There were present: Mayor A. T. Eskridge, presiding; Lottie R.Runion, clerk; A. W. Gatewood, director of public works, and Councilmen: J. K. Harrison, 0. P. Jordan, L. E. Whitesell, J. E. Bunts, F. A. SQSgle, T. L. James and A. M. Bushong. Absent: G. C. Hall. The minutes of the regular meeting held onFebruary 5, 1943 were read and approved. The regular bills and payrolls for the month of February were audited, approved and ordered paid. Said bills are given at the conclusion of these minutes. One building permit, coming within the requirements of the ordinance was granted, subject to governmental approval, to Ira A. Smith for one-story 4-room frame dwelling on the north si,t~/of N. & W. Railway, back of Steel Plant, to cost X450.00, applicant stating that he had salvaged lumber available for two rooms. POLICE M.C. Pierce submitted the police report for the REPORT month of February, which was ordered filed. A. W. Bushong, seconded by J. K. R.K.Suther- Harrison, and unanimously passed, Roby K. Sutherland was land appointed Town attorney, and his salary fixed at X300.00 per year, effective March 1, 1943. POLICE Mayor Eskridge, acting upon authority .~- -vested DEPT. in him and the chief of police at the4February 5th meeting,. ASST. reported that Mrs. Elizabeth H. Caves had been. employed as switch board operator and ~retary in the police depart- ment at a salary of X100.00 per month, effective March 1, 1943. Bushong and INCREASE unanimously passed, the clerk of the councils salary was increased from X115.00 to ~ti130.00 per month, effective March 1, 1943. HEALTH Mayor Eskridge submitted a report of the Pulaski DEPT. Health Department which was ordered filed. REPORT J. S. DRUNKEN On motion duly made, seconded and unanimously DRIVING passed the folloR~ing ordinance was adopted: ORDINANCE AN ORDINANCE TO BAKE IT UNLAWFUL FOR ANY PERSON TO DRIVE OR OPERATE IN THE TOWN OF' PULASKI, VIRGINIA, ANY AUTOMOBILE OR OTHER ROTOR VEHICLE,ENGINE OR TRAIN WHILE UNDER THE INFLUENCE OF ALCOHOL, BRANDY, RUM WHISKEY, GINS WINK LtUGER BE?~, BEER, ALE, PORTER, STOUT, OR ANY OTHE~ LT~UID, BEVE~AGE 01~ ARTICLE CONTAINING ALCOHOL, OR UNDER THE INFLUENCE OF ANY NARCOTIC DRUG, OR ANY OTHER SELF-ADMINISTERED INTOXICANT OR DRUG 4R WHATSOEVER NATURE: TO PRESCRIBE PENALTIES FOR VIOLATIONS THEREOF, AND TO REQUIRE CONVICTIONS THEREUNDER TO BE REPORTED TO THE DIRECTOR OF THE DIVISION OF MOTOR VEHfCLES. BE IT ORDAINED BY THE COUNCIL OF THE TOWN OF PULAS~I, VIRGINIA, THAT: (1) It shall be unlawful for any person to drive o#! operate any automobile or other motor vehicle, car, truck, ~igive, or train in the Town of Pulaski while under the influence off` alcohol, brandy, rum, whiskey gin, wine, beer lager beer, al.e, porter, stout, or a~y.,,,pther liquid, beverage or article conk; taining alcohol, or~under the influence of any narcotic dr ;, or any other self-administered intoxicant or drug of whatso er nature. ' (2) Any person who violates any provision of this ordinance shall be guilty of a misdemeanor, punishable by a fine of not less than one hundred dollars nor more than ones thousand dollars or imprisonment for not less than one mont~i nor more than six months, either or both in the discretion 0if the Court or fury trying the same, for a first offense, and; the Court may, in its discretion, suspend the sentence during the good behavior of the person convicted. Any person convicted of a second, or other subsequ t offense under this Ordinance shall be punishable by a fine not less than one hundredc~gl.lars nor more than one thousand dollars and by imprisonment for not less than one month nor., more than one year. (3) The judgment of conviction, if for a first offse under this Ordinance, shall of itself operate to deprive th person convicted, of the right to drive or operate any such' vehicle, conveyance, engine or train in this State for a period of one year from the date of such judgment, and if f ~~ a second or other subsequent offense, for a period of three y rs from the date of the 3udgeme3~t of conviction thereof. Pulaski, Va., ~@arch 2, 1943 person has heretofore been convicted of violating any similar Ordinance of the Town~of Pulaski and thereafter is convicted of violating the provisions of Section 1 of this Ordinance, such conviction shall for the purpose of this ordinance be a subsequent offense and shall be punished accordingly; and the Court may, in its discretion, suspend~~~~:_ the sentence during the good behavior of the person convicted, if any person so convicted shall, during the time for which he is deprived of his right so to do, drive or operate any such vehicle, conveyance, engine or train in this Town, he shal be ~Ltilty of a misdemeanor. (4) The Mayor or other trial officer or any other proper official shall, within thirty days after final conviction of any person in his court under this ordinance, report the fact thereof and the name, postoffice address and street address of such person, together with the license plate num- ber of the vehicle operated by such person, to the Director of the Division of rotor Vehicles. ~ • (5) This ordinance is passed and adopted under authority of the general powers vested in the Council of the Town of Fulaskiy Virginia, and with particular reference to Section 4675 (25s) Cade of Virginia, 1936, as amended (Acts of A~ss~bley 1936-7 Ex. Sess. page 3~1), and all former and existing ordinances and portions of any former and «p~.sting ordinances in conflict with this ordinance are hereby repealed.
