s mile Post-N-315 plus 485 feet, all as more particularly shown colored red on blue print of Plan N-1964- C, dated January 18th, 1941, in the office of the Chief Engineer of the Railway Company at Roanoke, Virginia, a copy of which is attached hereto and made a part hereof. 7. The terms and conditions of this agreement are as follows: (a} The Town agrees in advance of any construction work herein contemplated to furnish to the Grantor+s Chief Engineer for his approval profiles showing the present ground and proposed grp.de lines of said lO-inch pine line in, upon, across and under its said lands. (b) The Town agrees to construct, complete and maintain said 10-inch sewer pipe line and appurtenances, and to maintain thA existir_~ lA-inch vitrified sewer pipe line 1 (cunt+d) #4 3~5 Council ~dinutes Conttd. Pulaski, Va., Jan. 13, 1942 and appurtenances at its own sole cost and expense, and without cost or expense of any kind whatsoever to the Grantor, and agrees to reimburse the Grantor any expense whatsoever that may be incurred on account of or resulting from the existence construction, repair, maintenance and operation of said serer pipe lines. (c) That all work in connection with the constructio~i, repair and maintenac of said 10-inch sewer pipe lines and existing 18-inch sewer pipe line and their appurtenances on the lands of the Grantor shall be done under the supervisipn and to the entire satisfaction of its Chief Engineer or his duly appointed representative. 8. The Town hereby covenants and agrees to protect, indemnify and save harmless the said Grantor from and against all claims, suits, damages, costs, including attorneys feed losses and expenses, in any manner resulting from, due to, or arising out of the laying, maintenance, renewal, repair, use, existence ot'~ removal of said sewer pipe lines. 9. It is hereby agreed that if the said Grantor sha~~. find it necessary to utilize its premises making necessary thei re-location of said sevaer pipe lines at any of the locations herein referred to, the necessity for which it shall be the sole fudge, the Town will at its own sole cost and expense remove the same to a new location to be later agreed upon or determined. 10. It is also understood and agreed that the agree- ment of April 17th, 1913, between-the Virginia Company and the Town of Pulaski, Virginia, hereinabove mentioned is hereby cancelled. f. IN WITNESS WHEREOF, the said Grantor has executed these presents by its duly authorized officers, and the Town by its Mayor, attested by its Clerk, thereunto duly authorized; by ordinance of its Town Council dated the 8th day of April, 1941, as of the ~{ay, month and year first above written.
